Dear Mr. Angell:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 22, 2006 regarding the above matter:
WHEREAS, Alpha Consulting as agent for A. SHELLEY TUPPER applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated
February 27,2006, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 22, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of A. SHELLEY TUPPER
to construct a 4'X 6' access ramp leading to a 4'X 27' catwalk with a 3'X 15' hinged ramp and a
6'X 20' floating dock secured by three (3) float piles with the condition that the decking be of
non-treated wood or the new grating material and all as depicted on the plans prepared by
Alpha Consulting dated 2-24-06.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

A. SHELLEY TUPPER requests a Wetland Permit to construct a 4'X 6' access ramp leading to a
4'X 27' catwalk with a 3'X 15' hinged ramp and a 6'X 20' floating dock secured by three (3)
float piles. Located: 3050 Minnehaha Blvd., Southold. SCTM# 87-3-41
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review ofthe
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
The proposed action is located within Corev Creek. a listed New York State Critical
Environmental Area and Sil!nificant Coastal Fish and Wildlife Habitat Area. Details
rel!ardinl! the habitat desil!nation and status follow below.
Policy 1. Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a
coastal location, and minimizes adverse effects of development.
The 62' total length of the proposed catwalkJramp/float may impede navigation and access
of the water body in this area. 2004 aerial photos indicate that no dock structures are
located immediately adjacent to the subject parcel.
The proposed structure is for private use and will not support a pattern of development
that enhances community character nor preserves "public" open space.

Policy 3. Enhance visual quality and protect scenic resources throughout the Town of South old.
Policv Standard
3.1 Enhance visual quality and protect scenic resources throughout the Town of Southold
including:
A. Minimize the introduction of structural design components (including
utility lines, lighting, signage and fencing) which would be discordant
with existing natural scenic components and character,
The property shoreline is improved with an existing concrete
walllbulkhead and wooden stair which provides access to the water
body. To the southwest one dock structure approximately 72' in
length occurs. To the north west three dock facilities exist ranging
from 31'.1" to 54'.3" (2004 Aerial Photo). Due to the scale ofthe
dock structure and absence of dock structures in the immediate area,
the action does not fully meet this policy, conversely, the applicant
proposes a structure that will extend perpendicular from the shoreline
and affect the scenic quality of the area.
B. Using appropriate siting, scales, forms, and materials to ensure that
structures are compatible with and add interest to existing scenic
components.
The structure scale is inconsistent with the surrounding area. No
other dock structures perpendicular to the shoreline occur adjacent to
the property.
C. Protect visual quality associated with agricultural land, open space and
natural resources.
As discussed, above, the visual quality of natural resources will be
impaired as a result of the action.
Policy 5. Protect and improve water quality and supply in the Town of South old.
The materials used to construct the dock have not been snecified. Please have the applicant
propose the construction materials and methods for the dock structure to meet Section 97-
27 of the Town of Southold Town Code: Construction and operation standards; listed
below in part:
B. Shoreline structures. The following standards are required for all operations
relating to shoreline structures on residential properties. Operations conducted on
properties zoned Ml or M2 may be given greater flexibility in these requirements given the
water-dependent nature of their use.
Additionally to further the above policy and compliance with Section 97-27 of the Town of
South old Town Code and to reduce turbidity in the event that the proposed action is
approved, the following shall be applied:

[3] In order to prevent the release of metals and other contaminants into the wetlands
and waters of Southold, the use of lumber treated with chromated copper arsenate (also
known as "CCA"), commercial copper quat (CCQ), creosote, penta products or homemade
wood preservatives is prohibited for use in sheathing and decking. Similarly, the use of
tropical hardwoods is prohibited unless it is certified by the Forest Stewardship Council or
similar organization. Materials used for structural components shall be determined at the
discretion of the Trustees. (SEE LATEST CHAPTER 97 REVISION)
(2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip
berm and silt booms. The placement of the erosion control structure(s) shall be determined
by the Trustees or their designee. All intertidal construction and excavation reauires the
installation of a silt boom that will retain all suspended sediments within the immediate
proiect area.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems
including Significant Coastal Fish and Wildlife Habitats and wetlands.
The proposed action is located adjacent to Corey Creek, a listed New York State Critical
Environmental area and Significant Coastal Fish and Wildlife Habitat Area and Critical
Environmental Area. Details regarding the habitat designation and status follow.

