There were present: Messrs: Robert Wi Gillispie,~ Jr., Chairman; Robert Bergen; Fred Hulse~ Jr. Absent: Messrs: Charles Grigonis, Jrl; Serge Doyen~ Jr~ Also present: Howard Terry~. Buildinglnspector An informal discussion was held on the proposed cdr'wash operation or'Frank Claudiol to be located at north side of Main Road ~oute 25)~ Greenport:, New York. Mrl Claudio plans to purchase theeasterly section of Kalin~s property~ which is zoned "B" B~sinessl After consultation with the Town Counsel,. it has been decided that a car wash is not a permitted use in the Ordinance. Therefore, Mr. Claudio will have to apply for a v~ianceo Southold Town Boar~_~of Appeals -2- ~ February 23~ 1971 The Chairman read the data which he collected on several other neighboring towns ordinances~, as to whether or not a car wash is a permitted use or a special exception in each particular town; and if so, what zone district it is allowed in. Said data to be placed in the file of Frank Claudio at such time when his application is received. The meeting was officially called to order at i:30~P~Mo by the'Chairman, who stated that he had received a telephone call fromSupervisorMartocchia the other day in reference to com- plaints on "Royal Flush Stables"~ located at south side of Oregon Road,~ Cutchogue~ N, ¥o Complaints have been received by several departments of the Town government, as well as by PerryDuryea of the State~Legisla%ure,. and the County Health Department. The Chairman stated that the purpose of this meeting was to determine whether or not the Board of Appeals should hold a re-hearing on the special exception permit~ Appeal NOo 1347~ which they granted to James Warner~ Paul Winters~ & MarkF. Madaio; proprietors of"Royal Flush Stables," On motion by Mro Bergen~ seconded by Mr. Hulse~ it was RESOLVED that pursuant to Section 267,-SUbdivision 6 of the Town Lawa of the State of New York~ on the Board's motion,, a re- hearing will be held at 8:30 PoMj~ Thursday~ March 18~. 1971~ at the Town Office, Main~Road~ Southold~ New York, on Appeal No. 1347; upon application of James Warner~ Paul Winters~ & Mark F~ Madaio~ 173 Oregon Road~ Cutchogue~ New York,~ for a special exception in accordance with the Zoning~ Ordinance,,~%rticle III~ Section 300a Subsection 5 (d)~ forpermission to establish and maintain stables for boarding and riding hozseso Location of property: land of Dominick Mavellia~ north side of Oregon ROad~ Cntchogue~ New York, bounded north by Lo'I. Sound~ east,by Graphic A~ts Management~ Corp.~ south by Oregon Road~ west by Vincen~ Zimnoskio Vote of the Board: Ayes:--Messrs: Gillispie,, Bergeni Hulse~ This determination was made on the basis of the numerous complaints that have been received and in support of the general purpose and intent of the Zoning Ordinance~ which is to promote the, health, safety~ morals, and general welfare of the Town of Southoldo Southold Town Boar~ Of Appeals -3- February 23~ 1971 The Chairman dictated letters to be sent to Sidney Beckwith~ Deputy Commissioner of the County Board of Health; Southold Town Chief of Police~Carl Cataldo; and Supervisor Martocchia~ all of whom have received complaints on "Royal Flush Stablest" Each of foregoing officials were asked ~o submit a written report of all the complaints that they received~ and is possible to appear in person at the re-hearing, The meeting was adjourned at 2:30 Respectfully submitted~ ecretary' · Southold Town Board of Appeals
