THIS INDENTURE, made the l day of May nineteen hundred and seventy-three.-
BETWEEN
eventy-three_BETWEEN ISABEL F. SHANNON, widow, residing at 141 Pascack Road,
Hillsdale, New Jersey
party of the first part, and RICHARD CLARK and SHIRLEY CLARK, his wife, both
residing at 203 South Street, Greenport, New York
party of the second part.
WITNESSETH,that the party of the first put,In consideration of Ten Dollars and other valuable consideration
paid by the party of the second part,does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
V V') ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Village of East Marion, Town of Southold, County of
Suffolk and State of New York bounded and described as follows :
BEGINNING at a concrete monument set on the easterly line of
JRocky Point Road at a point 175.01 fee.. Svil�ilerlj% from another,
v concrete monument on said easterly line of said road and near the
edge of the Sound Bluff; from the first mentioned concrete monument
running along the southe4ine of a proposed road N.770 19 ' 50"
fp E.-150 feet to a concrete monument; thence parallel to said Rocky
Point Road, S. 130 45 ' 10" East.-150 feet to a concrete monument;
thence parallel to said proposed road S. 770 19 ' 50" W. 150 feet
to a concrete monument on said easterly line of said Rocky Point
Road; thence along said easterly line of Rocky Point Road,
N. 130 45 ' 10" W.-150 feet to the point of beginning.
BEING AND INTENDED TO BE the same premises conveyed to Isabel F.
Shannon by Benjamin C. Faulkner, et al. by deed dated November 19,
1953 and recorded in the Suffolk County Clerk ' s Office in Liber 3669 '
at page 394.
TOGETHER with all the right, title and interest of the party of ,
the first part to a right of way over the above mentioned proposed
road, 50 feet in width, the southerly line of which is the northerly
line of the premises above described.
TOGETHER with all the right, title and interest of the party of
the first part, of, in and to such portion of Sound Avenue as adjoins
said premises on the west to the center line thereof.
TOGETHER with all right,title and interest,if any, of the carry of the first part of,in and to any atreeb and
roads abutting the above-described premises to the center line tfiereof; TOGETHER wM the
and all the estate and rights of the party of the first part in and to said premises, TO HAVE'AND TO
HOLD the premises herein granted unto the party of the second part, theah 'a or success= and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien IAw, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive snch consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it rad "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF,the party of the first part has duly executed this dad the day and year first above
written.
