Dear Mr. Anrig:
The Southold Town Board, at their regular meeting held on August
13, 1985, authorized the release of the Letter of Credit in the amount of
$120,000 for major subdivision known as Highpoint at East Marion, Section
I, and Letter of Credit in the amount of $325,000 for major subdivision
known as Highpoint at East Marion, Section II.
The above referenced Letters of Credit are enclosed herewith, in
accordance with the instructions of Mr. Mandel. I am also enclosing the
Letter of Credit #M-8335 in the amount of $375,000, which was reduced
to $120,000 and the new Letter of Credit #M-8503 issued.

Gentlemen:
We hereby establish our Irrevocable Letter of Credit #M-8503 in your favor and
authorize you to draw upon this Bank up to an aggregate amount of One Hundred
Twenty Thousand and 00/100 ($120,000.00) Dollars. Said monies to the extent
necessary to complete the improvements hereinafter set forth and referred to
herein shall be paid upon demand by the Town Board to complete road improvements
to the subdivision known as Highpoint at East Marion, Section I, Town of Southold,
New York.
Funds under this Letter of Credit are available against the Town's draft on us
presented at our office at 245 Love Lane, Mattituck, New York no later than
November 18th, 1986. All drafts drawn hereunder must all also be accompanied
by the Town's signed statement certifying that the amount drawn represents
sums due under or in connection with the Performance Bond of Highpoint at East
Marion, Section I, Inc.
This Letter of Credit is not transferable.
This Letter of Credit replaces our Letter of Credit #M-8335 which was issued on
November 18th, 1983 and was reduced pursuant to a Resolution of the Town Board
of the Town of Southold dated November 20th, 1984.
This credit is subject to Uniform Customs and Practices for Documentary Credits
(1984 Revision) International Chamber of Commerce Publication #400 except as
expressly provided herein.

The fOllowing action was taken by the Southold Town Planning
Board, Monday, July 29, 1985.
RESOLVED that the Southold Town Planning Board, fOllowing
a field inspection, recommend to the Town Board that the letter
of credit be released on Highpoint at East Marion, Sections I and
II.
Also, enclosed is the recommendation of the Highway Superintendent
regarding the release of the letter of credit. As well as,
correspondence from the applicant's attorney indicating his intent
to file for dedication.

Reduction of letter of credit
Coments:
All items of required work as shown in the bond estimate have been completed
with the exception of the following:
I. Asphalt top course on all roads............................$29,300.00*
2. Seeding - estimated amount remaining say...................$ 1,000.00
3. Recharge basin curb - this item waived.
4. Monuments................................................. .$ 1,250.00
Total..............$31,550.00
*There was an error in the S.Y. of pavement, 8740 S.Y. as shown in the bond
estimate. Apparently the two entrance roads from the property line to
Stars Road were not included. From computations and measurements the final
S.Y. of pavement is 9870 S.Y., an increase of 1]30 S.Y. over the estimate.
Using price breakdown as submitted with the bond estimate the asphalt top
course is 27% of the completed pavement. 27% of 9870 S.Y. at $11.00/S.Y.,
(bond price) is say $29,300.00.
In the matter of reduction in the letter of credit I would recommend
2 x $31,550 say $63,000. Prior to this report and before the increase in
pavement was known, $60,000 had been proposed.
