Dear Mrs. Terry:
The following action was taken by the Southold Town Planning Board,
Monday, December 14, 1987.
RESOLVED that the Southold Town Planning Board, following a field
inspection, concur with the report of the Highway Superintendent and the
Town Engineering Consultant firm and recommend to the Town Board that
the passbook for the major subdivision of Paradise-by-the-Bay be released.
All work as stipulated by the bond estimate has been completed.
Enclosed is a copyof the report from the Highway Superintendent,
and a copy of the report from the Engineering Consultants.

I have inspected Paradise - by - the - Bay this morning.
The stop signs, and dead signs have been installed, the gutters have
been cleaned of all debris, and all other remedial work has been complied with.
I feel that the developer has complied with all of the items stipulated
in the report of Inspector Neil Heffernan with regard to the road construction.

Gentlemen:
The Southold Town Board at their regular meeting held on April 21, 1987
adopted the followi ng resolution with respect to the bond for Paradise-by-the
Bay":
RESO LVED that the Town Board of the Town of Southold hereby accepts the
bond estimate of $200,000.00 for roads and improvements in the major subdivision
known as "Paradise-by-the-Bay" located at Southold, all in accordance with the
recommendation of the Southold'Town Planning Board, Superintendent of Highways
Jacobs and Engineer Lawrence Tuthill; and be it further
RESOLVED that the Town Board hereby releases the passbook of William F. LaMorte,
in the amount of $106,000.00 to the Southold Savings Bank for transfer to Mohri ng
Enterprises, Inc. and updating to $200,000.00; and be it further
RESOLVED that the Town Board hereby directs that an additional inspection fee of
$5,760.00 be paid to the Town, which sum represents the differel'ltial between the
$106,000.00 bond and the $200,000.00 bond.

Dear Mrs. Terry:
The following action was taken by the Southold Town Planning
Board, Monday, April 13, 1987.
RESOLVED that the Southold Town Planning Board accept
and refer to the Town Board the updated bond estimate for
the major subdivision known as "Paradise-by-the-Bay" located
at Southold and request that the Town Board release the passbook
to the bank in order to have it transferred from LaMorte to
Mohring in the amount of the updated bond estimate of $200,000;
with an inspection fee to be paid on the differential in the amount
of $5,760.
Enclosed is a copy of the bond estimate for your review.
If you have any questions, please don't hesitate to contact

above, in reference to the correspondence with Southo1d

formal notice to the Southo1d Town Planning Board and the S./n,.I..{
Town Board of the fact that my client has purchased the
property in question and has been assigned the certificate
of deposit which serves as security for performance of the
subdivision improvemen~ required by-the Town. As you know,
the subdivision improvements are being completed at this

RESOLVED that the Town Board of the Town of Southold award the bid
for one (1) new 1980 15 passenger Plymouth Voyager Maxi-Wa1<on to
Mullen Motors, Inc., Southold, New York, at a bid price of $11,000.00;
to be paid for from the Whole Town Contingency Fund.)
Vote of the TownBoard: Ayes: Councilman Murphy, Councilman
Murdock Councilman Nickles Councilman Drum, Supervisor Pell.

SUPERVISOR PELL: This will be fully reimbursed by the Office of
the Aging to the Town. The Town has to put the money out first
and then we get reimbursed.
3. On motion of Councilman Murdock, seconded by Councilman Drum, it was
RESOLVED that James Fogarty, Radio Operator, be and he hereby is
granted his Step I pay increase in the amount of $500.00 effective
December 1, 1980.
Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.
This resolution was declared duly adopted.
4. On motion of Councilman Nickles, seconded by Councilman Murdock, it was
RESOLVED that the Town Board of the Town of Southold reappoint Frank
Cichanowicz to the Conservation Advisory Council for a two-year term
from January 11, '1981 through January 11, 1983.
Vote of the Town Board: Ayes: Councilman Murppy, Councilman
Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.
This resolution was declared duly adopted.
5. On motion of Councilman Drum, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of Southold reappoint
William P. Ruland to the Conservation Advisorv Council for a two
year term from January 11, 1981 through January 11, 1983.
Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.
This resolution was declared duly adopted.
6. On motion of Councilman Murphy, seconded by Councilman Nickles, it was
RESOLVED that the Town Board of the Town of Southold reappoint
John J. Talbot to the Housing Board of Appeals for a tpree year
term from January 9, 1981 through January 9, 1984. ,

Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.
This resolution was declared duly adopted.
SUPERVISOR PELL: Number 7 we are going to wait on. All the paper
work is not in. I thought it would be, that is why it was put on
the agenda, but it did not come through in time.
Number 8 (a) the Town Board was in discussion with the gentleman
today who owns Highland Estates and we are going to meet with him
again. Myself, perhaps, and somebody else and see if we cannot
work out some of the problems he is having with the size of the
bond. Number 8(a) will be held and put on the agenda on 1/27.
On motion of Councilman Nickles, seconded by Councilman Murphy, it was
RESOLVED toat the Town Board of the Town of Southold increase the
bond amount for roads and improvements in the subdivision known
as "Soundview Acres at Orient: from $77,000.00 to $150,000.00 as
recommended by the Southold Town Planning Board and Town Engineer
Lawrence Tuthill.
Vote of the Town Board: Ayes: Councilman Murphy; Councilman
Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.
This resolution was declared duly adopted.
8(c). On motion of Councilman Drum, seconded by Councilman Murdock, it was
RESOLVED that the Town Board of the Town of Southold increase the
bond amount for roads and improvements in the subdivision known
as "Paradise B~ The Ba~" located,at Southold, New York, from
$53,000.00 to 106,000.00 as recommended by the Southold Town
Planning Board and Town Engineer Lawrence Tuthill.

