/~R. RONrALDB. BUSCH: It will be au in-ground pool with dimensions
of 16~ x 32~..~The fence will be l0 feet from the pool, and the
property line is l0 feet further away.
MR. TUTHILL: I am the developer, i have done all I could to keep
it nice loo~ing. Because of the way the creek came in it is wider

From the road instead of the normal 35 Feet. in this area, across
the road, there is l?0 foot depth. Except For .this one, most of
them are 200 feet deep. This is 176 feet on one side and 170 Feet
on the other. This reduces their backyard, in the sense, that it
is going to be in the ground, I don~t think that it would be
objectionable to have it on the side of the house. I think it is
more sensible to have it there.
THE CHAIR~: You have restrictions on the number of trees that
can be taken down on any lot.
~,~. T~ITHILL: This is to prevent someone from stripping the lot.
~o CHARTererS HAi~ (neighbor): I have discussed this with my wife
and we have absolutely_ no objection.
THE CHAiR~L~2~: is there anyone present who wishes to speak against
this application?

THE CH~.IR~4AN: There is a serious topographical slope away from
the house down to ~aurel Creek. I think this is a good location for
the swimming pool.
After investigation and inspection the Board Finds that the
applicant requests permission to locate accessory structure (swimming
pool) in sideyard area on the north side of Long Creek Drive,
Eouthold, New Tork. The installation of the pool in the sideyard
area would still give a 20 foot sideline. The fence enclosing the
pool would be in accordance with Town regulations and Regulation ~10
of Tennecott Park. Shrubs and landscaping are planned to er~hance~
appearance of Fence and pool area. The Board finds that it is in
agreement with the reasoning of the applicant.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the i~ediate vicinity of this property and in the same use district;
and the variance will not change the character of the neighborhood,
and will observe the spirit of the Ordinance.

years.. It is renewable each year. We have looked over the property
and believe we should limit the size~of the addition the applicant
requests to something that would accomodate a refrigerator. &s i
understand it, the Department of Health has required a new type of
refrigerator.
~fter investigation and inspectiou the Board finds that the
applicant reqmests permission to renew farm labor camp permit granted
April 2, 1970, on property located south Side of Main Road, Orient,
New York; and requests permission to add a small addition to.increase
the kitchen area of one of the buildings in order to accomodate a
refrigerator required by the Department of Health.
~he~Board finds that the public convenience and welfare and
justice will be served and the legally established or permitted use
of neighborhood property and adjoining use districts will not be
permanently or substantially injured and the spirit o£ the Ordinance
will be observed.

The Board finds that the public convenience and welfare and

Tt~E GF-~.IRMAN: The application is accompauied by a survey indicating
that the lot.is irregular in shape. Ztls 100 feet on Waters ~dge Way,
208 feet om the eastern line and 208 feet ou the western line. The
house has been built 50 feet from ~aters Edge ~ay. The closest point
is the eastern edge which parallel~ the eastern line of the house.
(Van Tuyl Map dated ~eptember 21, 1970).
T~E CHOiRbOY: Is there anyone present ~no wishes to speak against
this application?

TEE CHAIRI~N: I would have to speak against it because we have
been trying for years to get the To~aBoard to require au inspectiou
survey of the foundation before the people build these houses.
However, most recent decisions favor the applicant on a basis that
it does not alter the chs~acter of the area, and on this type of
decision it is usually granted. The basis of that reasoning is that
you have to be able to show a substantial change in the character of
the area. It is pretty hard to show that 6 inches is too close. I
received a call tonight from Helen Jacobsen i~ which she said that.so
far as she is concerned (she lives 100 ft. from the applicaut) and so
far as any of the other neighbors is concerned, they have no objection
to the granting of this application.
After investigation and inspectiou the Board finds that the
applicant requests permission to erect one family dwelling with
reduced sideyard area located south side of Waters ~dge Way, Southold,
New York. The Board finds that the six inch.error will 2ct change
the character of the area; and that neighbors of the applicant have
no objections. The error is not over the line, but is too close to the line.
The Board finds that strict application~of the Ordinance will
produce practical difficulties or uunecessary hardship; the hardship
created is unique and would be shared by all properties alike in the
Lm~.ediate viciuity of this property and in the same use district;
and the variance does observe the spirit of the Ordinance and will not
change the character of the district.

garage will b~e facing north. The reason for the ll feet is that the
garage would block the batb~voom window.

A~ter investigation and inspection the Board Finds that applicant
requests permission to re-instate use of one family dwelling with
less than minimum living area and reduced sideyard area, building
has been unoccupied as residence for over a two (2) year period, on
property located north side of Pine Neck Road, Southold, New York.
The two buildings were on the lot prior to the Zoning ordinance and
at one time the smaller building was used as living quarters by one
of the family. The smaller building has a Full cellar and chimney
and is being renovated inside and out to meet the current housing
code and Health Dept. requirements. It is on the most level part
of the entire lot.
The Board finds that strict application of the Ordinance will
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would be shared by all properties alike in the
immediate vicinity of this property and in the same use district;
and the variance does observe the spirit o£ the Ordinance and will
not change the character of the district.

(Mm. Bujn0wski and Board mem~bers discussed map of the property
showing the old right-of-way. ~. Bujnowski said that M~. ~ells said
he could use Gin Lane, a private road. He substituted one right-of-
way for the other.)
THE CH~.IF2~I: You bought from an estate, did you not?
MR. BUJNOWS~: My lawyer is M~. Wi!owski from Jamaica. r
bought from~a.private individual. The Title Guarantee Compauy~has
guaranteed the right-of-way. I bought the property from ~. James

well documented. The Deed indicates perpetual easer~ent for all

After investigation and inspection the Board finds that the
applicant requests permission to use existing farm buildings for
storage for non-farming equiPment on propelty located east side of
Tabor Road and north side of Orchard Street, Orient, New York. The
findings of the Board are that this is amuch less intense use than was
formerly made of the property as far as machinery and repair and
shipping is concerned. The Board finds that the application is
reasonable as it provides transition from agricultural buildings to
a lesser ~se.
