WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
F 0 the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto

whereby the said premises have been incumbered in any way whatever, except as aforesaid.

C the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

EXHIBIT "A"
;:. Parcel 1. i
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being at East Marion, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a monument on the northerly line of a 16 foot
private road known as Rabbit Lane, 102. 84 feet easterly along
the northerly line thereof from Bay Avenue, said point of
beginning being the southeasterly corner of land now or formerly
of Sabbatino Massaro and the southwesterly corner of land herein
described; from said point of beginning running along said land
of Sabbatino Massaro and the several lands now or formerly of
Howe, Saint, and Brown, north 34012 ' 40" west, 250 feet, more or
less, to the shore of Marion Lake; thence easterly, along said
shore of Marion Lake, 53 feet, more or less; thence along land
now or formerly of Schimatz and Pascale on a line parallel to
and 49. 31 feet easterly from the first course hereinabove
described, south 34012' 40" east, 235 feet, more or less, to
said northerly line of Rabbit Lane; thence along said northerly
line, two courses: 1) south 56057 ' 50" west, 25.23 feet; thence
(2) south 69017 ' 30" west, 24.77 feet to the point of beginning.
TOGETHER with a right of way over said 16 foot private road
known as Rabbit Lane from the southeasterly corner of the premises
westerly about 153 feet to Bay Avenue.
SUBJECT to any state of facts an accurate survey might show,
and to covenants, restrictions, easements, agreements, reservations,
and zoning regulations of record, if any.
BEING the same premises conveyed to the decedent Sabbatino
Massaro by deed recorded in the Office of the Clerk of Suffolk
county, New York in Liber 6100, page 184.
Parcel 2.
ALL that certain lot or parcel of land, situate at East Marion,
Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
Beginning at a point on the easterly line of Bay Avenue formed
by the intersections of the northerly line of a certain sixteen
foot roadway with said easterly line of Bay Avenue, (The southerly
side of said roadway being designated by a monument set on the
easterly line of Bay Avenue about 208.80 feet northerly from high
water mark of the Bay) running thence northerly along Bay Avenue
One hundred feet; thence easterly and at right angles to Bay
Avenue One Hundred feet; thence southerly and parallel with Bay
Avenue approximately 124 feet to the northerly line of said
sixteen foot roadway; thence westerly along the northerly line
of said roadway approximately 102. 84 feet to its intersection
with Bay Avenue at the point of beginning.
TOGETHER with the right to pass and repass over said road-
way to the easterly end of the premises above described.
