She is handling the sale of property in his ownership on his behalf. The property in question is shown on the signed subdivision plat as Park & Playground. This minor subdivision plat was approved by the Planning Board in 1979, but was not filed in the County Clerk's office. The Park & Playground and the access to the lots within this subdivision remain in private ownership. Mr. Kreh wishes to sell the Park 8, Playground to one of the subdivision lot owners. I advised Ms. Bieling that since the property deeds refer to joint access to the Park & Playground area, that she should notify all owners of lots within this subdivision of the proposed sale, since each of the owners most likely will continue to have rights to that property after the sale. This essentially is a private matter, not a government matter. However, if the lot should be sold to the adjoining lot owner, Michael Verity, Principal Building Inspector, indicated to the two of us that the lots would merge, even while the other lot owners' right of access may remain intact. The subject lot, Pai'k & Playground, is slightly more than three thousand square feet in area, and is NOT a building lot. Folly Beach limited and Peter Kreh 1. We agree with the 5 points raised by the Suffolk County Planning Co~mission. 2. The developers should resubmit a common development plan with one efficient right-of-way and turn-around. 5- Lot # 2 is inadequate because of erosion that has taken place and will continue to take place. It also will not meet the 100 ft. setback for eesspools. 4. Both sites may be inadequate for a leeching field because of their proximity to the creek and bay and the underlying marsh composition of the soil. James Bitses, Bayview Ave. 1. The submitted map is accurate and correct. 2. Before approva~ soil and water tests should be done with the number of dwellings based in part on this information. 5- We question whether the proposed road layout and turn-around are in the best interest of the community. Pauzer, District Manager Suffolk County Soil and Water Conservation District 127 East Main Street, Room 105 Riverhead, New York 11901 Re: Minor Subdivision - Folly Beach Limited, Mattituck, New York - Town of Southold, New York. Dear Stan: These comments ~re based on preliminary plat map for Folly Beach Limited, by Roderich VanTuyl, mapped November 17, 1976. The map indicates four lots with right-of-ways in four acres along the shoreline of Peconic Bay and James Creek. Soils in these areas are mapped as: Fd; Fill Land, Dredged Material. A local resident said that the filling oecured in 1964 and 1965. A test boring on the boundary between lots 3 and 4 about 150 feet north of Peconic Bay showed 3 feet of dredge fill material over a 0.5 foot thick layer of peat bog, overlying saturated (water table) sand and gravel. My recommendations regarding the Folly Beach Limited Monor Subdivision are: 1. The entire area except for the ridge of the dune is below 10 feet elevation making it a flood prone area. The dune along Peconic Bay is indicated to be at an elevation of five feet above mean sea level and is insufficient to prevent storm flooding of the area behind it. Much of the interior area is lower than 5 feet in elevation but no depressed areas are indicated on the plot map. The soil boring was made in such an area, 1.5 feet below the 5 foot (dune ridge) elevation. The water table was found at a depth of 3.5 feet below the depressed area, approximately 5 feet below the 5 foot surface contour at 11:00 a.m. on August 17, 1977. The water table in this area is expected to fluctuate with tidal action in the bay. Cesspools are required to have 2 feet between the bottom of the system and the water table. Dear Stan: These comments are based on the Preliminary Subdivision Plat Map prepared by Roderick VanTuyl, dated December 14, 1976 for Peter Kreh. It indicates four lots with right-of-ways on four acres along James Creek. Soil in the area are mapped as: Fd; fill land, dredge material. Test borings in the adjacent property, Folly Beach Limited, show 3 feet of dredge fill material overlying 0.5 feet of peat bog overlying saturated (water table) sand and gravel. My recommendations regarding the Peter Kreh Subdivision are: A majority of the area, except for a portion of lots 1 and 2 are below 10 feet elevation making it a flood prone area. Flooding on this property will result from the low (5 feet above sea level) dune on the Peconic Bay edge of Folly Beach Limited, the adjacent property. Some of the area, particularly lot 3, is lower than five feet in elevation although the depressed areas are not indicated on the subdivision map. Water table in the area was determined by a soil boring on Folly Beach Limited at 11:00 a.m., August 17, 1977. It was