1977 releasing the account of Roger J. Rath and John

KNOW ALL MEN BY THESE PRESENTS, that JOHN E. RATH,
residing at 1095 Tulip Avenue, Post Office Box 250, Franklin
Square, New York 11010, his heirs, executors, administrators,
successors and assignsi' hereinafter called the "Principal" is
hereby held and firmly bound unto the TOWN OF SOUTHOLD, a
New York municipal corporation, having its principal place
of business at 16 South Street, Greenport, New York 11944,
hereinafter called "Obligee,"
WHEREAS, the "Principal" is the owner of a certain
plot, piece and parcel of real property located in the Town
of Southold, County of Suffolk, State of New York, and wishes
pursuant to New York Town Law 8277 to file a final subdivision
plat, to be known as "Paradise by the Bay," in the Suffolk
County Clerk's Office, and imp~~ve same in accordance with
the applicable provisions of the Town of Southold Zoning
Regulations, Subdivision Regulations, and Highway Specifi-
cations in effect on September 14, 1976, except where waived,
NOW THEREFOR IT IS AGREED;
FIRST
BOND.
The "Principal" is hereby
held and firmly bound unto the "Obligee" in the sum of
FIFTY-THREE-THOUSAND ($53,000.00) DOLLARS, lawful money
of the United States of America.
SECOND
SECURITY.
As security for this
Bond, the "Principal" is posting with the "Obligee" a Savings
Bank Passbook #5-23992 from the Ridgewood Savings Bank, 1010

Hempstead Turnpike, Franklin Square, New York 11010, in the
names of John E. Rath and Roger J. Rath, having on deposit
an amount in excess of the FIFTY-THREE-THOUSAND ($53,000.00)
DOLAARS fixed by this Bond, together with an executed with-
drawal slip to the order of the Town of Southold signed by
the owners of said Passbook.
THIRD
CONDITION OF BOND.
The condition
of this obligation is such that if the "Principal" shall
complete the installation of all improvements shown on the
final subdivision plat of Paradise by the Bay and all items
shown on the "ObiUgee's" engineer report dated October 6,
1976, within THREE [3] YEARS from the date hereof, in accord-
ance with the applicable provisions of the Town of Southold
Zoning Regulations, Subdivision Regulations, and Highway
Specifications in force and effect on September 14, 1976,
except where waived, and in accordance with the final
subdivision plat of Paradise by the Bay approved by the
Town of Southold Planning Board, and to the satisfaction
of the "Obligee," then this obligation shall become void,
otherwise to remain in full force and ef~ect.
FOURTH
EXTENSION. The "Phililcipal"s" time
to complete the subject improvements may be extended in excess
of THREE [3] YEARS upon application of the "Principal" and the

SUBSTITUTION.

security may be made as follows:
(a) Savings Bank Passbook
#5-23992 from the Ridgewood Savings Bank, 1010 Hempstead
Turnpike, Franklin Square, New York 11010, may be withdrawn
and be replaced by a savings bank passbook on any other
commercial lending instmtution or savings instmtution having

Dear Mr. Martocchia:
On October 12, 1976 pursuant to New
York Town Law 1277, the Southold Town Board approved
the Bond amount on the above entitled subdivision as
$53,000.00 as recommended by the Southold Town Planning
Board pursuant to Code of the Town of Southold iAl06-23;
and pursuant thereto, I enclose herewith:
(a) Bond.
(b) Savings Bank Passbook #5-23992
from the Ridgewood Savings Bank, 1010 Hempstead Turnpike,
Franklin Square, New York 11010, in the names of John E.
Rath and Roger J. Rath, having an amount in excess of the
$53,000.00 fixed as Bond.
(c) blank withdrawal slip to the
order of the Town of Southold signed by the owners of
the passbook.
(d) copy of my letter dated October 19,
1976 to the Ridgewood Savings Bank instructing them to
block said account to all others except the Town of
Southold.
(e) a $2,120.00 check for the inspec-
tion fees on the above subdivision.
At your earliest convenience please
return approved copies of the Bond and this letter and have
the Southold Town Board instruct the Southold Town Planning
