V pd THIS INDENTURE, made the first day of July nineteen hundred and seventy -one BETWEEN LYMAN G. KETCHAM and DOROTHY F. =CRAM, his wife, both residing at Naughright Road, Long Valley, New Jersey, is party of the first part, and END-01-LANE COTTAGE, INC., a domestic corporation having its office and principal place of business at 2400 Bay Avenue, East Marion, New York, party of the second part, WITNESSETH,that the party of the first part,to consideration of Ten Dollars and other valuable consideration j paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements deerean erected, situate, lying and being iRdbex at East Marion, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: iv BBIGINNING at the point of intersection of ordinary high water mark of Peconic Bay " and the southwesterly line of Bay Avenue running thence northerly along the southwesterly line of Bay Avenue north 350 35' west to a point 92 feet from the southwest corner of the existing town bulkhead; thence along property now or formerly of Robert D. Woodcock and Mary T. Woodcock south 540 25' west thirty feet; thence still along other land of Woodcock sohth 350 35' east 92 feet, more nt-1( or less, to the ordinary high water mark of Peconic Bay; thence north 48° 55' east 30 feet, more or less, to the point or place of )beginning. TOGETHER with all the right, title and interest of the parties of the first part of in and to the lands and lands under the water in the bay in front of the premises above described, and in and to the portion of Bay Avenue adjoining the granted premises and lying between Peconic Bay and the northeasterly boundary line of the granted premises as extended. BEING and intended to be the same premises conveyed to the parties of the first part by Robert D. Woodcock and Mary Tr. Woodcock, by deed dated June 8, 1945, and recorded in the Suffolk County Clerk's office in Liber 2468 of deeds at page 99 on July 30, 1945. AND the party of the first part covenants that the party of the first part has not done or suffered anything rn whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such eonsid- 00 erstion as a trust fund to be applied first for the purpose of paying the cost of the improvement and will aptly the same first to the payment of the cost of the improvement before using any part of the total of the acme for N any other purpose.
