WHEREAS, DECLARANT(S) Is/are the owner(s) of certain real property located on 1010 Maple Lane,
Greenport, Town of Southold, County of Suffolk, State of New York, described in the Suffolk County Tax
Map as District 1000, Section 35.00, Block 05 00, Lot 027.000 which is more particularly bounded and
described as set forth in Schedule "A" annexed hereto, hereinafter referred to as the Property,
WHEREAS, the Property is situated on lands within thelurisdicbon of the Board of Trustees of the Town of
Southold (hereinafter the "Trustees') pursuant to Chapter 275 of the Town Code of the Town of Southold
or its successor, and various activities conducted upon the property may thus be subject to the regulation
and approval of the Trustees prior to being conducted.
WHEREAS, the DECLARANT(S) therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities, the
Trustees required that a 10' non -turf buffer be installed and perpetually maintained adjacent to and
landward of the bulkhead;
WHEREAS, THE Declarant has considered the foregoing and has determined that the sarrra will be in the
best interest of the Declarant and subsequent owners of the property;
NOW, THEREFORE, the DECLARANTS) doldoes hereby covenant and agree as follows,
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and perpetually maintained a 10' non -turf buffer landward of the bulkhead as
defined by Chapter 275 of the Town Code, to wit: °a designated area where turf grass,
pesticides and fertilizers are not permitted" and as depicted on the plan prepared by En -
Consultants, Inc last revised September 5, 2006; and as described ;n the Trustee Permit
6416 (attached as Exhibit herewith),
2) These covenants shall run with the land and shall be binding on the DECLARANT(S),

The Board of Town Trustees took the following action during its regular meeting held on
Wed., July 19, 2006 regarding the above matter:
WHEREAS, En -Consultants, Inc. on behalf of DONALD & JOAN BREHM applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated June 19, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 19, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

The captioned application recently assigned to you contains an error in the submitted land survey, project
description, and project plan, all of which reference the need to remove and replace (for the purpose of the
bulkhead replacement) (2) 6' x 20' floats, when in fact there exists (1) 6' x 20' float and (1) 6' x 30' float.
Thus, please correct our application accordingly and substitute the attached surveys and plans for those
submitted with our application.
Please also find attached a copy of a letter from the Cleaves Point Property Owners Association, which
authorizes the proposed incidental dredging of the canal bottom, which is privately owned by the
Association.

As agreed upon by the Town of Southold Trustees and the applicants, rather than replace the existing
bulkhead in place, the applicants now propose to construct the new bulkhead up to 8 feet landward of the
existing structure in order to create a continuous line between the ends of the northerly and southerly
adjacent bulkheads and remove the existing jog at the southerly bulkhead. It is my understanding that
James King, Chairman of the Town Trustees, has discussed this modification with Charles Hamilton and
that Mr. Hamilton would be agreeable to the change.
As a result of this change, approximately 125 cubic yards of sandy upland fill material would need to be
excavated and dredged to a depth of up to-4'ALW, and this material would be trucked offsite to an
approved upland source. In order to avoid creating a gulley immediately in front of the new bulkhead, the
shoaled area up to 10 feet seaward of the existing bulkhead (i.e., the area ranging from 10 to 18 fent
seaward of the new bulkhead) would still need to be dredged to a depth of-4'ALW, resulting in
approximately ±25 cubic yards of dredged spoil to be used as backfill.
Four (4) copies of a revised project plan depicting these modifications are attached hereto. Please let me
know if you have any questions or require any additional information. By copy of this letter and revised
plans, I am similarly notifying all other involved regulatory agencies.

(in-place) an existing timber bulkhead with a vinyl bulkhead and incidentally dredge a maximum
of 25 cubic yards lost backfill material from a 10 -foot area adjacent to the new bulkhead, which

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
