THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON MAY 3, 1994:
RESOLVED that the Town Board of the Town of Southold hereby authorizes
the release of the $159,621.00 performance bond for Wolf Pit Associates,
which is being held by the Town of Southold as a bond for the roads and
improvements in the major subdivision of Wolf Pit Estates, located on the
southwest corner of Mill Road and Mill Lane, Mattituck, all in accordance
with the recommendation of the South.old Town Planning Board and
Engineering Inspector Richter, who report that all items have been
completed in a satisfactory manner.

Dear Ms. Terry:
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, April 18, 1994:
BE IT RESOLVED that the Southold Town Planning Board recommend
to the Town Board that the Performance Bond in the amount of
$159,621.00 for the above mentioned subdivision be released.
James Richter, Engineering Inspector, in a report dated May 10,
1993, indicated that all items had been completed in a
satisfactory manner. The Planning Board adopted his report on
June 15, 1993, noting that two required firewells were still
outstanding. The Planning Board was notified on April 15, 1994,
by the Mattituck Fire Department that the firewe11s had been
installed in a satisfactory manner.

The Planning Board of the Town of Southold is concerned that this bond not
lapse until all the improvements are satisfactorily completed. I, therefore,
would appreciate your confirmation that the subject bond is not the type of bond
that will lapse or expire but continues in force indefinitely until it is released
