Y. 11971 July 6, 1981 Planning Board Town Hall Southold, New York 11971 Gentlemen: A Building Permit should not be issued unless there is access to a street as provided in the Town Law 280a 100-141B. A "street" is a street improved to the satisfaction of the Planning Board 100-13 Page 10014. Therefore, either the Planning Board has to be satisfied the road is improved for permits to be issued, or under 280a 3, the Zoning Board of Appeal can approve the Access. Has the streets in the Subdivision of West Creek Estates, Southold been improved to the satisfaction of the Planning Board? This Subdivision Map was approved by the Planning Board, May 21, 1963 and it was filed August 19, 1963 as filed Map #3848. Glenn Road and Shepard Drive have been built, but are not Town Roads. L.I.. n.Y. 11971 2-6-1973 Mr. John Wickham, Chairman Planning Board Town Hall Southold, N.Y. 11971 Gentlemen: West Creek Estates in Southold is a sub-division of 51 lots on which there are 19 occupied homes and one home occupied sum- mers only. The sub-division was approved in 1963 and the sub-division map on file in the Building Dept. shows a proposed beach and a proposed marina. All residents and lot owners that we have contacted feel that when completed they would have beach rights and, if not on the creek, an opportunity to moor their boat in the marina. It has recently come to our attention that the owners, Wilsberg Brothers of Mattituck are planning to sell the marina with an adjoining lot for which they still have title. Now, we realize that no one has anything to support the second para- graph in their deeds. Up to now we felt the the marina could not be sold without submitting a new sub-division map because the owners have been taxed $lee.ee on one entity: the roads, proposed beach, and proposed marina. We searched the minutes of the Planning Board meetings held from 1961 to 1964 and found nothing in the minutes speci- fically dealing with such rights. Our feeling is that perhaps these considerations were so favorable to Wilsberg Brothers because they were to provide by their planning, a beach and a marina. Please advise. Thank You. Murphy, Supervisor, Town of Southold FROM: West Creek Property OWners Association SUBJECT: Petition for the Town of Southold to take over and maintain the roads in the Sub-Division known as West Creek Estates, Town of Southold The enclosed petition represents more than 51% of the assessed valuation in the sub-division known as West Creek Estates, Town of Southold. The entire sub-division has a total assessed valuation of $169,800.00 according to the current records in the ~wn Assessors office. The residents signing the petition feel that since the owners of the sub-division, Harold and Ernest Wilsberg of Mattituck will no longer be responsible for the maintenance of the roads known as Glenn Rd. and Shepard Drive; and said owners have discontinued paying the taxes; and since the Property Owners Association is unable to assume this responsibility of maintenance: we are hereby petioning the Town of Southold to acquire title and restore the roads to a safe condition.
