Box 1181 Cutchogue, NY 11935 RE: 670 WEST CREEK AVENUE, CUTCHOGUE SCTM#: 1000-103-13-5.3 Dear Ms. Doty: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, June 20, 2018: RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Westland Permit#6453 to replace the four (4) 4"x4" support posts at seaward end of catwalk with four(4) 8" diameter 20' long pilings (installed upside down); and as depicted on the project plan prepared by Deborah Doty, received on May 24, 2018, and stamped approved on June 20, 2018. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not an approval from any other agency. The steps are removed during the winter months and stored upland of the wetlands. The end of the dock lifted up twice during the last three winter seasons. Each spring the 4x4 posts had to be driven back into the creek bottom. I am proposing that the four 4x4 posts located in the creek be replaced with four 8" diameter 20' pilings. I grant permission to the Trustees to enter upon my property with respect to this application. Two copies of the application are enclosed. Photos of the four creekside pilings are included within the application. Also enclosed is my check# 10627 payable to the Southold Town Clerk in the amount of$50.00. Catherine Mesiano, Inc. on behalf of DEBORAH DOTY requests a Wetland Permit to construct a 4'X 80' fixed walk (fiberglass grid material), a min. of 1.5' above grade, 4'X lZ2 fiberglass grid panel ramp and cantilevered kayak slide (2-4" pvc pipes). SCTM# 103-13 -5.3 The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (I_.WRP) Policy Standards. Based upon the information provided on the LWRP Consiatcncy Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT w~th the below Policy Standards and therefore is INCONSISTENT with the LWRP. To further the Policies 9.2 and 9.4; The applicant must demonstrate to the Board that the action fully meets the below policies; In addition the LWRP states "Piers, docking facilities, and catwalks must not result in ati unnecessary interference with use of public trust lands. Alternatives to long piers or dccks include use of dinghies to reach moored boats and mooring in nearby marinas. Dcedging solely to accommodate the draft of larger boats is not a recommended al/ernalive ". 9.5 Provide access and recreation that is compatible with natural resource values. 6.3 9.4 Prolect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The applicant has not demonstrated that the following dock standards pursuant to 1~ 275-11. Construction and operation standards have been met (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1 ] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; [3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; [4] Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; [5] Whether the dock will cause degradation of surface water quality and natural resources; [6] Whether the dock will cause habitat fi'agraentation and loss of significant coastal fish and wildlife habitats; [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera manna) and widgeon grass (Ruppia maritima) or shellfish; [8] Whether the dock will unduly restrict tidal flow or water circulation; [9] Whether the dock will be safe when constructed; [10] Whether the dock will adversely affect views, viewsheds and vistas important to the community; [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. Assure public access to public trust lands and navigable waters. Provide access to, and reasonable recreational tt~'e of, navigable waters and public trust lands under water. I. Provide for free and unobstructed public use of all navigable waters below the line of mean billh water for navigation~ recreation~ and other public trust purposes~ including the incidental rights of Imbllc anchoring. 3. Obstruction of navigable waters and underwater lands is limited: to the minimum necessary for access to navigable waters. Thc minimum is determined by evaluating the following factors: (i) the extent of the use's dependence on access to navigable (ii) the range &tidal water level fluctuatic~n, (iii) the size and nature of the body of water, (iv) the nature of public use of the adjacent waters, (v) the traditional means of access used by surrounding similar uses, (vi) whether or not alternative means to gain access are available. by extent and characteristics of the developable adjacent u~land area and its ability to support m-water development for the water-dependent use. by potential adverse effects on natural resources and their uses, and by potential adverse effects on public safety. 9.5 Provide access and recreation that is compatible with natural resource values. Provide appropriate access and associated recreational activity that will avoid potential adverse i~npacts on natural resources. Use the following factors in determining the potential for adverse environmental effects: 1. intensity of the associated recreational, scientific, or educational activity, 2. level of likely disturbance associated with the proposed activity. The following types of access or a,sociated activities are listed in decreasing order of potential for disturbance: a. motorized activities, b. active, non-motorized activities, including water-dependent and water-related uses, c. passive activities, d. avoidance of the area. 3. Sensitivity of the natural resources involved and the extent of the ecological benefits associated with avoidance of the area. D. Provide access using tnetho&' and structures that maintain aad protect open space areas associated with natural resources. The dock was constructed in accordance with the approved design. Upon completion of the structure, Ms. Doty found it precarious, at best, to walk down the ramp, especially when it was wet or seaweed had accumulated on it. Subsequently,Ms. Doty has had a second hip replacement and the finds the ramp much too steep for her to safely walk upon and manage a kayak. At this point she is unable to use the ramp and therefore requests permission to modify the ramp by re-using material used for construction of the ramp and creating 3 steps to grade. No change to the overall length or width is proposed. Attached is a copy of the NYSDEC approved Permit Modification. We respectfully request modification to the existing Trustee Wetlands Permit converting the ramp to steps. As we believe this modification to be minor in nature, we respectfully request an administrative determination. Thank you for your consideration. Also enclosed are two photographs of the existing structure. The dock was constructed in accordance with the approved design. Upon completion of the structure, Ms. Doty found it precarious, at best, to walk down the ramp, especially when it was wet or seaweed had accumulated on it.
