The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed, June 20, 2007:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #6436 to increase the size of the west side of dwelling from 18.4' to 20' within
the setback; increase the size on the east side of the dwelling from 26.4' to 29' within
the setback; covered entry area converted to living space except for entry approx. 3'
wide by 12' long; increase length of dwelling from approx. 64' long to 69' long; and
relocate proposed swimming pool to west side of property, and as depicted on the plans
prepared by James J. Deerkoski dated April 18, 2007.

At the meeting of the Southold Town Conservation Advisory Council held Mon., June
11, 2007, the following recommendation was made:

The CAC has no comment on the application, however, states that this is a prime
example of over-development on the shoreline.

Dear Ms. Witschieben and Ms. Larsen,
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 23, 2006 regarding the above matter:
WHEREAS, applied to the Southold Town Trustees for a permit under the provisions of Chapter
275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated July 31, 2006, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 23, 2006 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has found the proposed construction to be consistent with the policies of
the LWRP, and,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
CAROL WITSCHIEBEN & JANET WITSCHIEBEN LARSEN to construct a two-story addition
to the existing one-family dwelling on pilings; construct a one-car garage; enlarge the existing
patio by 3' in width; re-build the existing covered porch; install a 14'X 30' gunite swimming pool
with cement walkway around pool; repair/rebuild existing driveway with asphalt and stone;
convert part of the pre-existing driveway into a cement patio around pool; install new stone
circular driveway; re-Iandscape property with trees, grass, shrubs and flowers; replace existing
cement walkways removed during demolition work; and replace the existing outdoor shower
with the condition that the drainage be contained from the impervious part of the driveway and
the new part of the driveway be pervious and all as depicted on the plan prepared by James
Deerkoski and last dated July 26, 2006.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The Permittee, Carol Witschieben and Janet Witschieben Larsen ,as part of the consideration
for the issuance of the Permit does understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of South old.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date,
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That iffuture operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. . The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

convert part of the pre-existing driveway into a cement patio around pool; install new

Description: Proposed Addition to Witschieben-Larsen Residence, to be a two-story addition on
pilings.
As a result of the recent" Stop Work Order" issued on June 28, 2006 and the contractor's error during
the excavation of immediately removing part of the existing structure due to a cave-in and structural
problems, building was stopped (building was in progress under a legal permit issued by the Building
Department) and an Administrative Permit was applied for and received from the Trustees permitting
repairs to the foundation of the pre-existing den and family room. This action and pursuant building
delays and related additional expenses for owners, resulted in the necessity for Carol Witschieben and
Janet Witschieben Larsen to again revise the architectural design for the extension to their home and
place the addition on pilings behind the existing structure. The proposed addition to the home will
include (as indicated on the site plan) the following:
I. Two-story addition to existing one family dwelling on pilings, 20 feet long by 30 feet wide.
2. A single-car garage
3. An existing patio enlarged by 3 feet in width. This patio faces beach side
4. Pre-existing deck cover to be rebuilt over part of pre-existing patio, beach side
5. A gunite pool, 14 feet wide by 30 feet long, with cement walkway around pool
6. Repairlrebuild existing fencing at the edge of the beach grass, seaward
7. Repair/rebuild existing driveway. Pre-existing driveway will be repaved with a combination of
asphalt and stone
8. Part of the pre-existing driveway will be converted to a cement patio around cement pool.
9. New circular driveway placed in front of the extension, street side - to be of stone
10. Re-landscape property with trees, grass and shrubs and flowers.
11. Replacement of pre-existing cement walkways removed during demo work.
12. Replace pre-existing outdoor shower.
