Chairperson Woodhouse: Good evening, and welcome to the November 7th meeting of
the South old Town Planning Board., For our first order of business, we will set Monday,
December 12th, 2005 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold,
as the time and place for the next regular Planning Board Meeting.

We have a couple of public hearings tonight with the opportunity for the public to
address the Board. We just ask that when you want to come forward that you stand up
at the microphone. There's a piece of paper where you can write your name so that
when we transcribe the record we have the correct spelling of your name.
PUBLIC HEARINGS
6:00 p.m. - Morris. Davsman & Nannie: This proposal is to subdivide a 15,423 sJ.
parcel into two lots where Lot 1 equals 9,794 sJ. and Lot 2 equals 5,629 sJ. The
property is located on the nlslo Brown Street and the slslo Linnet Street, approximately
313' wlo 7th Street in Greenport. SCTM#'s 1000-48-3-7.1 & 48-3-24
Deborah Dotv: Good evening, I represent the Morrises, the applicants in this matter.
They cannot be here tonight, they have other scheduled matters. As the Board knows,
we are here to correct something that apparently was an oversight in 1979 and 1989.
We are seeking that you ratify the lot line that has existed for almost 100 years in
Driving Park in Greenport. It's part of that subdivision. And we are requesting your
approval of the application that is before you tonight. In 1979, my clients went for a
variance before the ZBA for two undersize lots. They were taking four lots and creating
two lots out of them. At that point in time, the subject lot on Brown Street was not a part
of the application. In fact, it was listed as a separate lot and four lots were being
divided to the south. They received approval in 1979 of that variance from the ZBA.
They were not represented by an attorney. In 1989, they came before this Board for an
application for a lot line change. Again, they were not represented by an attorney. But
the lot line change was approved by this Board in 1989. Again, Lot 18 or 24, whatever
you want to call it, the one on Brown Street, was not part of that application. They
thought it was a separate lot, they understood it was a separate lot, and they of course
received separate tax bills on it. In 1990, they transferred the Brown and Linnett Street
Lot that is directly north of the subject parcel, meaning the Brown Street Lot, to their
daughter; they sold it to her. In 1999, they sold the adjoining parcel to the north on
Linnett Street Lot to their son. All they had left was the Brown Street Lot, which is a
vacant lot. Small, but a vacant lot. Last year, a little bit over a year ago, they entered
into a contract to sell the Brown Street Lot. That contract is contingent upon the buyers
getting a building permit; not an unreasonable request. When they applied for the
building permit, the Building Department told them that it had merged with the Linnett
Street Lot. Immediately, we went for an application for a waiver of merger. We were
denied that because the ZBA felt that it was not eligible for a waiver of merger. And
that instead we had to go for a variance before the ZBA, then come to you to subdivide
the lot. Immediately, my clients went before the ZBA for a variance for two non-
conforming lots, then that was created. As soon as that was created I came before this
Board with an application to do what we are doing today, which is ratifying the 1909 Lot
Line that exists between the two lots. I am requesting that the Board grant our
application as presented and let us proceed with selling the lot to somebody who wants
to build an affordable house, a modular house, to be his home. They are local
South old residents who are seeking to build their own home, their first new home, and
they have been very patiently waiting since September of last year for us to be able to
transfer the lot. To address Mr. Cremer's question that I see before me in his mind,

with regard to the minor encroachment of a little bit over one foot of the garage from the
northerly property onto the subject parcel, the buyers agree to accept that
encroachment; that is, to buy the property with the encroachment in place. I have been
in touch with the Southold Town Attorney. We have agreed that there will be a
covenant in the deed acknowledging that the encroachment exists on the subject
parcel. Therefore, I ask that you grant our application.

Chairperson Woodhouse: Is there anyone else who would like to address the Board on
this application?
Paul Dinizio: I live on 637 Brown Street, across from the property in subject. Like I said
before at the other meetings, I have no problem with doing something like this, as long
as you're gonna do it all over Southold Town. I don't know why you just pick out my
neighborhood for something like this. I mean a 5,600 sq. ft. lot is a pretty small lot. But
they're all buildable; my parents live on a lot that size, my grandmother, my uncles,
everybody on that street. Fortunately, my brother and I were able to buy acres on that
street. So, if you're gonna set standards for lots that size, I think you should do it all
over South old Town. Not just in Greenport. I mean, there's plenty of land in Orient,
you could build thousands of houses down there. There's plenty of land in Mattituck,
Cutchogue, Southold, everything, where you could build hundreds of houses. And so, I
think, before you give permission for something like this, you should make it town-wide
or you shouldn't allow it. One or the other. And that's alii have to say. Thank you.

to the Planning Board on October 20, 2005; and
WHEREAS, at their work session on October 17, 2005, the Planning Board determined
that the Health Department approval to construct a single-family residence on Lot 2
indicates that the County already considers this to be a single and separate parcel; be it
therefore
RESOLVED, that the Southold Town Planning Board finds that the Health Department
approval for this project has been satisfied;

this Board.

WHEREAS, on August 8, 2005, the Southold Town Planning Board granted conditional
sketch approval upon the map prepared by John C. Ehlers, L.S. dated November 18,
2004 and last revised on November 30, 2004; and
WHEREAS, an application and fee for preliminary plat approval were submitted on
August 17,2005; and
WHEREAS, on November 1, 2005, the applicant submitted a revised map prepared by
John C. Ehlers, L.S. dated July 15, 2005 and last revised on October 31, 2005; and
WHEREAS, in a letter dated October 5, 2005, the Suffolk County Planning Commission
disapproved the application because they consider Lot 2 to be a landlocked parcel; be it

RESOLVED, that the Southold Town Planning Board hereby overrides the Suffolk
County Planning Commission because the Board finds that the 15'-wide access
easement provides adequate access to Lot 2 and conforms to the requirements of the
Southold Town Code;

1. Submission of the final map containing the Health Department stamp of
approval and the following revision: Removal of the 25'-wide non-fertilization
buffer. The 50'-wide buffer needs to be labeled as a "50'-wide non-
disturbance/non-fertilization buffer. "
2. Submission of a valid permit or letter of non-jurisdiction from the NYSDEC for
the proposed subdivision.
3. Submission of draft Covenants and Restrictions containing the following
clauses:
a. There shall be a 50'-wide non-disturbance/non-fertilization buffer
adjacent to the wetland boundary on Lots 1 and 2 on the subdivision

WHEREAS, the applicant, North Fork Resources, Inc., proposes the amended site

receives stamped Health Department approval differs in any way from the proposed
conditional site plan on which the Planning Board held a public hearing and voted on,

issues properly before the Planning Board, to hold another public hearing on this
"revised" site plan application and rescind or amend its conditional approval; and
WHEREAS, on May 9, 2005, the Southold Town Planning Board closed the final public
hearing and granted conditional final approval which expires in six months on
November 9; and
WHEREAS, on October 17, 2005, the agent sought to extend the conditional final
approval; be it therefore
RESOLVED that the Southold Town Planning Board grant an additional six-month
