WITNESSETH:
WHEREAS, the Declarant has title to certain land situate, lying and being at
2000 Sound Drive, Greenport, Town of Southold,~uffolk County, New York, SCTM
#1000-33~1-18 said land being more particularly described in Schedule A which is

WHEREAS, the Property is situated in or adjacent to lands activities upon which
are regulated by the Town of Southold Board of Trustees pursuant to Chapter 275 of
the Town Code of the Town of Southold, as may be amended, and various activities
conducted upon the property are subject to the jurisdiction, regulation and approval or
disapproval of the Trustees prior to being conducted;
WHEREAS, the Declarant has applied to the Town of Southold Board of
Trustees for a Wetland Permit for approval to reconstruct the existing house within the
existing footprint with a second-floor addition, covered pomh, in-ground swimming pool,
terrace, sanitary system, and garage as described in Schedule A and known as SCTM
#1000-33-1-18 and as depicted on the plans prepared by Angel B. Chorno last dated
August 6, 2008; and
WHEREAS, the Town of Southold Board of Trustees, as conditions for the
issuance of such Wetland Permit, required certain covenants and restrictions be placed
on the property as shown on the aforesaid plans.
NOW, THEREFORE, this Declarant witnesseth:
That Declarant, for the purpose of carrying out the intentions expressed above
does hereby make known, admit, publish, covenant and agree that the said property
herein described shall hereafter be subject to the following covenants which shall run
with the land and shall be binding on all purchasers and holders of said premises, their
heirs, successors, and assigns, to wit:
1. The grant of a Wetland Permit to reconstruct the existing house within
the existing footprint with a second-floor addition, covered porch, in-
ground swimming pool, terrace, sanitary system, and garage with the
condition drywells and gutters are installed to contain the roof run-off
backwash, a line of staked hay bales is installed prior to construction, a
limit of disturbance, and a 10' non-tuff buffer, and all as depicted on the
plan prepared by Angel B. Chorno last dated August 6,2008; within
perpetuity.
2. These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of the Town of
SOuthold Board of Trustees after a duly noticed public meeting.
Adjoining property owners shall be entitled to notice of such public
meeting by publication or as otherwise deemed sufficient by the Board of
Trustees but their consent to such modification shall not be required.
3. It is the responsibility of any party having any right, title or interest in
the Property to consult Chapter 275 of the Town Code of the Town of
Southold, as may be amended, and to obtain from the Town of Southold
Board of Trustees review and such approvals as may be required by
Chapter 275 for activities regulated therein on the Property.
4. Declarant grants the continuing right in perpetuity to the Town of
Southold or any of its designated representatives to enforce the conditions
and restrictions of the covenants.
THE FOREGOING covenants and restrictions shall bind the Declarant, its heirs,
successors and assigns, and any and all person or persons who shall succeed to the
ownership of said premises of any part thereof by transfer or otherwise.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
_April 19~ 2006, and in consideration of application fee in the sum of $250.00 paid by Peter & Arlene Manos,
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to reconstruct the existing house within the existing footprint
with a second-floor addition, covered porch, in-ground swimming pool, terrace,
system, and garage, with the condition drywells and gutters are installed to contain
roof run-off and pool backwash, a line of staked hay bales is installed prior to
construction, a limit of disturbance, and a 10' non-turf buffer, and all as depicted on
plan prepared by Angel B. Chorno last dated August 6, 2006.
1N WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Peter & Arlene Manos, residing at 2000 Sound Dr., Greenport, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., April 19, 2006 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of PETER & ARLENE MANOS applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated March 29, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the installation of drywells to contain
the roof run-off and pool backwash, the installation of a hay bale line during
construction, a limit of disturbance, and a non-turf buffer, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 19, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of PETER & ARLENE
MANOS to reconstruct the existing house within the existing footprint with a second-
floor addition, covered porch, in-ground swimming pool, terrace, sanitary system, and
garage, with the condition drywells and gutters are installed to contain the roof run-off
and pool backwash, a line of staked hay bales is installed prior to construction, a limit of
disturbance, and a 10' non-turf buffer, and all as depicted on the plan prepared by Angel
B. Chorno last dated August 6, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The applicant was issued a variance form the Southold Town Zoning Board of Appeals (#5730) on
July 21, 2005, allowing a 65 foot setback from the top of the bluff, based on proposed additions and
alterations.
Following the amendment, calling for a new single family dwelling and an amendment relocatinl,
the accessory in-ground swimming pool to the rear yard~ the new dwelling, including the new
pool, will be +/-51 feet from the top of the bluff.
Therefore~ the proposed amendment is not permitted pursuant to Article XXIII Section 100-
239.4 A(I) which states;
"All buildings located on lots adjacent to sounds and upon which there exists a bluff or
bank landward of the shore or beach shall be set back not fewer than one hundred (100)

