GALlZIA Property Location: 190 Gillette Drive, East Marion CTM 38-2-2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 11,405 square foot parcel has 102.68 linear feet along Gillette Drive and 104.68 feet in depth along the northerly (side) lot line, and is referred to as Lot 31 on the Map of Marion Manor, filed March 18, 1953 in the Suffolk County Clerk's Office. The property is improved with a single-family, one-story dwelling and accessory shed, as shown on the August 15, 2001 survey prepared by Barrett, Bonacci and VanWeele, P.C. BASIS OF APPLICATION: Zoning Code Section 100-244, based on the Building Inspector's October 6,2005 Notice of Disapproval, concerning proposed additions to the existing dwelling with setbacks at less than 35 feet from the front yard and rear yard lot lines. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a second-floor addition, and two one-story additions, as shown on the plot plan date stamped March 13, 2006. The proposed rear yard is 30 feet from the new addition, and the proposed front yard is 31.8 feet to the concrete stoop construction, at its closest points. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The improvements requested by the applicant are residential and customary to any house in the area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is limited in size to 11,405 square feet, and the house already exists. It would not be feasible for the applicant to reconfigure the entire layout of the home to gain the minimal space he is requesting. '. pa~e 2 - May 11, 2006 . Za File No. 5871 - Henry H. The applicant proposes to add a small stoop onto the front of his house that will encroach 3.17 feet into the restricted yard to allow for an 8 ft. length extending along the front of the house. The applicant will also add a single-story addition encroaching into the rear yard by approximately 4.63 feet, running a 15 ft. length along the rear of the home. The second-story addition to the home will be over the existing first floor area of the home, without reducing the setbacks that have existed over the years. 4. The difficulty has been self-created 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the applicant's plot plan date-stamped March 13, 2006. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
