Terry, Town Clerk FROM: Bennett orlowski, Jr., Chairman ~(J }.~ RECEIVED MAR 4 1992 RE: Park and Playground Fee and Bond Estimate for Mattituck Creek Estates (James Cohill) SCTM~ 1000-107-1-2 Southofd Tow., CIeri< DATE: March 4, 1992 Please note the following in reference to the above mentioned subdivision: 1. on March 13, 1990, the Town Board adopted a resolution determining that $11,500.00 be deposited with the Town In lieu of land for Park and Playground purposes for the above mentioned subdivision. 2. on May 22, 1990, the Subdivision of Land Section of the Town Code was amended to include a set fee for Park and Playground purposes of $2,000.00 per vacant lot. 3. After the Town Board set the amount for the Park and Playground fee, the subdivision proposal was substantially revised. The number of lots was reduced from 9 lots to 6 lots, and the entire southerly cul-de-sac was omitted. Since the application was changed, the $11,500 fee was no longer valid. Accordingly, the new fee had to be based on the May 22, 1990 Code revision. ($2,000. per vacant lot. This subdivision has 6 lots; of which 5 are vacant.) 4. The subdivider opted to complete the subdivision improvements that were required in the bond estimate prior to the endorsement of the slilidivision. The improvements have been installed in a manner acceptable to the Engineering Inspector and the . . . Mattituck Creek Estates March 4, 1992 Page 2 Planning Board. Therefore, a Letter of Credit or equivalent will not be required for this subdivision. On February 24, 1992, the Planning Board authorized the Chairman to endorse the final maps as all conditions of final approval had been fulfilled. I have also bought and sold real property for my own account at Southold and elsewhere in the Town of Southold. I am well acquainted with real estate values in the Town of Southold. . . On or about March 2, 1990 the Town of Southold requested First Towne Realty to make an appraisal of property in the Town of Southold, Village of Mattituck, State of New York. While I was then generally familiar with the property, I have since carefully inspected all of the property for the purpose of appraising it. The parcel contains approximately 19.1 acres and is located off Grand Avenue, Mattituck, Town of Southold, County of Suffolk, State of New York and is bounded on the east and south by Grand Avenue on the west by E. Fox and on the north by Mill Road. The property is farmland with a Lilco high power easement through the center of the property going east to west. The 1989 - 1990 Southold Town Assessment was: Land 5,100 Building 4,000 Total $9,100 In my opinion a fair market value for the parcel on March 12, 1990 is $12,000 per acre or $230,000. No consideration has been given for the dwelling on the property. . . It was RESOLVED that as per Section A106-38E of the Town Code, the subdivision entitled Mattituck Creek Estates be referred to the Town Board for a determination of the amount of the cash payment to be deposited in lieu of land reservation for park and playground purposes. This subdivision is for 9 lots on 19.1220 acres, and is located on the southwest corner of Mill Road and Grand Avenue in Mattituck. Enclosed for your assistance is a copy of the proposed subdivision.
