Stats of New York, hounded and described as follows: Beginning at a concrete monument set on the easterly line of Bay Avenue at the southwesterly corner of land of the parties of the first part and the north- westerly corner of land conveyed or to be conveyed by Rita Schmidt to the parties of the second part; running thence along the easterly line of Bay Avenue N. 340 12" 4011 W. - 50. 0 feet; thence along land of Rita Schmidt N. 550 471 20" E. - 200 feet, more or less, to the shore of an arm of Marion Lake; thence south- easterly along the said arm of Marion Lake, 54 feet, more or less, to said land conveyed or to be conveyed to the parties of the second part; thence along said land, S. 550 471 20" W. - 220 feet, more or less, to the point of beginning. Together with all rights, titles, and interest, if any, of the parties of the first part, of, in, and to lands lying under the waters of Marion Lake in front of and adjoining said premises. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