found to be 5 feet below the 5 foot contour and expected to fluctuate with tidal action. Therefore, on site waste disposal systems will be difficult to install. Suffolk County Department of Health requires 2 feet from the bottom of a cesspool to water table. The area is old marsh filled in. As such, it is unsuitable for stable housing foundations without pilings. In addition, the dre- dge fill material has a high salt content preventing vegetation of up to 30 percent of the area. The vegetated area is predominated by Phragmites communis and cord grass indicative of both wet and saline conditions. Dear Mr. Wickham: The Suffolk County Planning Commission at its regular meeting on July 6, 1977, reviewed the proposed subdivision plat, entitled, "Minor Subdivision-Folly Beach Limited", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the follow- ing reasons: 1. From the information provided it can not be determined if there is an ade- quate water supply on the site and that the site is suitable for disposal of sewage. This map, therefore, should only be considered for approval after it has been deter- mined by the Suffolk County Department of Health Services that there is an adequate water supply available to serve each lot and that sewage disposal on each lot will not adversely affect James Creek and Peconic Bay. 2. Lot 2 has insufficient depth to provide a 100 foot setback from James Creek for a residential building and for any sanitary disposal facility required on the lot. 3. It is not knoWn what the constitution of the subsurface strata on the site is and what effect it will have on disposal of sewage and erection of buildings on the lots. It is believed that the immediate underlying material was salt marsh. 4. The nature of the right-of-way raises questions as to the accessibility of large vehicles and emergency vehicles to the lots. 5. Erosion of the Peconic Bay in this vicinity is considered to be critical and the erosion rate should be taken into consideration in the lot layout. The Commission also offers the following comments on the map for your use and consideration: The subdivision of this tract presents several serious problems for the environ- ment and future lot owners. It is suggested that the subdivider of this tract be re- quested to join together with the subdivider of the adjacent tract, to the north, so Mr. John Wickham, Chairman - 2 - July 8, 1977 so that a unified layout can be developed utilizing a common efficient right-of-way. The layout of these subdivisions should also take into consideration that the resi- dential buildings that will be erected on the lots may, someday in the near future, be used for year round use. R.O.W. and located as shown on the above noted map. S.e Attached she.t 2 for test hole information. 1he compact black silt found in some of the test holes could be the first run of hydraulic fill or possibly the original meadow. However, there was hardly any evidence of vegetation in the silt. 1his material was hard packed which ~uld b expected due to the depth and the length of time the hydraulic surcharge has bee in place, 1964 to 1983 and other fill from 1980. Also, most of the natural sett ment in the fill material would hawe occurred. I would not anticipate any problems for a road due to percolation c~ capillary ~ of water in this type and depth of fill. The silt ~yer might act as a seal and ca~se ground water levels to rise, but in my opinion, not to the extent of aff.¢ ing a road subgrade. Recommendations for a road section: 1. Road width to be at least 18 ft. 2. Place a 6" compacted course of bank run or equal~ containing 25% or more of gravel (medium size) and 10 to 15% of loam. 3. Place a compacted 3" crowned top course of 3/4" stone blend on the bank run 4. ~ome minor grading is necessary throughout and at the last 230 ft. where th road will drop from a higher level to meet the existing road at the marirm. 5. ~here does not appear to be any surface drainage ~roblems for the above roa~ recommendations. 6. This is borne out by accompanying test hole data and location maps. Dear Stan: These comments are based on the Preliminary Subdivision Plat Map prepared by Roderick VanTuyl, dated December 14, 1976 for Peter Kreho It indicates four lots with right-of-ways on four acres along James Creek. Soil in the area are mapped as: Fd; fill land, dredge material. Test borings in the adjacent property, Folly Beach Limited, show 3 feet of dredge fill material overlying 0.5 feet of peat bog overlying saturated (water table) sand and gravel. My recommendations regarding the Peter Kreh Subdivision are: - A majority of the area, except for a portion of lots 1 and 2 are below t0 feet elevation making it a flood prone area. Flooding on this property will result