Present Were: Don Wilder, Chairman Jack McGreevy, Member Peter Young, Member James Eckert, Member Dave Bergen, Trustee Lauren Standish, Secretary Absent Were: Tom Schlichter, Member Joyce Grigonis, Member Jacob Smith, Student Member CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM CHAIRMAN'S ANNOUNCEMENTS Chairman Don Wilder reviewed the letter from Member Peter Young requesting the committee consider breaking up into groups when making the field inspections. The other members of the Council agreed and suggested looking into the use of the Town van. Chairman Wilder divided the members into two groups. Members Jack McGreevy and Peter Young will cover Peconic, Cutchogue, New Suffolk, Mattituck and Laurel, and Chairman Don Wilder and Member James Eckert will cover Southold, Greenport, East Marion, and Orient. After one month, the groups will be reversed. Don also reported on 2 the progress of the Laurel Lake Preserve. The access to the water is up for discussion and a survey is being conducted of the plant life and the condition of the existing dock. REPORTS Member Peter Young suggested the committee set criteria for the members to follow. The deer population is an issue and could put the farmers out of business. Chairman Don Wilder volunteered to research the issue on the Internet. Peter reported on East End Lighthouse, which is an organization that is looking to control the off-shore facilities. Peter thought it might be a good idea for the Town to look into the conservation of these historic structures/properties. He will get more information such as contact names, and write a letter to the Town Board. Member Jack McGreevy reported on his recent LWRP committee meeting. They discussed suggesting to the Town Board the possibility of purchasing a dredge. Currently, the County handles all of the dredging for the Town. Jack expressed a concern for the need of Down's Creek to be dredged. Trustee Dave Bergen explained that Down's Creek does not meet the criteria for dredging. Jack also reported that the LWRP committee will be setting up a meeting with the Trustees and the Town board to discuss any conflicts. Dave Bergen suggested the Town Board should not get involved at this time. APPROVAL OF MINUTES Moved by Peter Young, seconded by James Eckert, to Approve the Minutes of August 16, 2006. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by James Eckert, seconded by Peter Young, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDTIONS of the Wetland Permit application of SANDRA ENGELKE to remove 173'+/- of existing bulkhead and construct new bulkhead with 9' and 14' returns inkind/inplace. Remove 2-3' existing stairways from bulkhead to beach and replace inkindlinplace. Re- vegetate slope with Cape American beach grass. Remove existing west stairway to bulkhead and replace inkind/inplace. Remove existing east stairway to deck and construct new stairway and deck. Located: 5704 Indian Neck Lane, Peconic. SCTM#98-5-14.3 Inspected by: James Eckert, Jack McGreevy, Peter Young, Don Wilder The CAC recommends Approval of the application with the Condition there is minimal disturbance to the bank and an effort is made to save as many trees as possible. Vote of Council: Ayes: All Motion Carried 3 Moved by Jack McGreevy, seconded by Don Wilder, it was RESOVLED to recommend to the South old Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of GLADYS MILNE to remove 106' of existing bulkhead and 96' wide wooden boardwalk and replace inkind/inplace. Located: 240 Knoll Circle, East Marion. SCTM#37-5-15 Inspected by: Jack McGreevy, Don Wilder The CAC recommends Approval of the application with the Condition the entire lower area is non-turf and grated vinyl is used for the boardwalk. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by James Eckert, it was RESOLVED to SUPPORT the application of NORMA MILLER to remove 70' of existing bulkhead and stairway and replace inkind/inplace. Located: 12910 Main Rd., East Marion. SCTM#31-14-14 Inspected by: Peter Young, Don Wilder, Jack McGreevy The CAC Supports the application and recommends the existing buffer is maintained. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JOSEPH IAVARONE to renovate the existing one and a half story wood frame dwelling, demolish existing one-story section of house and construct a new one and a half story wood frame addition. Demolish existing detached garage and construct a new two-car garage. Located: 405 Wood Lane, Peconic. SCTM#86-6-4 Inspected by: Don Wilder, Jack McGreevy, Peter Young The CAC Supports the application with the Condition a drainage plan is submitted, the installation of a 20' non-turf buffer along the northwest corner of the property, and efforts are made to save as many trees as possible. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to NOT SUPPORT the application of ARTHUR R. TORELL to construct a single-family dwelling, one-car garage, gravel driveway, and sanitary system. 4 Located: 365 Westwood Lane, Greenport. SCTM#33-2-11 Inspected by: Peter Young, Don Wilder, Jack McGreevy The CAC does Not Support the application because the proposed structures are too close to the wetlands, however if the Board of Trustees vote in favor of the construction, the existing deteriorated hay bales should be replaced. