Dear Mr. Fitzgerald:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 21, 2006 regarding the above matter:
WHEREAS, Proper-T Permit Services as agent for CLEAVES POINT CONDOMINIUMS
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May
12,2006,and
WHEREAS, said application was referred to the South old Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
June 21, 2006 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Board ofTrustees approve the application of CLEAVES POINT
CONDOMINIUMS to place 200+-CU YDS of clean light-textured sandy soil to create a dune-like
feature 120+- long and 15+- wide, to be planted with native species and such other vegetation
as recommended in the USDA-NRCS planting plan dated 6/21/06 and install a rock revetment
40+-long and 8'-12' wide for erosion control and all as depicted on the plan prepared by Sea
Level Mapping and annotated 6/21/06.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

TOWN OF SOUTHOLD
At the meeting of the Southold Town Conservation Advisory Council held Wed., June
14,2006, the following recommendation was made:
CLEAVES POINT CONDOMINIUMS to place approx. 200 cy. of clean beach sand fill to
construct dune-like feature in curving area approx. 165' long by 10' wide; install low-
profile rock revetment on filter .cloth on seaward face of sand fill, using 200-300 lb. rocks
in an area approx. 135' long and 8'-12' wide.
Located: 2820 Shipyard Lane, East Marion. SCTM#38-7-15
Jack McGreevy made an inspection and he recommends Disapproval of the application
because there should be no hardening of the shoreline in that area.

A site visit was conc:Iut:tcd at the Cleaves 38.7.1500
June 19'",2006. A section oCtile shoreline bas been breached with the saltwater damaging a section
of the lawn.
The eastern edge of the shorc1inc bo.dr..i." the eroded area bas a roc:k mro::b..-l pootecting this
section of the point. The western edge has a small sandrisc pl~ bybcacharass. The section of
iDterest is a low, sand lIIId stone beach that bas a stight slOf~ard the south (water's edge). This
area is allowing the wllter to intrude 00 the grass causillg . The Southold Town Board is
allowing an additional 40 feet of roek with the rest in v..~i..., cover. This can, under the correct
conditiollS, worlc.
Looking lit the topographic map that you provided, the elevations along the shore should be bro.
lIP to a coDSistcnt elevation of 6.4 with good light-textured S1mdy soil The berm should be fifteen
feet wide. A gcote;xtiIe mat can be staked onto it for lICIded. protection while the grasses begin to
establish themselvcs. 'Cape' American beacbgrass is a logical choic;c for this area. However, it
would be advantageous to pilpt a diversity 0(' grasses. A mixture of wann season grasses can be
spread on the lJfOUIId before the "'-~ is P'fnt"'" Spreading the seeds prior ::llanting the
beachfll'&$S WIll aid in incotporation due to foot traffic and sand disturbance. A g mix would .'
include: 'BlackWIIII' swit.chgrass at 4 PLS Ibslac., 'Atlantic' coastal panic;grass lit 5 PLS Ib5fac., Salt

CLEAVES POINT CONDOMINIUMS requests a Wetland Permit and Coastal Erosion Permit
to place approx. 200 cy. of clean beach sand fill to construct dune-like feature in curving area
approx. 165' long by 10' wide; install low-profile rock revetment on filter cloth on seaward face
of sand fill, using 200-300 lb. rocks in an area approx. 135' long and 8'-12' wide. Located: 2820
Shipyard Lane, East Marion. SCTM#3 8-7-15
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department as well as the records available to me, it is my recommendation that
the proposed action is generally CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP.
Pursuant to Chapter 95, the Boar;:! of Trustees shall consider this recornrnendationm preparing
its written determination regarding the consistency of the proposed action.

munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The placing of clean sand fill and the installation of a low-profile rock revetment
which extends an existing rock revetment is not inconsistent with the character of
the waterfront community, and because there are no plans, nor is it possible, to in-
crease the development of the relatively small area it is felt that there is no adverse
impact on the desired preservation of open space. Infrastructure use is not a factor
since the project is to extend an existing erosion-control structure. The project is
certainly beneficial in supporting and maintaining an existing use of the coastal 10-
cation, without any incremental increase in development in the area.
Policy 2 Preserve historic resources of the Town of Southold.

There is no evidence to indicate that the immediate area of the project includes his-
toric features, and it is to be expected that the mainly close-shore nature of the pro-
ject area is unlikely to have been the site of activities of past civilizations.

Enhance visual quality and protect scenic resources throughout the Town of
South old.

The proposed dune construction, including planting of native species of vegetation,
does not involve changes to or the addition of any above-ground unnatural struc-
tures and upon its completion its effects will enhance the vista from both land and
water. It is compatible with other existing shoreline features and activities in the
area, and will not adversely affect the dynamic landscape elements (tidal fluctua-
tions, seasonal vegetation changes; seasonal/diurnal changes in ambient light)
which might contribute to ephemeral visual qualities.

Minimize loss of life, structures, and natural resources from flooding and ero-
sion.

It is intuitively obvious that the likelihood of the activity proposed contributing to
increased hazards which could result in the losses listed is minimal. Natural protec-
tive features are, in fact, being enhanced and strengthened, and will not be ad-
versely affected

Protect and improve water quality and supply in the Town of Southold.

The proposed project does not include any activity which will have a long-term
adverse effect on water quality and supply. The placing of the clean sand fill to
construct and dune-like area to replace the one lost to erosion may be beneficial in
that it will prevent the inundation of a large portion of the lawn area and may re-
duce the leaching of salt water into the ground water below the lawn area. Liquid
or solid wastes will not be discharged into the water or wetlands before, during, or
after the project work.
Protect and restore the quality and function of the Town of Southold's ecosys-
tem.

Policy 6
The area of the project has been damaged by erosion in that an existing dune-like
area has been washed away and a portion of the area landward of that has been
eroded. The project is intended to restore the .dune-like area and provide protection
against ordinary future erosion. During installation existing areas of wetlands
vegetation, if any, will be protected insofar as possible. The project is near, but not
included in, the Orient Harbor Significant Coastal Fish and Wildlife Habitat. The
nature of the project, considering that it is the extension of an existing approved
erosion-control feature, is such that there will be no new impacts on any of the re-
sources listed in the NYSDOS narrative for the nearby Orient Harbor. All statutory
and regulatory requirements, at all levels of government, will be strictly complied
with.
