I was advised by the PlanniDg Board on December 2nd that work w~s completed on the
above subdivision. AlI!lO, was shown tha Superintendent of Highl~ay's copy'of letter
received by the Planning Board in reference to the s/11I1e matter.

The last report (No. 254 dated Oct. 21, 1982) indicated t~ree items of work to be
done. They were grading the swales, corracting the elevation of a L.B. and seeding
the swale areas.
The swales, with exception or a very small area at the Orchard ~treet entranca, n"1ve
been gradad. '!his grading r.as been disturbed and rutted by persons ur:knowr! (probably
teenagers) by driving cars and motorcycles in 'the swales. I :;culd not require any re-
gI"llding by the elmer. If done, the same kim of v.!lndalism ",uld no doubt be repeated.

Performance Bond
Gentlemen:
The Planning Board held a Public Hearing September 20, 1982 in
the matter of the reduction of the face value of the performance
bond furnished by Peter Blank, Jr. and Mary Louise Blank to cover
the cost of the improvements in the subdivision known as Bayview
Farms at Orient, New York. Said performance bond was given in the
face amount of $140,000 and it was proposed to reduce same to
$25,000. Our Board passed the fOllowing resolution:
RESOLVED that the Southold Town Planning Board recommend to the Town
Board a reduction in the performance bond from $140,000 to $25,000
for improvements within the subdivision known as Bayview Farms, lo-
cated at Orient.

* The annual percentage yield is based on both principal and interest left on deposit for a full year at

INTEREST CALCULATIONS: Interest is compounded quarterly. Each quarter the amount of the certifi-
cate, plus interest earned but not received in previous quarters, is multiplied by the quarterly percentage
rate stated above. Compounding of interest on Money Market Certificates of D.eposit is prohibited by
Federal law. If you choose to have your interest remitted to you by check, no compounding will occur.

INTEREST PAYMENTS: We will pay you interest in accordance with one of the following options:
I) On the maturity of the certificate.
2) Monthly check issued to you on the 10th of the month.
NOTE: If you select Option No.2, and purchase your certificate during the first ten days of the month,
you will receive your first check on the tenth of the next month. If you purchase your certificate after the
tenth of the month, you must wait an additional month before receiving your first check. For example,
if you purchase a certificate on Sept. 2, 1980, your first interest check will be issued on Oct. 10, 1980.
If you purchase your certificate on Sept. II, 1980, your first interest check will be issued on Nov. 10, 1980.

August 24, 1982 approved the reduction of the oond on sub-
division known as Bayview Farros at Orient, owned by Peter
Blank, from $140,000.00 to $25,000.00.
I am attaching hereto a portion of Section 277, Article
16 of the Town Law pertaining to perforroance bonds. You
will note that the Planning Board must hold a public hearing
before the amount of the perforroance bond may oe reduced.

that the land shown on such plats shall be of such a character that
it can be used safely for building purposes without danger to
health or peril from fire, flood or other menace; that suitable
monuments have been placed at such block corners and other
necessary points as may be l'cquired by the board and the loca-
tion thereof is shown on the map of such plat; and that the parks
shall be of reasonable size for neighborhood playgrounds or other
recreational uses; that all streets or other public places shown
on such plats shall be suitably graded and paved and that street
signs, sidewalks, street lighting standards, curbs, gutters, street
trees, water mains, fire alarm signal devices including necessary
ducts and cables or other connecting facilities, sanitary sewers
and storm drains or combined sewers shall be installed all in
accordance with standards, specifications and procedure ac-
ceptable to the appropriate town departments except as here-
inafter provided, 01' alternatively that a performance bond suf-
ficient to cover the full cost of the same as estimated by the plan-
ning board or other appropriate town departments designated
by the planning boal'd shall be furnished to the town by the own-
. er. In the event that the owner shall be authorized to file the
approved plat in sections, as provided in subdivision three of
section two hundred seventy-six of this article, approval of the
plat may be granted upon the installation of the required im-
provements in the section of the plat filed in the office of the coun-
ty clerk 01' register 01' the posting of a bond covering the cost of
SUell improvements. The owner shall not be permitted to be-
gin construction of buildings in any other section until such
section has been filed in the office of the couuty clerk 01' register
and the required improvements have been installed in such sec-
tion 01' a bond covering the cost of such improvements is posted.
Such performance bond shall be issued by a bonding 01' ~urety
company approved by the town board 01' by the owner With se-
cUl'ity acceptable to the town board, and shall also be approv-
ed by such town board as to form, sufficiency and manner of
execution. Such performauce bond shall run for a term to
be fixed by the planning board, but in no case for a longer term
than three years, provided, however, that the term of such
performance bond may be extended by the planning board with

qUired Improvements have not been installed as provided in this
section within the term of such performance bond the town board
may thereupon declare the said performance bond to be in default
and collect the sum remaining payable thereunder and upon the
receipt of the proceeds thereof the town shall install such im-
provements as are covered by such performance bond and arc
Commensurate with the extent of building development that has
taken place in the subdivision but not exceeding in cost the amount
of such proceeds.
2. In making such determination regarding streets, high-
ways, parks and required improvements, the planning board
shall take into consideration the prospective character of the de-
velopment, whether dense residence, open residence, business
or industrial.
3. Notwithstanding, the foregoing provisions of this section
the planning board may waive, subject to appropriate conditions,
the provision of any or all of such improvements and require-
ments as in its jUdgment of .the special circumstances of a par-
ticular plat or plats are not requisite in the interest of the public
health, safety and general welfare, or which in its jUdgment are
inappropriate because of inadequacy or lack of connecting fa-
cilities adjacent or in proximity to the subdivision.
4. The installation of fire alarm signal devices including nec-
essary connecting facilities shall be required or waived pursuant
to this section only with the approval of (1) the board of su-
pervisors of the county if the installation is to be made in an area
included in a central fire alarm system established pursuant to
paragraph (h) of subdivision one of section two himdred twen-
ty-five of the county law or (2) the town board in any other case
unless the installation is to be made in a fire district in a town
in which no central fire alarm system has been established pur-
suant to subdivision eleven-c of section sixty-four of the town
law, in which event only the approval of the board of fire-commis-
sioners of such fire district shall be necessary. Required instal-

Gentlemen:
At a regular meeting of the Southold Town Planning Board, Wednesday,
August 18, 1982 the following action was taken:
RESOLVED that the Southold Town Board recommend to the Town Board to
reduce the amount of the bond from $140,000 to $25,000 on the subdiv-
ision known as Bayview Farms located at Orient for completion of ad-
ditional plantings and road construction based on Inspector John
Davis' report and Superintendent of Highways recommendation.
Attached please find a copy of the Inspector's report along with cor-
respondence for the Superintendent of Highways.

Dear Mrs. Terry:
Please be advised that all of the items on the
bond estimate except one have been completed at the subject
subdivision. The sole item that has not been completed is
the planting of trees. The sole reason that the trees have
not been planted is because the Planning Board and the Town
Engineer have not told us where to place the trees.
In light of the fact that the applicant has com-
pleted all of the items on the bond estimate except for the
planting of the trees, it is respectfully requested that the
certificate of deposit now on deposit with the Town be re-
leased to the applicant. If this is not acceptable, the
applicant would be willing to deposit with the Town the amount
of money necessary to cover the cost of planting the trees.
If you have any questions, please do not hesitate
to contact me.
