Gentlemen:
The following action was taken by the Southold Town Planning
Board at a special meeting held September 28, 1979.
RESOLVED to recommend to the Southold Town Board release of
the bond of the subdivision knmm as "O:dent-by-the-Sea. Section
III" as recommended by the Planning Board Inspector, John W.
Davis, and agreed to by letter from Raymond C. Dean, Supt. of
Highways.
It is to be noted that a report has been received from the
Planning Board Inspector, John W. Davis, with a letter agreeing
with same from Raymond C. Dean, Supt. of Highways, regarding the
section known as "Orient-by-the-Sea, Section II" stating that all
work has been completed.
I attach copy of Mr. Davis' report and letter from the Supt.
of Highways.

RE: ROAD REPAIRS
COMMENTS:
Road repairs for the above subdivisioa (Section II) were completed by Corrazziai-
and Sons on September 12th, 13th, 14th & 17th, 1979.
Repairs as follows:
In lieu _of scarafying and remixing the badly broken surface areas on Plumb Island
Lane, it was thought better to resurface them with a 2" blacktop cap, agreed to by
the owner. ApprOXimately 490 L.P. (4 locations) were capped for full width.
Also, repaired with blacktop were other small areas on Plumb Island Lane. A
new. seal coat with chips was placed on Plumb Island Lane from Ryder Farm Lane
to Park View Lane, the extension-of Uhl Lane to Three Waters Lane and on Ryder
Farm Lane from Uhl Lane to North Sea Drive. Seal coat rolled with 8 ton roller.

During the recent road repairs on Section II, I noticed that street name signs
have not been installed for Section III as follows:
1. Main Road and Ryder Farm Lane.
2. Ryder Farm Road and Parkview Lane.
3. Ryder Farm Road and UbI Lane.
4. Ryder Farm Road and Plunb Island Lane.
5. Uhl Lane and Plunb Island Lane.
Street name signs are not in the bond estimate but according to Town requirements,
the signs have to be installed.
A few small pavement repaiTs have been made on Section III.
'!here is minor weed growth at curbs on st>me of pavement in Section III that has
occurred since October, 1978 when all such growth was removed.
Other than the street signs all work as called for has been c~rnpleted in Section
III.

Section 277 of Town Law states in part. "Such performance
bond shall run for a term to be fixed by the planning board, but
in no case for a longer term than three years, provided, however,
that the term of such performance bond may be extended by the
planning board with consent of the parties thereto."
The time has expired with regard to your subdivision and as
a result your bond is in jeopardy of default with the Town of
Southold.
Please advise the Town Clerk and the Planning Board of your
disposition of this problem.

Dear Mr. Tasker:
Pursuant to our telephone conversation in connection with the
above captioned matter, I am enclosing the following:.
(I) Copy of letter dated May 8, 1974, from Edward J. Bage to
the Southold Town Planning Board recommending a Performance Bond
for Orient By The Sea, Section III in the amount of $97,750.00.
(2) Copy of the Southold Town Board resolution of September 10,
1974, approving a Performance Bond for Orient By The Sea, Section .
III in the ~~6unt of $97,750.00.
(3) Copy of letter dated October 27, 1978, from the Town Clerk
to Mr. Uhl.
(4) Copy of Inspection Report of John W. Davis dated October 18,
1978, for Orient By The Sea, Sections II and III. The report states
that the work has been completed with the exception of 1000 feet on
Plum Island Lane which requires repairs and resurfacing.
(5) Copy of proposal of Paul Corazzini & Sons, Inc. dated Sept-
ember 12, 1978, with the acceptance of Walter Uhl dated October 30,
1978. The proposal states the cost of $10,800.00 to repair the needed
area on Plum Island Lane.
As you know from our previous conversation, it is my position that
Plum Island Lane is not part of Orient By The Sea, Section III subdi-
vision, rather it is in Section II. Therefore all of the improvements
that are required under the Performance Bond for Section III have been
completed. -From my review of the file it appears that a Performance
Bond for Section II was never required. I have discussed this matter in
detail with Mr. Walter Uhl, one of the principals of Woodhollow Proper-
ties, Inc. ~I. Uhl is willing to have his company post a~o,ooo.oo

Performance Bond to the Town of Southold to insure that the repair of
Plum Island Lane which is in Section II will be completed. This, of
course, is done on the premise that the Board will release the existing
Performance Bond for Section III inasmuch as the work in that Section
has been satisfactorily completed.
I would appreciate your bringing this matter to the Town Board's
attention and if this proposal is acceptable, allow Mr. uhl to furnish
the Town Board a Performance Bond in the amount of $20,000.00 covering
the repair of plum Island Lane.
