TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose. .
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.

SCHEDULE A
All that certain plot, piece or parcel of land with the buildings
and improvements thereon erected, situate, lying and being at
East Marion in the Town of Southold, County of Suffolk and State
of New York bounded and described as follows:
BEGINNING at a point on the southerly side of Oak Court, now
known as South Lane, which point of beginning is situate North
580 58' 30" East 57 . 28 feet from the corner formed by the
intersection of the southerly side of Oak Court, now known as
South Lane, and the easterly side of Orchard Lane;
THENCE from said point of beginning North 580 58' 30" East 17 .44
feet along the southerly side of Oak Court, now known as .South
Lane, to a point;
THENCE South 310 01' 30" East 80 . 00 feet along other lands of the
party of the first part to a point shown on map of property
surveyed for Edward A. Thorp by J. H. Geideman, East Marion; Long
Island, dated June 15, 1994 , revised October 7, 1994;
THENCE South 850 41' 30" East 33 . 55 feet along other lands of the
party of the first part to a point shown on aforesaid map of
property surveyed for Edward A. Thorp;
THENCE South 310 01' 30" East 255 . 00 feet more or less to a point
in the northerly line of Gardiner's Bay (sometimes called Peconic
Bay) at ordinary high water mark, distant 110. 00 feet
southwesterly from the point or intersection of said line of
Gardiner's Bay and the westerly line -of land formerly of Antone
Furst, now or formerly of Thieringer;
RUNNING THENCE Westerly along the said line of Gardiner's Bay at
ordinary high water mark 50. 00 feet more or less to a point;
THENCE North 310 01' 30" West 370. 00 feet more or less to a point
on the southerly side of Oak Court, now known as South Lane, the
point or place of beginning.
Said parcel of property is shown as Parcel " 4 " on said map of
property surveyed for Edward A. Thorp at Gardiner's Bay Estates,
East Marion, Town of Southold, New York, by J. H. Geideman,
Licensed Land Surveyor, dated June 15, 1994 and revised October
7 , 1994 .
BEING AND INTENDED TO BE part of the premises conveyed to the
party of the first part by deed dated September 2, 1993 and
recorded at the office of the Clerk of the County of Suffolk in
Liber 11653 of conveyances at Page 087 .
