TABOR, residing at (No #) Garnett Head Road, RR #1, Box 130 , Pembroke, Maine 04666 , and MARJORIE C. WILLIAMS, residing at 2929 S. E. Ocean Boulevard, 138-8, Stuart, Florida 34996 , as Co- executors of the Estate of E. KENNETH TABOR, who died a resident of Suffolk County, New York, on April 22 , 1994 (Surrogate 's Court File No. 1165 P 1994 , party of the first part; and LYNDA J. TABOR, residing at (No # ) Orchard Street, Orient, New York 11957 , party of the second part. W I T N E S E T H• WHEREAS, the party of the first part is owner in fee simple of a parcel of land at Orient Town of Southold County of Suffolk and State of New York, by a deed dated April 5, 1960 by E. Kenneth Tabor to E. Kenneth Tabor and Ruth V. Tabor, his wife, which deed was recorded in the Suffolk County Clerk ' s Office on April 7, 1960 in Libel 4792.-page 218.1 said Ruth V. Tabor died a resident of Suffolk County, New York, on August 15 , 1991 , leaving E. Kenneth Tabor as surviving tenant by the entirety; said property being more particularly bounded and described as follows: CAX MAP �' ) BEGINNING at a monument at the intersection of the northerly DESIGNATION line of Orchard Street with the easterly line of Tabor Road, and )IST. 1000 from said point of beginning running along said easterly line of ;EC. 025. 00 Tabor Road two courses as follows: (1 ) North 10 47 30 East 270 . 23 feet, thence (2 ) North 80 06130" West- 4. 12 feet to an iron 3LK• 02 . 00 pipe; thence along land of Orient Central Cemetery, North 820 45 ' OT 021 . 000 East 149 .0 feet; thence alongother land of the party of the first -1- Page 2 of 5 Part, South 2° 48 ' 20 " West 356 . 73 feet to said northerly line of Orchard Street; thence along said northerly line of Orchard Street North 65° 23 ' West 152 . 0 feet to the point or place of BEGINNING; and WHEREAS, the party of the second part is owner in fee simple of a parcel of land at Orient, Town of Southold, County of Suffolk and State of New York , by a deed dated January 4, 1971 by E. Kenneth Tabor to Lynda J. Tabor, which deed was recorded in the Suffolk County Clerk ' s Office on January 6 , 1971 in Liber--.,6865 page 339; said property being more particularly bounded and described as follows: OAX MAP ('vs BEGINNING at a point on the northerly line of Orchard Street ' ),ESIGNATION which point is 152. 0 feet easterly from the intersection of said )IST. 1000 northerly line of Orchard Street with the easterly line of Tabor q ad; from said point of beginning running thence along land now SEC. 025 . 00 or formerly of E. Kenneth Tabor and Ruth V. Tabor, North 20 48 ' 3LK. 02 . 00 20 " East 356 . 73 feet to land of Orient Central Cemetery; thence OT 022. 000 along land of Orient Central Cemetery two courses as follows: (1) North 820 45 ' East 121 . 2 feet; thence (2) South 40 14 ' West 421 . 3 feet to said northerly line of Orchard Street; thence along said northerly line of Orchard Street North 650 25 ' West 117. 0 feet to the point or place of BEGINNING; and WHEREAS, due to an error or confusion in the aforesaid deed of the common boundary line between the party of the first part and the second part, the parties desire to fix and definitely establish this boundary line between the two parcels mentioned above respectively owned by' them. NOW, THEREFORE, in consideration of the premises , and the sum of One Dollar by each of the parties hereto to the other in hand paid, the receipt of which is acknowledged, the parties for them- selves , their heirs , executors , administrators, successors and assign , covenant and agree that the boundary line between the -2- Page 3 of 5 respective properties to be established is a line described as follows: P BEGINNING at a point on the northerly line of Orchard Street, which point is 137. 0 feet easterly from the intersection of the northerly line of Orchard Street with the easterly line of Tabor Road, from said point of beginning running thence the following four ( 4) courses and distances: (1 ) North 30 55 ' 30 " East 150. 0 feet, (2) thence North 350 12 ' 20 " East 46 .17 feet, (3) thence North 30 53 ' 00 " East 118 . 0 feet, (4 ) thence North 170 02 ' 40 " West 47 . 0 feet to land of Orient Central Cemetery. The party of the first part hereby remise, release and quitclaim to the party of the second part, their heirs and assigns forever, all of their right, title and interest in and to any land lying to the east of the boundary line so established. The party of the second part hereby remise, release and quitclaim to the party of the first part, their heirs and assigns forever, all of their right, title and interest in and to any land lying to the west of the boundary line so established. It is mutually covenanted and agreed by and between the par- ties that this agreement shall run with the land and be binding to the benefit of their respective heirs , executors , administrators, successors and assigns of each of the parties hereto.