The Southold Town Board of Trustees reviewed the site plan prepared by Garrett
Strang, Architect dated March 30, 2004 and determined the proposed swimming pool to
be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and
Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Based on the information you have submitted the Department of Environmental Conservation
(DEC) has determined that the property landward of the 46' elevation contour (that generally
runs across the top of the bluff) as shown on the survey by John C. Ehlers, dated 1/15/02, is
beyond Article 25 (Tidal Wetlands Act) jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no
permit is required.
Be advised, however, that no construction, sedimentation, or disturbance of any kind may take
place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the properly under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 28,884 sq. ft. parcel has 100 feet along the
north side of Sound Drive, 275.63 feet deep and is improved with a single-family dwelling.
BASIS OF APPLICATION: Building Department's April 22, 2005 Notice of Disapproval, citing
Section 100-239.4A(1) in its denial of an application for a building permit to construct new additions
and alterations to the existing dwelling. The reason stated for disapproving the application is the
construction is not permitted at less than 100 feet from the top of the bluff of bank.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 7, 2005 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to add a two-ft, enlargement in the
reconstruction of the existing one-story porch, resulting in a 65 ft. setback from the top of the bluff.
The existing porch is shown on the 4/19/05 site map prepared by Garrett A. Strang, Architect, 51
feet from the top of the bluff at its closest point.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The two ft. extension is in an easterly direction
and will bring the house construction no closer to the bluff than the setback that exists.

2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The expansion is minor and the easterly side is
the only option available to maintain the existing setback. A greater setback variance would become
necessary if the new extension were proposed on the opposite westerly side.
3. The variance granted herein is not substantial.
4. The difficulty has been self-created based on the existing nonconformity.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an enclosed porch addition, while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by
Member' Orlando, and duly carried, to
GRANT the variance as applied for, as shown on the 4/19/05 site map prepared by Garrett
A. Strang, Architect.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features, as are expressly addressed in this action.

property is improved with a one-family, two-story frame dwelling situated at 99 feet from the front line
along Sound Drive, 16 feet from the westerly side line, 18.5 feet from the easterly side line, and 61+-
feet from the top of the L.I. Sound bluff.
BASIS OF APPLICATION: Building Department's April 1, 2004 Notice of Disapproval, citing Code

an in-ground swimming pool in the (easterly) side yard.

inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:

swimming pool along the easterly side of the existing dwelling, at 5 feet from the side lot line, at its
closest point. No raised decks or other building construction is proposed around the pool, other than
a open, sun terrace at ground level and pool fencing.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The adjoining property owner to the east of the
pool location stated at the May 20, 2004 public hearing that he had no objection to the location of the
pool. The pool will be screened from the road by a new front yard garage as well as other neighbors
by a planting of screening along the pool on the easterly property line.

2. The benefit sought by the applicant cannot be achieved by some method, feasible for
applicant to pursue, other than an area variance because if located in the required rear
yard, there is insufficient area to locate the pool without a variance from the code's 100 ft.
setback from the top of the bluff rule. Without the variance, the proposed pool would not
be possible.
:3. The requested area variance is not substantial. The side yard location is more
environmentally sound than placing the pool in the rear yard area, which is closer to the
top of the bluff.
4. The alleged difficulty has been self-created and is due to the applicant's desire to enjoy
a swimming pool.
5. No evidence has been submitted to suggest that the relief granted will have an adverse
impact on physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum necessary and adequate to enable the
applicant to enjoy the benefit of a swimming pool while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
7. The applicant assures that there will be no drainage or flow of water from the pool or
construction activities toward the bluff and that drywells will be properly installed for this
purpose in the overall design planning of the project.
.RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member
Goehringer, it was
RESOLVED, to GRANT the variance as applied for, as shown on the 3/30/04 site
plan prepared by Garrett Strang, R.A., SUBJECT TO THE FOLLOWING

1. The applicant shall plant and maintain a row of screening the entire 32 ft. length
of the pool along the east property line.
2. In the event that the applicant does not construct an accessory garage in the
location shown on the above site plan, the applicant shall plant a row of evergreens
the entire 24 fi. width of the pool to block it from view from Sound Drive.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided as well as the records available to me, it is my recommendation that the

A. INSTRUCTIONS (Manos 1000-033-01-18)
1. All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
Southold Waterfront Consistency Review Law. This assessment is intended to
supplement other information used by a Town of Southold agency in making a
determination of consistency. *Except minor exempt actions including
Building Permits and other ministerial permits not located within the
Coastal Erosion Hazard Area. ;
2. Betbre answering the questions in Section C, the preparer of this form
should review the exempt minor action list, policies and explanations of
each policy contained in the Town of Southold Local Waterfront
Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area (which
includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the
proposed action may affect the achievement of the LWRP policy standards and
conditions contained in the consistency review law. Thus, the action should
be analyzed in more detail and, if necessary, modified prior to making a

previously granted for additions and alterations to existing residence. The foundation was

Dear President King
and Board:
Enclosed is the revised site plan of the proposed location of the house and pool for the above
project. The Board granted the approval to locate the pool and house 50 feet from the Top of the
Bluff and we had planned to relocate thepool seaward of the house. The Zoning Board pushed the
house and relocated pool to no closer than 80 feet from the Top of the Bluff.
The Zoning Board allowed the pool to remain in the side yard because they had already
granted a variance for the pool in the side yard at 65 feet from the Top of the Bluff(as is shown on
the enclosed site plan). Therefore the ZBA has given the owner the choice of keeping the peo! in
the side yard at 65 feet or pushing the pool and house at 80 feet.
Given these alternatives, the owner will keep the pool in the location of the side yard (65 feet
from the Top of the Bluff) in order to place the house at 80 feet from the Top of the Bluff.
We have added to the site plan:
dry wells for roof and pool back-wash
Non-turf area (10' landward of hedge)
Limit of Disturbance
The Top of the Bluff has been confirmed by the surveyor.