NARRATIVE
COREY CREEK
LOCATION AND DESCRIPTION OF HABITAT:
Corey Creek and Beach is located on the southwestern shoreline of Great Hog Neck on Little
Peconic Bay, in the Town of South old, Suffolk County (7.5' Quadrangle: Southold, NY). The
fish and wildlife habitat consists of approximately 130 acres of tidal creek, salt marsh, mudflats
and beach. The area around the western shoreline of Corey Creek and Moyle Cove is a
developed residential area and some portions ofthe creek have been dredged and bulkheaded.
The beach is a small sand beach and dredged material area which is somewhat degraded by
human disturbance.
FISH AND WILDLIFE VALUES:
The small disturbed tidal creek and beach found at Corey Creek is not a rare ecosystem type but
the area functions as an important habitat for a variety of fish and wildlife.
Osprey (SC) historically have nested on platforms at this site. A small population ofleast tern
(T) was present on the beach in 1984, but this species was documented only once more through
1996. Piping plover (E, T -Fed) were sporadically documented at Corey Creek beach, ranging
from 0-2 pairs annually during the 1987-1996 period.
Diamondback terrapin have also been seen but the importance of this area to this species is not
well documented. This area may also provide important breeding habitat for horseshoe crab, but
additional documentation is required. The creek serves as a feeding area for the osprey along
with waterfowl, shorebirds and other wildlife. Waterfowl species observed overwintering in the
Corey Creek area include Canada goose, American black duck, mallard, oldsquaw, bufflehead,
red-breasted merganser, surf scoter, and common goldeneye. The creek is a productive area for
marine finfish and shellfish. The area serves as a important nursery area and habitat for shellfish
including bay scallops and hard clams.
The creek was once one ofthe top three areas in Southold for scalloping, however there is no
longer any scalloping in Corey Creek. It is one of the top clamming areas in the town. The creek
area is also locally important for waterfowl hunting. Concentrations of Canada geese at this site
currently present a nuisance and water quality problem.
IMPACT ASSESSMENT:
Anv activitv that would substantiallv degrade the water qualitv in Corev Creek would adverselv
affect the biological productivitv of this area. All species offish and wildlife would be affected
by water pollution such as chemical contamination (including food chain effects resulting from
bioaccumulation), oil spills, excessive turbidity, stormwater runoff, and waste disposal. It is
essential that water quality be maintained in the area to protect the bav scallop fisherv. The
Town of Southold recommends that use of sprinklers and lawn chemicals be minimized or
prohibited on creek waterfront propertv.

Alterations of tidal patterns in Corey Creek (e.g., by modifying the inlet) would have major
impacts on the fish and wildlife species present. Dredging in the creek should be scheduled from
September 15 through December 15 to minimize potential impacts on aquatic organisms and to
allow for dredged material disposal when wildlife populations are least sensitive to disturbance.
Dredged material disposal that alters the creek inlet or tidal flow would negatively impact the
habitat value of this site. Barriers to fish migration, whether physical or chemical, would have a
major impact on the fisheries of Corey Creek. Restoration of fisheries habitat through removal
of such barriers, or other means, should be considered for Corey Creek.
Elimination of salt marsh and intertidal areas, through dredging, loss of tidal connection,
excavation or filling, would result in a direct loss of habitat area. Construction of shoreline
structures such as docks, piers, bulkheads or revetments, in areas not previously disturbed by
development (e.g., natural beach or salt marsh) may result in a loss of productive areas which
support the fish and wildlife resources of Corey Creek. Alternative strategies for the protection
of shoreline property should be examined, including innovative, vegetation-based approaches.
Control of invasive nuisance plant species, through a variety of means, may improve fish and
wildlife species use of the area and enhance overall wetland values.
Unrestricted use of motorized vessels including personal watercraft in the protected, shallow
waters of bays, harbors, and tidal creeks can have adverse effects on aquatic vegetation and fish
and wildlife populations. Use of motorized vessels should be controlled (e.g., no wake zones,
speed zones, zones of exclusion) in and adjacent to shallow waters and vegetated wetlands.
Nesting shorebirds inhabiting Corev Creek are highlv vulnerable to disturbance by humans,
especiallv during the nesting and fledging period (March IS through August IS). Significant
pedestrian traffic or recreational vehicle use of the beach could easily eliminate the use of this
site as a breeding area and should be minimized during this period. Recreational activities (e.2"..
boat and personal watercraft landing, off-road vehicle use, picnicking) in the vicinitv of bird
nesting areas should be minimized during this period. Predation of chicks and destruction of
eggs or nests by unleashed pets (e.g., dogs, cats) and natural predators may also occur, and
predator control should be implemented where feasible. Fencing and/or continued annual
posting of shorebird nesting areas should be provided to help protect these species. Control of
vegetative succession, through beneficial use of dredged material or other means may improve
the availability of nesting habitat in this area. The Corey Creek site is particularly disturbed by
use of off-road bikes and other vehicles; recreational vehicles should be prohibited from the area
during the March IS-August 15 shorebird nesting period.
Activities during dock construction can destroy vegetation either above or below the tide line by
pulling them from the substrate or destroying their root system. The peat beds underlying salt
marshes can also be compacted through the improper use of heavy equipment.
In sea grass beds, the installation of pilings may have immediate impacts as well as cause long-
term changes. Installation through 'jetting" with high-pressure hoses typically disturbs a
surrounding area- depopulating grasses there prior to construction. Once areas are depopulated,
the presence of pilings may lessen chances of regrowth. Beal, Schmit, and Williams (1999)
suggest that changes in seagrass communities in the vicinity of pilings may be caused by the
modification of currents, sediment deposition, attraction ofbioturbators, and leaching from
chemicallv treated wood.
Both marsh grasses and sea grasses have adapted to living in extended periods of sunlight. Their

