Y. , as joint tenants and not as tenants in common, party of the second part, WITNESSETH, that whereas letters testamentary were issued to the party of the first part by the Surrogate's Court, Queens County, New York, on February 5, 1971 and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and inconsideration of devise under above last will and testament antk {� mkatDOtttK s> iietotKBIF�t stdorgetm paid by the party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, '0'* g oLDot6�mox situate, at East Marion, Town of Southol , County of Suffolk, State ofew York, which is the southerly portion of lot 83 as shown on a map entitled "Map of Section Two Gardiner's Bay Estates, situate at East Marion, Long Island" which map was filed in Suffolk County Clerk's office on September 23rd, 1927, under the number 275, and which portion is described as follows: BEGINNING at the point where the division Line between lots 83 and 84 intersects the westerly line of the street which is unnamed on the filed map of Gardiner's Bay Estates°.and running thence westerly along said lot 84, which was conveyed to the party of the second part by deed dated November 1, 1954 and is recorded in Suffolk County Clerk's office in Liber 3819 of deeds at page 85, 170 feet to the easterly line of lot 97 as shown on said map and running thence northerly along lot 97 as sho"I suer, map 20.5 feet; thence easterly through lot 83 and along land o be conveyed to Paul W. Gabbert and Margaret E. Gabbert, his wife , to the westerly side of said street and running thence southerly along said street 27.25 feet along said street to the point of beginning, as set forth in next paragraph. Being the same premises conveyed to said decedent, GENEVIEVE C. KELSEY, ;iby deed dated December 3 , 1964 and recorded in the office of the clerk of Suffolk County on October 26, 1965 in Liber 5847 at page 87 and subject to all terms and conditions thereof . TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in s§g�id premises, and also the estate therein, which the party of the first part has or has power to convey or d3p6se of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid.