RESOLVED that the Town Board of the Town of Southold accept the
Bond of William F. LaMorte and Kathie L. LaMorte in the amount of
$1013,000.00 for roads and improvements in the subdivision known as
"Paradise by the Bay" at Southold, New York, and be it further

Dear Mr. Raynor:
Our records indicate that the original bond of Paradise
By The Bay expired in November of 1979. Your letter of
January 2, 1981 indicated that the Planning Board at a regular
meeting held December 15, 1980 resolved to extend the time of
the bond for an additional three years, which r assume would
be from November 1979.
Town Attorney Tasker questioned the date on the bond
which is June 26, 1981--expiration three years from that date.
r calculate the expiration date of the bond should be November
of 1982.

Dear Sirs:
I am the attorney for William F. LaMorte, owner of a
certain subdivision known as Paradise-By-the-Bay. I under-
stand that the Town Planning Board has recommended that the
performance bond for this subdivision not be renewed. This
is a great injustice:
The Planning Board's action was taken pursuant to Section
277 of the Town Law which in part says "Such performance bond
shall run for a term to be fixed by the planning board, but
in no case for a longer term than three years, provided, how-
ever, that the term of such performance bond may be extended
by the planning board with the consent of the parties thereto".
As to this subdivision, the three years were up November 1979.
In July of 1979, I requested an extension of the term of the
performance bond. This was the first extension requested for
t:his performance bond and the request was timely.
On September 28th, the Planning Board conferred with
Mr. LaMorte and myself and requested we justify our request
for an extension. It was pointed out to the Board that Mr.
LaMorte purchased this subdivision within the original three
year period for his residence at considerable expense.
He also purchased within this time period a local
business in Cutchogue known as "Key Foods", also at consider-
able expense. This is a needed enterprise serving a large
area of the town, employing a large number of persons.
The stocking of this store cost Mr. LaMorte well over
half a million dollars. The large expenses during this
period made it impossible to make improvements and should
have been reason enough for an extension.

It is unreasonable to force Mr. LaMorte to develop this
property as it is presently his home. None of the lots have
been sold and therefore no improvements are required at this
time.
The performance bond held by the town is a savings
passbook. Mr. LaMorte offered to increase the bond but
Mr. Raynor said that would not be necessary as it was more
than adequate. The subdivision as it exists meets all of
the town's zoning requirements. If it was now being presented
to the Planning Board for approval, it would have to be ap-
proved.
It is unfortunate that it has been lumped with other
subdivisions in which lots have been sold and homes built
which need improvements. In fact, Section 277 states that
when a bond is declared in default and improvements are to
be made by the Town, they are to be "commensurate with the
extent of building development that has taken place in the
subdivision ...".
It is requested that this Board refer the matter back
to the Planning Board for reexamination and request that
they extend the time of this bond.

THIRD
CONDITION OF BOND. The condition of this
obligation is such that if the Principal shall complete
the installation of all improvements shown on the filed
map of Paradise by the Bay and all items shown on the
Obligee's engineer report dated October 6, 1976, within
THREE (3) YEARS from October 26, 1976, in accordance with
the applicable provisions of the Town of Southold Zoning
I Regulations, Subdivision Regulations, and Highway

Specifications in force and effect on September 14, 1976,
except where waived, and in accordance with the final
subdivision plat of Paradise by the Bay approved by the
Town of Southold Planning Board, and to the satisfaction
of the Obligee, then this obligation shall become void,
otherwise to remain in full force and effect.
FOURTH
- EXTENSION. The Principal's time to
complete the subject improvements may be extended in
excess of THREE (3) YEARS upon application of the Principal
and the consent of the Obligee and the Town of Southold

Planning Board, which said consent shall not be unreasonably
witheld.
FIFTH
SUBSTITUTION. Upon application of the
Principal and consent of the Obligee, not to be unreasonably
witheld, substitution of this Bond and/or security may be
made as follows:
(a) Savings Bank Passbook #9-74476 from
the Southold Savings Bank, Main Road, Southold, New York
11971, may be withdrawn and be replaced by a savings bank
passbook on any other commercial lending institution or
savings institution having at least a deposit of FIFTY-THREE

drawal slip to the order of the Town of Southold signed by
the owners of said passbook;
(b) this Bond may be withdrawn
and replaced by an identical bond, without security, to be

replaced by an identical Bond to be posted by any future
owner of the subdivision plat of Paradise by the Bay
together with security.
