the Town of Southold, Suffolk County, New York and in connection therewith
the Obligee desires this bond be given;
NOW, THEREFORE, 'IHE CONDITION OF THIS OBLIGA'IION IS SUCH, that if
the Principal shall in connection with the installation of said terms on
E.ngineer's Estimate in "Mount Beulah Acres" within two (2) years
from the date hereof, complete said improvements to be in accordance
with the construction specifications of the Town of Southold, all in
conformance with the plot plan approved by the Southold Town Planning
Board and to the satisfaction of the Town of Southold, then this obligation
to be void; otherwise to remain in full force and effect.
NO party other than the Obligee shall have any rights hereunder as
against the Surety.

Dear Mr. Kiernan:
I concur with Mr. Bennett OrloWSki's memorandum
of June 3, 1988 in reference to Cosden Court an unbuilt
road within the above named subdivision.
I see no reason for this road to be constructed.
It would not compare to the Chardonnay Woods subdivision
to the east. The proposed road does lie within a natural
drainage swale as Benny notes in his memo.

It is the Planning Board's understanding that the as yet
unbui1t right-of-way known as Cosden Court within the SUbdivision
of Mount Beulah Acres is currently used for stormwater drainage.
The subdivision owner was bonded for $20,000 to construct a
road within this right-of-way. The Planninq Board has d~rprminpn
that the right-of-way should not be bu~lt since it lies within ~
natural drainage swale that extends to the east of the pr~~~}tv.
~~so. the develonment of the adio1n1nQ property (to the e
does not.recnlire the cqn~truction of Cosden Court.
Before the Planning Board releases the developer of his
bond, it needs to know whether the Town will accept the
dedication of a 50' by 20' parcel for drainage purposes. Because
of the high groundwater table in the immediate area and the fact
that the Subject lot is part of a drainage swale that will remain
contiguous with the swale on the adjacent property - the Planning
Board strongly recommends to the Town that it accept the
dedication.
