Gentlemen:
We hereby establish our irrevocable and unconditional Letter
of Credit in the amount of Sixty Seven Thousand Five Hundred Sixty
and 00/100 U.S. Dollars ($67,560.00) in your favor at the request
of Dr. Irving Newman to guarantee and assure the performance and
completion of certain site improvements as described below.

This bond in the amount of $67,560.00 to run for a one year
period represents the estimated cost of the required improvements
which includes construction of curbing, highways and drainage in
the subdivision known as Orient Park Estates as set forth in the
Planning Board Resolution by the Town of Southold Planning Board
made on April 9, 1990.
It is further agreed that all drafts drawn under

1992 and will be automatically renewed for successive one-year

return receipt requested, that we elect not to so renew this

AUGUST 25, 1995
You received a Notice of Public Improvement Lien re Orient Park Estates
on 8/23/95. The only involvement of the Town in Orient Park Estates is
that the Town held a subdivision performance bond to insure installation
of infrastructure pursuant to Town Law 277. The Town Board had
approved the work and released the bond on 8/22/95. The bond expired
on 8/23/95. The Town does not own the road and did not perform the
work or contract to have it performed. The road installation is not a
"public improvement" as defined in Lien Law Section 2. Therefore, the
Lien Law notices do not apply to the work.
Since there is nothing for the lien to attach to, I suggest you proceed as
usual with closing your files on this subdivision.

PLEASE TAKE NOTICE that CORAZZINl ASPHALT, INC., as
lienor, has and claims a lien in the principal and interest of the valne and
agreed price of labor performed and materials furnished as hereinafter
mentioned upon the monies applicable to the construction of the public
improvement hereinafter mentioned, to the extent of the amount due or to
become due under the contract between the Town of Southold Town Board
and Orient Park Estates and Irving Newman, which lien is based upon the
following facts:
1. The name and address of the lienor is the Corazzini Asphalt, Inc.,
Cox Lane, Cutchogue, New York 11935.
2. The name of the contractor for whom the labor was performed and
the materials were furnished is Irving Newman of Orient Park Estates, 1
Horizon, Fort Lee, New Jersey.
3. The amount due the lienor is $19,330.00 and the date when said
amount became due is August 22, 1995.
4. A description of the public improvement for which labor was
performed and the materials furnished is as follows: construction and
sitework at a subdivision entitled, "Orient Park Estates, located at Orient,
New York, including but not limited to, road work for the purpose of
donating the roads at the subdivision to the Town of Southold at per
specifications outlined by the Town of Southold.
5. The labor performed consisted of, including but not limited to, street
curb cut, surveying, excavating, drainage and grading; and the materials

furnished consisted of, including but not limited to, RCA blend, Asphalt,
Liquid asphalt, Blue Stone layer.
6. The contract pursuant to which the public improvement was
constructed was made between the Town of Southold and Orient Park Estates
cmd Irving Newman for the purpose of constructing roads to be donated to the
Town of Southold as per specifications outlined by the Town of Southold.
The contract for the subject work between Irving Newman (Orient Park
Estates) cll1d Corazzini Asphalt, Inc. is dated February 4, 1993.
7. The labor was performed and the materials were furnished for the
construction of said public improvement pursuant to the aforementioned
contract and in furtherance of the execution and completion of same.
8. Thirty days have not elapsed since the completion and acceptance
of the construction of said public improvement.

as soon as they are shipped to the Highway Department.

of acknowledgement indicating our previous conversation relative
partial exhonoration of the bond as the work on the road and
utility installation progresses.

We are returning herewith your proposed agreement, passbook in the amount
of $67,560.00, along with a certified copy of a resolution which was adopted by
the Town Board at its meeting of July 30, 1991, with regard to the
above-referenced minor subdivision. As you will note, this resolution will not
allow the acceptance of a passbook in lieu of a performance bond for any
subdivision, and therefore, we are not able to accept your agreemeat.

Please be advised, however, that the Town will accept cash, a letter of credit
or a performance bond from a recognized bonding company.

signature card for an account at the Suffolk County National
Bank.
This card to be executed by the Town Clerk will require
two signatures prior to the withdrawal of any monies from

physical possession of the passbook should satisfy the
board's requirements, to insure proper completion of the