photosynthetic pathways vary from many terrestrial plants allowing them to be highly productive
in their natural settings. Shading can have significant impacts on the health and productivity of
these plants. It is recommended that the Board minimize shading from dock structures to the
greatest extent possible.
The proposed construction methods of the dock strucutre have not been identified. It is
recommended that the applicant identify the proposed construction practices.
Based upon the above, the action is inconsistent with the following policy standards.
Policv Standards
6.1 Protect and restore tidal and freshwater wetlands.
The proposed action will result in a net loss of tidal wetlands.
6.2 Protect vulnerable fish, wildlife, and plant species, and rare ecological communities.
It is recommended that the proposed action be amended to further the above policy and
subpolicies and comply with Section 97-27 of the Town of Southold Town Code (below).

(7) Critical environmental areas. At the discretion of the Board of Trustees, any
operations proposed in critical environmental areas (~97-11) may be subject to more
stringent requirements than detailed in this section. Such requirements may include, but
are not limited to, denial of certain operations, shortening or reducing the size of
structures, and increasing the width of non disturbance buffers.
Policy 8. Minimize environmental degradation in Town of Southo/d from solid waste and
hazardous substances and wastes.
See Policy 5 response above.
Policy 9. Provide for public access to, and recreational use of coastal waters, public lands, and
public resources of the Town of South old.
9.4 Assure public access to public trust lands and navigable waters.
A. Provide free and substantially unobstructed passage along public trust
shorelands.
E. Provide access to, and reasonable recreational use of navigable waters and
public trust lands under water.
I. Provide for free and unobstructed public use of all navigable waters below
the line of mean high water for navigation, recreation, and other public
trust purposes, including the incidental rights of public anchoring.
2. Permit limited obstruction of public use, including navigation, in
navigable waters:

a. for water-dependent uses involving navigation and commerce
which require structures or activities in water as part of the use.
b. for commercial recreational boating facilities, provided that the
loss of navigable waters and use of underwater lands is offset by
sufficient public benefits.
c. in order to gain reasonable access to navigable waters from
riparian lands.
3. Obstruction of navigable waters and underwater lands is limited:
a. to the extent that it interferes with commercial navigation. The
right of commercial navigation is superior to all other uses on
navigable waters and may not be obstructed.
b. to the minimum necessary for access to navigable waters. The
minimum is determined by evaluating the following factors:
(i) the extent of the use's dependence on access to navigable
waters,
(ii) the range of tidal water level fluctuation,
(iii) the size and nature of the body of water,
(iv) the nature of public use of the adjacent waters,
(v) the traditional means of access used by surrounding similar
uses,
(vi) whether or not alternative means to gain access are
available.
Piers, docking facilities, and catwalks must not result in an
unnecessary interference with use of public trust lands.
Alternatives to long piers or docks include use of dinghies to reach
moored boats and mooring in nearby marinas. Dredging solely to
accommodate the draft of larger boats is not a recommended
alternative.
c. by extent and characteristics of the developable adjacent upland
area and its ability to support in-water development for the water-
dependent use.
c. by potential adverse effects on natural resources and their uses, and
d. by potential adverse effects on public safety.
4. Structures extending beyond the minimum necessary for access to
navigable waters impair public trust interests and open space values
associated with the water's surface. Allow such structures only in the
following circumstances:
a. when necessary for practical and convenient operation of water-
dependent industry or commerce, and provided that obstruction of
commercial navigation does not result.
b. for commercial recreational boating facilities provided that:
(i) the loss of navigable waters and use of underwater lands is
offset by sufficient public benefit, and
(ii) obstruction of commercial navigation does not result.
c. when the principal purpose of the structure is necessary:
(i) to provide public access for recreational uses
(ii) for improvements for navigation
(iii) for protection from coastal hazards, or
(iv) for essential public transportation and transmission
facilities.