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of AL SAFER to demolish the existing dwelling and construct a new six (6) bedroom two-story single-family dwelling with related appurtenance and tennis court. Located: 1295 Robinson Lane, Peconic. SCTM#98-5-2 Inspected by Peter Young, James Eckert, Jack McGreevy, Don Wilder The CAC Supports the application with the Condition drywells are installed to contain the pool backwash and roof run-off from the dwelling, the entire slope plus 10' is re-vegetated, and there are no extensions to the dwelling on the seaward side. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JANINA CASEY-DITTMAR to construct a second-floor addition to the existing dwelling and provide drywells for leaders and gutters. Located: 275 Watersedge Way, Southold. SCTM#88-5-58 Inspected by: Peter Young, Don Wilder The CAC Supports the application with the Condition of an additional 10' non-turf buffer to what exists. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the application of NICK BUBANY to construct a 4'X 75' fixed dock (min. 2.5' above grade), 3'X 16' seasonal ramp and a 6'X 20' floating dock secured by (2) 8" dia. piles. Located: 200 Hickory Dr., Cutchogue. SCTM#104-8-1 Inspected by: Jack McGreevy, Peter Young, Don Wilder, James Eckert 5 The CAC does Not Support the application because of concerns with the impact on free and easy navigation. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JLH ASSOCIATES, LLC to construct bluff stairs from top of bluff to beach. Located: 1690 The Strand, East Marion. SCTM#30-2-61 Inspected by: Don Wilder The CAC Supports the application with the Condition the width of the stairs is verified, open mesh grating is used on the landings, there is minimal disturbance to the bluff, and there is no disturbance to the existing non-turf areas. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the application of WILLIAM GRELLA to repair the existing deck, remove lattice fence on both sides of property, construct a new stone wall on north side of property and a new mahogany fence with concrete columns and stone veneer. Located: 1200 First St., New Suffolk. SCTM#117-7-30 Inspected by: Don Wilder, Jack McGreevy, Peter Young, James Eckert The CAC does Not Support the application because the impervious driveway should removed and replaced with a pervious driveway or develop a drainage plan. SCTM#9-6-4 The CAC did not make an inspection, therefore no recommendation was made. Moved by Peter Young, seconded by James Eckert, it was RESOLVED to SUPPORT the application of JACK FARNSWORTH to construct a gable roof and stoop onto the existing gazebo and replace the existing railings on the gazebo. Located: 1140 Park Ave., Mattituck. Vote of Council: Ayes: Peter Young, James Eckert, Don Wilder Nay: Jack McGreevy Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of DEBORAH DOTY to construct a 4'X 80' fixed walk (fiberglass grid material), a min. of 1.5' above grade, 4'X 14' fiberglass grid panel ramp and cantilevered kayak slide (2-4" pvc pipes). Located: 670 West Creek Ave., Cutchogue. SCTM#103-13-5.3 Inspected by: Peter Young, Jack McGreevy, James Eckert The CAC Supports the application with the Condition of a 20' non-turf buffer and no treated lumber on the support posts. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOVLED to SUPPORT the application of GEORGE KOFINAS to re-vegetate approx. 2500 sf. on bluff face that was damaged by fire and to RESERVE DECISION on the application to replace inkind/inplace destroyed 11 'X 50' wood deck and 8'X 32' bath house; and repair/replace the cap of the pre-existing retaining wall. Located: 552 East Rd., Cutchogue. SCTM#136-1-44 Inspected by: Peter Young, James Eckert, Jack McGreevy The CAC Supports the application with the Condition drywells and gutters are installed to contain the roof run-off. 7 Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Don Wilder, it was RESOLVED to SUPPORT the application of CHARLES GEITZ to raise the existing dwelling and construct a cellar, raising the house 5'; decking to be removed and replaced after house is raised; and remove the shed. Located: 1580 Leeton Dr., Southold. SCTM#58-2-5 Inspected by: Don Wilder, Jack McGreevy The CAC Supports the application with the Condition the area between the house and the bulkhead is re-vegetated, a drainage plan is submitted, and the use of fiberglass grating on the decking. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Peter Young, seconded by Don Wilder, it was RESOLVED to SUPPORT the application of JOHN & JOY GALLAGHER to Amend Permit #5745 to include a 2'8" X 10' ramp and 6'X 20' floating dock. Located: 730 Bayview Dr., East Marion. SCTM#37-5-4&5 Inspected by: Peter Young The CAC Supports the application contingent on the relocation of the neighboring docking facility and reducing the size of the proposed float to 4'X 16'. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Don Wilder, it was RESOVLED to SUPPORT the application MARY ZUPA to Amend Permit #5636 to construct a 12' extension to the existing return at the n/w end of the low-sill bulkhead, and replace 20 cy. of clean fill. Located: 580 Basin Rd., Southold. SCTM#81-1-16.7 Inspected by: Peter Young Vote of Council: Ayes: All Motion Carried 8 The next meeting of the Conservation Advisory Council has been set for Wed., October 11, 2006 at 6:00 PM at Down's Farm Preserve.
