This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifYing that the solder used in system contains less than 2/1 0 of 1 % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

REQUEST MADE BY APPLICANT: This is a request for a Special Exception under Article III,
Section 100-30A.2B and 100-31B, sub-sections 14a-d of the South old Town Zoning Code
(amended 2-7-9). The applicant and owner is proposing to reside in the single-family dwelling, and
in conjunction with his residence proposes to establish a Bed and Breakfast as an accessory use,
with up to three (3) guest bedrooms for lodging and serving of breakfast to not more than eight (8)
casual, transient guests (roomers).
PROPERTY DESCRIPTION: This property contains 20,414 sq. feet with 112.57 feet along the
Main Road and 192.74 feet along Orchard Lane (Old Orchard Road). The property is improved with
a single-family dwelling, an accessory metal cottage building, one-car garage, and small shed, as
shown on the 2/25/03 survey, amended 4/17/03 by Pat T Seccafico, P.C.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 3, 2005, at which
time written and oral evidence was presented. Based upon all testimony, documentation, personal
inspection of the property and the area, and other evidence, the Zoning Board finds the following
facts to be true and relevant.
REASONS FOR BOARD ACTION. DESCRIBED BELOW: Based on the testimony and record
before the Board and personal inspection, the Board makes the following findings:
1. This use as requested is reasonable in relation to the district in which it is located and to
adjacent and nearby use districts. This proposed Bed and Breakfast Accessory Use is incidental to
the residential occupancy by the applicant as an owner of the home.
2. The owner's proposed Bed and Breakfast accessory use will not prevent the orderly and
reasonable use of adjacent properties, or properties in adjacent use districts, or of permitted or
legally established uses in this zone district or adjacent use districts.
3. The safety, health, welfare, comfort, convenience, and order of the town would not be adversely
affected by the proposed Bed and Breakfast accessory use and its iocation.
4. The structure will be readily accessible for fire and police protection.
5. The proposed use will be in harmony with, and promote, the general purpose and intent of the
zoning code (Chapter 100) and will be compatible with its surroundings and with the character of the
neighborhood and of the community in general.

6. This Special Exception is for approval of the requested Bed and Breakfast as an accessory use
within the existing floor area of the existing single-family dwelling. The use of the primary building
will remain as a single-family dwelling and as such, will not prevent the orderly and reasonable use
of this property or adjacent properties.
7. No evidence has been submitted to suggest that this use will have an adverse impact on
physical or environmental conditions in the neighborhood. This accessory use is an authorized
zoning use under Section 100-31B of the Zoning Code subject to a Special Exception review and
approval by the Board of Appeals and a Certificate for Occupancy and annual inspections from the
Building Inspector for other safety and health regulations.
8. No adverse conditions were found after considering items listed under Section 100-263 and 100-
264 of the Zoning Code.
BOARD ACTION/RESOLUTION: In considering all of the above factors, the following action was taken:
On motion by Member Dinizio, seconded by Member Orlando, it was
RESOLVED, to GRANT the application for an Accessory Bed and Breakfast Use as shown
on the revised diagrams prepared by Christopher Stress, RA date-stamped April 14, 2005
outlining the walls to be removed on the first and second floors, and the April 17, 2003
updated survey prepared by Pat T. Seccafico, P.C. with hand-drawn proposed 72' by 33'
parking area, SUBJECT TO THE FOLLOWING CONDITIONS:
1. A bed-and-breakfast permit shall be issued by the Building Inspector for a term of one
(1) year under Section 100-31B if the following conditions are met:
(a) A smoke alarm shall be provided on each floor and in every guest room.
(b) The dwelling shall have at least two (2) exits and there shall be a window large
enough for emergency egress in each guest room.
(c) The identification sign shall be no larger than two (2) square feet in areas zoned
Residential-Office or higher, but there shall be no exterior signage identifying the use as a
bed-and-breakfast in residential areas.
(d) No accessory apartment, as authorized by !l 100-31 B(13) hereof, shall be
permitted in or on premises for which a bed-and-breakfast facility is authorized or exists.
2. The existing nonbearing walls that separate rooms shall be removed.
3. There shall be a maximum of four (4) bedrooms, including the owner/resident's
bedroom.
4. A minimum of five (5) parking spaces shall be on-site on this property (three for the Bed and
Breakfast Use and two for the single-family dwelling).
5. Applicant-Owner shall occupy the dwelling as their principal residence, and shall obtain a
Certificate of Occupancy or Compliance from the Building Department before occupancy of
the building as a new Accessory Bed and Breakfast.

6. This Authorization by the Board of Appeals is solely for an Accessory Bed and
Breakfast and does not include use of the lot and buildings for any other use or
purpose.
7. The owner (applicant) shall obtain a B & B permit from the Town of Southold Building
Department as required by Code Section 100-31(B).
8. There shall be no backing out of cars onto Route 25 or Orchard Lane.
9. There shall be a flexible chain ladder placed next to each guest bedroom for emergency
purposes.
10. The owner (applicant) must occupy the dwelling as a principal residence, and must
comply with all of these conditions before obtaining a Certificate of Occupancy or
Compliance from the Building Department, and before guest occupancy of the building as a
new Accessory Bed and Breakfast as required by Code Section 100-31 B.
11. The Board of Appeals reserves the right to visit the building, by appointment, regarding
compliance with the conditions of this approval, under this date, before a Certificate of
Compliance or Certificate of Occupancy is issued.
