LIBER 7513 PAGE 2 , THIS INDENTURE,made the 17th day of October , nineteen hundred and seventy three BETWEEN ANNA B. GERKE, residing at 61-38 69th Place, Middle Village, New York �S party of the first part, and • WARREN G. DONNEILY and ANNA GERKE DONNELLY, his wife, both residing at 61-38 69th Place, Middle Village, New York O party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable Consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being Jodie at Orient, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the northerly side of Sound View Road at the southwesterly corner of land of Ryan, which point is distant 11.77 feet r. westerly from the southwesterly corner` of Lot Numbered 24 on a certain map entitled, "Map of Orient by the Sea, Section 1° filed in the Suffolk County Clerk's Office as No. 2777, when measured along the northerly side of Sound View Road; A x RUNNING thence along the northerly side of Sound View Road the following 2 courses and distances: C 1) westerly along a curve bearing to the left having a radius of 548.16 feet ® a distance of 76.32 feet; 2) South 77 degrees 30 minutes 50 seconds west 23,68 feet; THENCE north 2 degrees 39 minutes 50 seconds west 262.80 feet to the ordinary highwater mark of Long Island Sound; THENCE along said ordinary highwater mark of long Island Sound a tie line course and distant of North 79 degrees 02 minutes 50 seconds east 100 feet to land of Ryan; and RUNNING thence south 2 degrees 43 minutes 10 seconds east along the land of Ryan 265,41 feet to the northerly side of Sound View Road the point or place of Beginning. The grantor herein is the,same person as the grantee in the deed dated September 12, 1973 recorded September 14, 1973 in liber 7489 page 468. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. A AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the pftrpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the sante for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
