They were grading the swales, corracting the elevation of a L.B. and seeding the swale areas. The swales, with exception or a very small area at the Orchard ~treet entranca, n"1ve been gradad. '!his grading r.as been disturbed and rutted by persons ur:knowr! (probably teenagers) by driving cars and motorcycles in 'the swales. I :;culd not require any re- gI"llding by the elmer. In the event that any re- qUired Improvements have not been installed as provided in this section within the term of such performance bond the town board may thereupon declare the said performance bond to be in default and collect the sum remaining payable thereunder and upon the receipt of the proceeds thereof the town shall install such im- provements as are covered by such performance bond and arc Commensurate with the extent of building development that has taken place in the subdivision but not exceeding in cost the amount of such proceeds. 2. In making such determination regarding streets, high- ways, parks and required improvements, the planning board shall take into consideration the prospective character of the de- velopment, whether dense residence, open residence, business or industrial. 3. Notwithstanding, the foregoing provisions of this section the planning board may waive, subject to appropriate conditions, the provision of any or all of such improvements and require- ments as in its jUdgment of .the special circumstances of a par- ticular plat or plats are not requisite in the interest of the public health, safety and general welfare, or which in its jUdgment are inappropriate because of inadequacy or lack of connecting fa- cilities adjacent or in proximity to the subdivision. 4. The installation of fire alarm signal devices including nec- essary connecting facilities shall be required or waived pursuant to this section only with the approval of (1) the board of su- pervisors of the county if the installation is to be made in an area included in a central fire alarm system established pursuant to paragraph (h) of subdivision one of section two himdred twen- ty-five of the county law or (2) the town board in any other case unless the installation is to be made in a fire district in a town in which no central fire alarm system has been established pur- suant to subdivision eleven-c of section sixty-four of the town law, in which event only the approval of the board of fire-commis- sioners of such fire district shall be necessary. The sole item that has not been completed is the planting of trees. The sole reason that the trees have not been planted is because the Planning Board and the Town Engineer have not told us where to place the trees. In light of the fact that the applicant has com- pleted all of the items on the bond estimate except for the planting of the trees, it is respectfully requested that the certificate of deposit now on deposit with the Town be re- leased to the applicant. If this is not acceptable, the applicant would be willing to deposit with the Town the amount of money necessary to cover the cost of planting the trees.
