The bearings as set forth in the above described parcels of land are referenced to Grid North, New York State Plane Coordinate System, Long Island Zone. RESERVING to Lloyd E. Terry, his heirs and assigns, the right, privilege and easement to use, operate, repair, protect and maintain in the same condition as shown and described in the Report of Physical Inspection, made March 15, 1990, but not improve or expand, the earthen dike locted on the premises hereby conveyed, together with ingress, egress and regress in connection therewith. This reservation shall remain in effect for so long as the lands now owned by Lloyd E. Terry adjacent to the premises hereby conveyed are wholly or partially used for agricultural purposes and practices as the same are defined in the Agriculture & Markets Law.