from the low (5 feet above sea level) dune on the Peconic Bay edge of Folly Beach Limited, the adjacent property. Some of the area, particularly lot 3, is lower than five feet in elevation although the depressed areas are not indicated on the subdivision map. 3o Water table in the area was determined by a soil boring on Folly Beach Limited at 11:00 a.m., August 17, 1977. It was found to be 5 feet below the 5 foot contour and expected to fluctuate with tidal action. Therefore, on site waste disposal systems will be difficult to install. Suffolk County Department of Health requires 2 feet from the bottom of a cesspool to water table. The area is old marsh filled in. As such, it is unsuitable for stable housing foundations without pilings. In addition, the dre- dge fill material has a high salt content preventing vegetation of up to 30 percent of the area. The vegetated area is predominated by Phragmites communis and cord grass indicative of both wet and saline conditions. A local resident said that the filling occured in 1964 and 1965. A test boring on the boundary between lots 3 and 4 about 150 feet north of Peconic Bay showed 3 feet of dredge fill material over a 0.5 foot thick layer of peat bog, overlying saturated (water table) sand and gravel. My recommendations regarding the Folly Beach Limited Monor Subdivision are: 1. The entire area except for the ridge of the dune is below 10 feet elevation making it a flood prone area. The dune along Peconic Bay is indicated to be at an elevation of five feet above mean sea level and is insufficient to prevent storm flooding of the area behind it. Much of the interior area is lower than 5 feet in elevation but no depressed areas are indicated on the plot map. The soil boring was made in such an area, 1.5 feet below the 5 foot (dune ridge) elevation. 3o The water table was found at a depth of 3.5 feet below the depressed area, approximately 5 feet below the 5 foot surface contour at 11:00 a.m. on August 17, 1977. The water table in this area is expected to fluctuate with tidal action in the bay. Cesspools are required to have 2 feet between the bottom of the system and the water table. They are also required to be at least 100 feet from surface waters. Because of these requirements, on- site waste disposal systems on these lots will be difficult to in- stall. Stanley A. The well was drilled by East Coast Drill- ing and the water tested by the H2~ Corp. Kreh has an adequate water source which supplies his residence. Custom Cesspools, Inc. has examined the area where the Yoll~ Seach cesspools would be located and has written you that there is no condition "which would prevent the instsllation of a sub-surface sewage system? A field man from the Suffolk Department of Health Services examined the area and found water at five and a half feet the last four feet ~ere sand. The field man, Charles Brigham, also examined the location of the well. 2. Lot 2 does have sufficient width for the building and cesspool to be located 100 feet from James Creek. 3. This is answered in #1 above. 4. The right of way is 30 feet - five feet wider than Camp ~ineola Road. If for any reason large vehicles could not negotiate the right of way, which I dispute, emergenc~ access could be made over Camp ~ineols £~,r. John: '~ickham- 2 5. Erosion of Peconic Bay in this area is critical. However, the property in question is well protected by jetties. There is plenty of erosion which in another two years will fill in the entrance to James Creek. This seems to be of no interest tothe Suffolk County Department of Planning or the County Executive. The suggestion of the County Board that the Kreh and Folly Zeach plans be merged would make it a major subdivision. The problems involved would m$1tiply as the Southold Planning ~oard has advised us at various hearings in the past. A problem that was never discussed is the financial one. It is impractical to make a criss cross of Kreh's and Folly Beach's finances. This morning a team from the Agriculture Department made a fast visitation. I didn't see them. Mr. Kreh did. They took a sample test hole right in back of my house, which is more than 150 feet from where any cesspools would be placed and found water at three and a half feet. They didn't bother to ask me the location of the area in question. I am all in favor of protectin~i the ecology of this area. It is my home. I, of course, don't want to foul up my own nest. I do feel however that the Suffolk County Planning Board and Department of Health Services are programmed to say ~0 v.,ithout careful consideration and are indulging in the luxury of shooting from the hip. These properties are zoned and taxed as residential. If they are not residential, what are they? How should they be assessed?
