VIEEHIAEUSER , late of County of Kings, State of New York who died on the 5th day of November nineteen hundred and seventy-two party of the first part, and ROBERT FRE.'NTZEL and ELIZUETH N. FRENTZEL, his wife, both residing at #124 Cooper Street, Leonia, New Jersey party of the second part, WITNESSETH, that whereas letters testamentary were issued to the party of the first part by the Surrogate's Court, Kings County, New York, on February 6th, 19 4 and by virtue of the power and authority given in and by said last will and testament, and by Article 11 of the Estates, Powers and Trusts Law, and in consideration-ef -- THIRTY FIVE THOUSAND TWO HUNDRED AND FIFTY ($35,250) ---_ --------- dollars, paid by t e party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, M lying and being in the Town of Southold, East Marion, County of Suffolk and State of yr New York, known and designated as Lots Nos. 61, 62 and 63 on a certain Map entitled, "Map of Section 2 Gardiner's Bay Estates", and filed in the Office of the Clerk of the County of Suffolk on September 23, 1927 as Map No. 275, being.more particularly bounded and described as follows; p BEGINNING at a point on the southwesterly side of Old Orchard Lane, where the Q, same is intersected by the division line between lots 60 and 61 on the aforesaid CU ' map; running thence along said division line South 58 degrees 58 minutes 30 seconds Ll West 150 feet to the division line between lots 61 and 72; thence along said division line and along the division line between lots 62 and 63 and lots 73 and 74, North 31 degrees 01 minutes 30 seconds West 150 feet to the division line between dots 63 and 75; thence along said division line and along the division line between lots 63 and 64 North 58 degrees 58 minutes 30 seconds East 150 feet to the southwesterly side of Old Orchard Lane; and thence along the southwesterly side of Old Orchard Lane South 31 degrees 01 minutes 30 seconds Fast 150 feet to the point or place of BEGINNING. I , TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. Subject to the trust fund provisions of section thirteen of the Lien Law. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