The proposed action will remain private and will not support a pattern of development that
enhances community character nor preserves "public" open space. Additionally, due to the
location and scale of the structure access of navigable waters may be impeded.
Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent
uses in suitable locations.
Due to environmental designations of the location this area may not be suitable for the
construction of the proposed action at the scale. Note, that the applicant currently enjoys
access to the water.
10.3 Allow for continuation and development of water-dependent uses within the existing
concentration of maritime activity in harbors, inlets and creeks.
A. Ensure that vublic actions enable these harbors. inlets and creeks to continue to
function as concentrations of water-devendent uses.
B. Protect and enhance the economic. vhvsical. cultural. and environmental attributes
which make uv the character of these harbors. inlets and creeks.
10.4 Minimize adverse impacts of new and expanding water-dependent uses and provide for
their safe operation.
A. Limit the potential for adverse impacts associated with development of a new water-
dependent use by promoting the location of new development at appropriate sites.
Appropriate sites include:
I. sites which have been previously developed,
2. sites which require minimal physical alteration to accommodate
development,
3. sites that already possess public infrastructure or locational characteristics
that would support a water-dependent use.
B. A void development of new water-dependent uses at sites that are located outside of
the traditional concentrations of water-dependent uses or at sites that exhibit
important natural resource values or where the proposed use will cause significant
adverse affects on communitv character. surrounding land and water uses. or scenic
qualitv.
The proposed action is located within a Significant Fish and Wildlife Habitat Area and
designated Critical Environmental Area, an area that demonstrates important natural
resource values, and is not located within a location of traditional water dependent use
(Marina) therefore the proposed action is inconsistent with this policy.
Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the
Peconic Estuary and Town waters.
C. Foster the occurrence and abundance of the Town's marine resources through:
I. protection of spawning grounds, habitats, and water quality,

11.2 Provide for commercial and recreational use of the Town of Southold's
finfish, shellfish, crustaceans, and marine plants.
A. Maximize the benefits of marine resource use so as to provide:
I. a valuable recreational resource experience,
2. viable business opportunities for commercial and recreational fisheries.
The proposed action will result in a net loss of tidal wetlands and marine bottomlands in a
ecological significant habitat area and therefore does not support the above policy(s).
It is recommended that the Board of Trustees require the following outstanding items and
issues be submitted and resolved to further the policies and intent of the Town of Southold
Local Waterfront Revitalization Program:
1. The proposed action is located adjacent to Corey Creek, a listed New York State
Critical Environmental area and Significant Coastal Fish and Wildlife Habitat Area
and Critical Environmental Area.
2. By nature ofthe location of the parcel the applicant currently enjoys access to the
water. The use and need of the dock have not been identified. Please have the
applicant identify the use and establish the need.
3. The proposed construction methods and timber materials have not been identified.
4. The application does not propose mitigation to areas impacted through the
construction of the dock or construction best management practices to minimize
adverse impacts to the greatest extent possible. (Turbidity controls etc...)
Correspondingly, the potential impact of any Unlisted Action on the environmental
characteristics of the Coastal Environmental Area is a relevant area of environmental
concern and must be evaluated in the determination of significance prepared pursuant to
Section 617.7 ofSEQR.

1. All applicants for perrnits* including Town of Southold agencies shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfron' Consistency Review Law. 'This:
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.
