I note that by the attached resolution, the Planning Board has recommended the release of the
remaining Performance Bond for peconic Landing. Please note that, in fact, this is not a performance
Bond but a bank account obligation maintained by the Suffolk County National Bank in conjunction
with the Town of Southold and peconic Landing to insure performance of development obligations
by Peconic Landing. In the Town Board resolution will you please indicated that the performance
obligation ofpeconic Landil1g in the form of a bank escrow custodial account is released.

Dear Mr. Orlowski:
As per your request, Victor L'Eplattenier and I have completed a final review of the Peconic
Landing Site for compliance with the Final Site Plan that was approved by the Planning Board. All of
the Maintenance Bond items have been completed in a satisfactory manner with the exception of the
proposed walkway along the Top of Bluff on the northerly side of the property.
This item has been deleted from the project by the developers of the site. Due telthe nature of
the proposed construction and the proximity to fragile slopes contained within the 8!luff Face, this
would be considered a recommended change to the site plan.
Our site inspection revealed the installation of split rail fencing along the landward side of the
Top of Bluff on the easterly side of the Site. The inspection also revealed that some of the
underbrush in the area adjacent to the Bluff has been cut further back to accommodate the
installation of this fencing. At this time, it is recommended that the Town Trustees be given the
opportunity to do a final inspection of the Bluff area and provide their input regarding compliance with
Coastal Erosion Regulations. On your behalf, I have contacted the Trustees office and suggested
that they do a final inspection prior to release of the Performance Bonds.
At this time, with the exception of the Trustee matter as noted above, the project is considered
complete and meets the minimum requirements established by Town Code and Planning Board
approvals. If you have any further questions concerning this matter, please contact my office.

Jamie Richter and I went to Peconlc Landing today to perform an Inspection to
determine If the final bond could be reduced to zero, at the request of Tom
Wolpert, P.E.
Jamie has determined that virtually all of the required cOnstruction is
complepi, as determined by the engineering reports on file, and verified by on
site In,Jpection. However, he noted some recent conditions, which need to be
addreissed, as follows:
1. He noted intensive clearing along the bluff, up to the fence line of a
recent split rail fence, behind several of the cottages, probably to
enhance the view of the L.I.Sound.He will notify the Trustees so they can
perform an Inspection and report If Peconlc Landing Is In violation.
2. Some rocks between ponds 1 and 2 appear missing or fallen, although
they do not Interfere with drainage or water flow, but make the barrier
appear Incomplete or broken.
3. The approved walkway along the bluff, representing a $79,000 item In the
approved Bond, was not built, at the discretion of Peconic Landing. This
Is O.K. With Jamie, since It was not required to be constructed.
4. The presence of excess debris and brush in the maintenance area was
noted, and Jamie will contact Peconic Landing to get It cleaned up
ASAP.
Jamie will send me a memo regarding the Bond release, and If the Trustees
sign off on the clearing along the bluff, a resolution for the PB can be written
for the next available meeting.

Attached is a copy of a request from Thomas Wolpert P, E., to
complete a final site inspection, and subsequent release of the
remaining Bond amounts.
Upon your return in December, can we please schedule a joint site
visit to assess the status of construction remaining (if any)? Also, is
Tom's presence on the site visit necessary, or should we just do it
ourselves?
Please advise me which dates in early December you would be
available for the inspection, and let me know the steps required to
release the final Bond.

The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, October 15, 2001:
BE IT RESOLVED that the Southold Town Planning Board recommend to the Town
Board that the Performance Guarantee in the amount of $3,964,216.00 for Peconic
Landing at Southold be reduced in the amount of $1 ,339,875.00.
As noted in Mr. Richter's September 27,2001 report, with the exception of the drainage
pipe, all required construction items have been completed in a satisfactory manner. The
Planning Board is not requiring the installation of the 233 lineal feet of 36" drainage pipe
due to the location of the rock storage pile at the site.

As per your request, I have reviewed the request for Bond Reduction from Retirement
Living Services, My report is as follows:
The proposed reduction of the Bond is indicated by the Construction Cost Estimate
dated 8/20/01 and is titled Value of Work Completed. A copy of this document has been
enclosed for your reference.
Item # 11 indicates that 233 lineal feet of 36" drainage pipe has been installed. This
item, according to field inspections, has only 160 lineal feet installed due to the location of
the rock storage pile at the site. This is the only modification to the proposed Bond
reduction and is considered a minor change to the request.
Based on the requested value of work completed and the modification to item # 11 as
listed above, the Value of Work Completed to date is one million, three hundred thirty nine
thousand, eight hundred seventy five ($ 1,339,875.00) dollars.

THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON NOVEMBER

WHEREAS, Peconic Landing is required to provide a letter of credit, cash, or other
security satisfactory to the Town to serve as a performance guarantee for the total cost of
furnishing, installing, connecting and completing all of the street grading, paving, storm drainage
and utilities for the project known as "Peconic Landing, be it
RESOLVED by the Town Board of the Town of Southold that the Supervisor, Jean W.
Cochran is hereby authorized to execute a Performance Guarantee Agreement whereby Peconic
Landing will deposit "Performance Bond" money at Suffolk County National Bank in the sum of
$3,964,216.00 subject to the approval of the Town Attorney.

Dear Mr. Orlowski:
As per your request, enclosed please find a revised bond estimate that indicates the
amount of work completed to date. I have also enclosed a copy of the inspection report
from the consulting engineers office as prepared by Mr. Gino Aiello, PE.
At this time I agree with the findings of the consultant and would recommend the
reduction of the current Bond. The New Bond Total has been adjusted to represent the
quantity of work remaining and should be in the amount of $ 132,000.00.

As per your request, enclosed please find a revised bond estimate that indicates the
amount of work completed to date. I have also enclosed a copy of the inspection report
from the consulting engineers office as prepared by Mr. Gino Aiello, PE.
At this time I agree with the findings of the consultant and would recommend the
reduction of the current Bond. The New Bond Total has been adjusted to represent the
quantity of work remaining and should be in the amount of $ 132,000.00.
