Box 617 Cutchogue, NY 11935 RE: CLEAVES POINT CONDOMINIUMS 2820 SHIPYARD LANE, EAST MARION SCTM# 38-7-15 Dear Mr. Fitzgerald: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 21, 2006 regarding the above matter: WHEREAS, Proper-T Permit Services as agent for CLEAVES POINT CONDOMINIUMS applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 12,2006,and WHEREAS, said application was referred to the South old Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 21, 2006 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, 2 . . RESOLVED, that the Board ofTrustees approve the application of CLEAVES POINT CONDOMINIUMS to place 200+-CU YDS of clean light-textured sandy soil to create a dune-like feature 120+- long and 15+- wide, to be planted with native species and such other vegetation as recommended in the USDA-NRCS planting plan dated 6/21/06 and install a rock revetment 40+-long and 8'-12' wide for erosion control and all as depicted on the plan prepared by Sea Level Mapping and annotated 6/21/06. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Infrastructure use is not a factor since the project is to extend an existing erosion-control structure. The project is certainly beneficial in supporting and maintaining an existing use of the coastal 10- cation, without any incremental increase in development in the area. Policy 2 Preserve historic resources of the Town of Southold. ~S 0 NO 0 NOT APPLICABLE There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that the mainly close-shore nature of the pro- ject area is unlikely to have been the site of activities of past civilizations. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of South old. ~S 0 NO 0 NOT APPLICABLE The proposed dune construction, including planting of native species of vegetation, does not involve changes to or the addition of any above-ground unnatural struc- tures and upon its completion its effects will enhance the vista from both land and water. It is compatible with other existing shoreline features and activities in the area, and will not adversely affect the dynamic landscape elements (tidal fluctua- tions, seasonal vegetation changes; seasonal/diurnal changes in ambient light) which might contribute to ephemeral visual qualities. . . Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. ~S 0 NO 0 NOT APPLICABLE It is intuitively obvious that the likelihood of the activity proposed contributing to increased hazards which could result in the losses listed is minimal. The placing of the clean sand fill to construct and dune-like area to replace the one lost to erosion may be beneficial in that it will prevent the inundation of a large portion of the lawn area and may re- duce the leaching of salt water into the ground water below the lawn area. Liquid or solid wastes will not be discharged into the water or wetlands before, during, or after the project work. Protect and restore the quality and function of the Town of Southold's ecosys- tem. ~YES 0 NO 0 NOT APPLICABLE Policy 6 The area of the project has been damaged by erosion in that an existing dune-like area has been washed away and a portion of the area landward of that has been eroded. The project is intended to restore the .dune-like area and provide protection against ordinary future erosion. During installation existing areas of wetlands vegetation, if any, will be protected insofar as possible. The project is near, but not included in, the Orient Harbor Significant Coastal Fish and Wildlife Habitat. The nature of the project, considering that it is the extension of an existing approved erosion-control feature, is such that there will be no new impacts on any of the re- sources listed in the NYSDOS narrative for the nearby Orient Harbor.
