The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, January 23, 2008:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #6431 to reduce the size of the proposed extension from 3,147 square foot to
2,454 square feet, increasing the distance from the bulkhead from 40 square feet to 46
square feet, eliminate the proposed second-floor addition on the garage, and remove
the shed at the east to increase the size of the side yard, and as depicted on the site
plan prepared by Robert Bassolino, last dated December 10, 2007, and received on
December 19, 2007.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Members,
I have revised the proposal that reduces the proposed construction.
.Enclosed please find revised site plan dated December 11,2007 indicating a reduction in the
proposed. extension as approved by the Town Trustees on August 23,2006 and the Board of
Appeals on October 5, 2006.
The changes are as follows:
Total coverage is reduced from 3147 sfto 2454 sf and from 19.99% to 15.58%.
Distance from new construction to the bulkhead is increased from 40 ft to 46 ft.
A second floor on the garage will not be built. The garage will remain as existing except for
the removal of the shed at the east to increase the size of the side-yard.
I will also submit complete plans and revised application with the Building Department
reflecting the reduction in scope. Also, we will comply with all of the conditions in the
original approval.
Please advise me if this submission is acceptable and if so, when the hearing will take place.

TERMS AND CONDITIONS
The Permittee John & Marie Shack. residing at 1265 Shore Dr.. Greenoort, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Bassolino:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., August 23, 2006 regarding the above matter:
WHEREAS, Robert Bassolino, RA on behalf of JOHN & MARIE SHACK applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated June 9, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268-5.H, said application was found to be
Consistent with Policy 6 of the Local Waterfront Revitalization Program policy
standards, by the Board of Trustees, and will further the policies through the following
actions: the proposed building extension to the south was reduced by 5', the addition of
drywells and gutters, a line of staked hay bales will be in place during construction, and
the installation of a 10' non-turf buffer landward of the bulkhead, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 23, 2006, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JOHN & MARIE
SHACK to construct an extension to connect the existing residence to the detached
garage and add a second floor, with the following conditions: drywells and gutters are
installed to contain the roof run-off, a line of staked hay bales is installed along the
seaward side of the dwelling during construction, the installation of a 10' non-turf buffer
along the bulkhead, and the three large trees are to remain, and as depicted on the plan
prepared by Robert Bassolino, RA dated July 24, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

To the Trustees:
This letter outlines my concerns and objections to the proposed construction and related
permit to be issued to John and Marie Shack for their property (1265 Shore Dr, Greenport)
which is adjacent to my home. The SCTM# is 1000-47-2-26-1
1195 Shore Drive is my only residence and I live here year round. I believe several aspects of
the proposed construction plan would significantly alter the value of my property and the
quality of my life. My objections are outlined below:
The plan calls for a two story, two car garage to be built 7' 11" from my property line. The
second story of the garage will be used as an accessory apartment (rental unit as described to
me by my neighbor). The exclusive method of entrance and exit for this apartment appears to
be about 10 ft from my property line, which will subject me to the pedestrian traffic of their
renters. If approved this will be the only rental unit of its type on our block.
I believe the size of the garage, setback of the garage, addition of a rental unit and siting of
the entrance of the unit are all impositions on me and devalue my property.
The new construction is also being sited much closer to the bay restricting my view. The siting
of this construction is inconsistent with siting of the other homes on our block and creates a
situation where the Shack's proposed home will crowd the views of its adjacent neighbors.
The plan also calls for the removal of 7-8 mature trees, impacting the green belt surrounding
the preserve located directly across the street.

CONSERVATION ADVISORY COUNCIL
TOWN OF SOUTHOLD
At the meeting of the Southold Town Conservation Advisory Council held Mon., July 17,
2006, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH
CONDITIONS of the Wetland Permit application of JOHN & MARIE SHACK to
construct an extension to connect existing residence to detached garage and add a
second floor.
Located: 1265 Shore Dr., Greenport. SCTM#47-2-26.1
The CAC recommends Approval of the application with the Condition drywells and
gutters are installed to contain the roof run-off, a 20' non-turf buffer is installed, and
replacement of the trees that will be taken down. The CAC also recommends the
Trustees address the asbestos siding on the dwelling and review the alignment with the
neighboring houses.

Board of Town Trustees:
At the July 19th hearing the following requests were made by the Board:
1. The proposed building extension to the south [towards the bulkhead] should be reduced
by 5 feet.
This was done. A revised site plan dated July 24, 2006 is submitted.
2. Adjacent buildings located.
An additional site plan dated July 24, 2006 indicating the buildings is submitted.
3. A 10 foot wide non planted area along the bulkhead is to be included.
The additional site plan indicates this together with the three large trees that will remain
together with some proposed bushes at the bulkhead side.
4. A survey with the proposed construction indicated.
This is submitted under separate cover.
5. The location of the septic and storm system.
This is indicated on the site plan dated July 24,2006.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based
upon the information provided on the L WRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT
with the L WRP.
Policy 6
Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The proposed addition to the residence from a tidal wetland is proposed at 39 feet: a minimum
separation distance of 100' is required pursuant to Chapter 97-12. Please require that the
applicant amend the application to meet the above policv.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Department to enlarge the existing one fami!Y.re~il1':'l'ice at the above location, It will remain a
one family residence with the addition of an accessory apartment.
Enclosed please find 6 complete sets of applications together with 6 of the required items
referencing P 97-21. Also included is a location map.
1. The applicant is the architect, Robert Bassolino, a notarized consent form from the
owner, John and Marie Shack is submitted.
2. The work is expected to commence in June of2006 and be completed in the summer of
2007.
3. The work is to enlarge an existing one family residence.
4. The material to be removed is approximately 27 cu yd of soil from the foundation
excavation. The enlarged building will be approximately 90' x 35'. A site plan is
submitted.
5. The site plan indicates the proposed work.
6. The foundation will go to a depth of approximately 4 ft. The site is level at the building
and gently slopes to the bulkhead @ 1 in 10.
7. The excavated soil will be trucked from the site. The extensions will be erected as per
Building Department approved plans by a general contractor.
8. A survey by a licensed surveyor is submitted. The site is level at the area of the
extensions. There is no construction within 39 ft of the existing bulkhead. The submitted
site plan indicates the area of construction.
9. There will not be any effect on the wetlands or the tidal waters.
10. A permit was issued to reconstruct the existing bulkhead.
11. The only permit issued was to rebuild the bulkhead, a copy is submitted. All appropriate
applications for the proposed work will be filed.
12. The only proposed activity is limited to minor excavation for the foundation there will be
no change in grade. All access will be from the street across the front lawn. The area of

landscaped.

A. INSTRUCTIONS
I. All applicants for permits. including Town of Southold agencies, shall complete this CCAP for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other infonnation used by a Town of Southold agency in
making a determination of consistency. · Except minor exempt actions including Building Permits
and other ministerial pemlits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the TO"'l'l1 of Southold 1.oeal .
Watemont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this fOIDl is answered "yes", then the proposed action niay affect the
achievement of the L WRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
detennination that it is consistent to the maxinlum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
