NOTICE TO BIDDERS
NOTICE IS HEREBY GIVEN, in accordance with the provisions of Section 103 of the
General Municipal Law, that sealed bids are sought and requested for the purchase
and delivery of 10,000 cubic yards of screened sand, more, or less, as may be needed,
for Ice Control and Highway Maintenance for the Highway Department.
Sand must be delivered to the Highway Department yard, Peconic Lane, Peconic,
New York, between the hours of 7:00 A.M. and 3:30 P.M., Monday through Friday,
excluding holidays, with prior notification to the Highway Department (631-734-5211 or
631-765-3140).
The sealed bids, together with a Non-Collusive Bid Certificate and bank draft or
certified check in the amount of $100.00, will be received by the Town Clerk of the
Town of Southold, at the Southold Town Hall, 53095 Main Road, Southold, New York,
until 10:00 A.M., Thursday, Apri16, 2006, at which time they will be opened and read
aloud in public. The Town Board of the Town of South old reserves the right to reject any
and all bids and waive any and all informalities in any bid should it be deemed in the best
interest of the Town of South old to do so.
All bids must be signed and sealed in envelopes plainly marked "Re-Bid on
Screened Sand", and submitted to the Office of the Town Clerk. The bid price shall not
include any tax, federal, state, or local, from which the Town of Southold is exempt.

And he further agrees that if this proposal shall be accepted by the Town and that ifhe shall refuse, fail or neglect to
enter into a Contract pursnant to such proposal and to the requirements of the Town and shall fail to give the
required security within the ten (10) days after notice of the acceptance of said proposal, shall have been deposited
in the mail addressed to him at the address given in the proposal, that he shall be considered to have abandoned the
contract and the sum represented by the certified check accompanying this proposal shall be forfeited to the Town as
Liquidated damages; otherwise the certified check shall be returned to the bidder within forty-five (45) days after the
date of receiving the bids.

In accordance with Section 103-d General Municipal Law, effective September I, 1966, every bid or proposal
hereafter made to a political subdivision of the State of any public department, agency, or official thereof or to a fore

The sealed bids, together with a Non-Collusive Bid Certificate and bank draft or
certified check in the amount of $100.00, will be received by the Town Clerk of the

INSTRUCTION TO BIDDERS
1. RECEIPT AND OPENING OF BIDS
The Town of Southampton invites bids on the forms herein provided for Town
of Southampton Annual Contract to Furnish Assorted Aggregates and Soil
Materials at the time, date and place indicated in the Notice to Bidders.
2. FORM. PREPARATION AND PRESENTATION OF PROPOSAL
In submitting the bid, the bid sheets furnished are to be filled in
but not detached from the Contract Form. In no case is the Contract Form to
be filled in or signed by the bidder. The complete bid for this work shall be
enclosed in a sealed envelope properly endorsed. All blank spaces for bid
prices must be filled in, in ink, in both words and figures, with a total or gross
sum for which the bid is made. Bids that contain any omission, erasure,
alteration, addition or items not called for in the itemized bid form or that
contain irregularities of any kind may be rejected.
3. REJECTION OF BIDS
(a) The TOWN BOARD reserves the right to reject any bid if the evidence
submitted in the qualifications statement or an investigation of such bidder fails
to satisfy the TOWN BOARD that such bidder is properly qualified to carry out
the obligations of the Contract and to complete the work contemplated therein.
Conditional bids will not be accepted.
(b) The TOWN BOARD reserves the right to reject any and all bids, in whole
or in part, to waive any information in any or all bids, and to accept the bid or
part thereof which it deems most favorable to the Town after all bids have
been examined and/or checked. No bid shall be withdrawn for a period of
forty-five (45) days after being publicly opened and read.
4. BIDDERS RESPONSIBILITY
It will be the responsibility of the successful low bidder (s) to furnish and deliver
all items bid to 20 Jackson Avenue, Hampton Bays, NY and/or as directed by
the Superintendent of Highways.

5. METHOD OF AWARD
All bids will be compared on the basis of the unit price bid. The estimated
quantities shown in the Form of Bid are not to be considered as absolute
quantities, but are given solely to be used by the Town Board as a uniform
basis for comparison of bids. Bids which are obviously unbalanced may be
rejected. The quantities actually required may be more or less than the
quantities estimated on the Proposal, and, if so, no action for damages or for
loss of profits shall accrue to the Contractor by reason or reasons thereof.
THERE CAN BE MORE THAN ONE SUCCESSFUL LOW BIDDER IN THIS
CONTRACT. The low bidder (s) may be requested to submit specifications
and additional information on the specified item before being awarded the
Contract.
6. TIME OF CONTRACT
The successful bidder will be required to supply the item within ten (10) days
after the contract is signed, unless the Town shall authorize a delay. The time
period under this contract shall be from the signing of contract for one year.
During this period, the low bidder(s) will be responsible to supply the Town of
Southampton with assorted Aggregates & Soil Materials specified, for a period
of one year at the contract amount per item. The Town has the sole option of
extending the Contract for an additional year at the conclusion of this Contract.
7. METHOD OF PAYMENT
Upon delivery of the supplies, the low bidder shall present an Invoice to the
Superintendent of Highways. Payment will be made based upon unit price per
item according to the contract amount.
The Town of Southampton reserves the right to with hold payment for any
materials that are delivered to the Town Highway Department in defective
condition. It will be the responsibility of the low bidder(s) to replace any and all
defective materials delivered to the Town of Southampton with any additional
costs in replacing the defective materials to be the responsibility of the low
bidders.

Under this Contract, the vendor shall furnish

directed by the Superintendent of Highways.
B. MATERIALS
The Compost shall contain organic matter or material of a generally
humus nature capable of sustaining the growth of vegetation, with no
"foreign" matter (Le. glass, plastic, etc.) of material toxic to plant growth. It
shall be free from stones, lumps or similar objects larger than two inches
in greater diameter, roots and brush. Composts that have been derived
from organic waste such as food and agriculture residues and animal
manures and that meet the above requirements and are approved by the

A. DESCRIPTION
The vendor shall furnish and deliver Infield Clay Mix to various locations
within the boundaries of the Town of Southampton as specified and/or as
directed by the Superintendent of Highways.
B. MATERIALS
The Infield Clay Mix shall be taken from an approved source
and shall contain a combined total of not more than 5% of
mica, feldspar, and organic matter. The percentage of
organic matter shall be determined by loss through ignition of
moisture free samples dried at one hundred (100) degrees
centigrade.

soil shall be free from gravel and hard pan as well as sticks,
roots, sod and trash of every description. No material shall be

the fact that only one bidder bid. I would like to re-bid to see if more venders will submit
