We write to you on behalf of 108 Harbor Watch LLC, owner of 70 Wildberry Lane; Darcy
Gazza, owner of 200 Wildberry Lane; Twin Barns LLC, owner of 610 Wildberry Lane; Kimdy
Realty LLC, owner 705 Wildberry Lane; CCR Properties Management Inc., owner 795
Wildberry Lane; Supplemental Care Trust of Bianca Milov, owner of 905 Wildberry Lane;North
Fork Building Co LLC, owner of 1015 Wildberry Lane; Goed Intent LLC, owner of 1135
Wildberry Lane; Merlotraminer LLC, owner of 1365 Wildberry Lane; Superduperhouse LLC,
owner of 19750 Soundview Avenue; Kimdy Realty LLC, owner of 19690 Soundview Avenue;
and Head of the Harbor LI LLC, owner of 19620 Soundview Avenue. Please accept this letter as
a formal demand that the Town of Southold not release the performance bond posted by the
developer of Wildberry Fields, Beta II, LLC and 2"d Generation Properties LLC as there are
numerous deficiencies, including substandard, defective construction, and non-completed
obligations, all of which have caused damages to the individual property owners and created
hazardous conditions in the development as set forth below:
1. The primary issue is the diffusion well. The lower most ring was damaged and
improperly backfilled. The well was not installed at the proper depth and needs to go
down 8 more feet. This has caused flooding in the roadway and extending to the property
owners individual lots. (Ex. A)

2. A silt fence required by the approved plan was not installed. (Ex. B)
3. The"temporary"stockpile has not been removed. (Ex. C)
4. The appropriate number and height of screening trees were not installed and 18 of the
installed trees are dead. (Ex. D)
5. The developer failed to install another layer of asphalt, as required. (Ex. E)
6. Installed curbs are already cracking, particularly in the flooded area. (Ex. F)
7. The barrier fence is damaged. (Ex. G)
8. There is debris around the diffusion well. (Ex. H)
9. The installed street lamp is non-functioning as it has no power and no bulb. (Ex. 1)
Based on the foregoing, I'm sure you can agree that the performance bond should not be
released. Please let us know what actions the Town is taking to ensure that the major subdivision
is delivered in accordance with its approved plans. I welcome the opportunity to meet and
discuss with whomever you think appropriate.
