Dear Mr. Eller:
As per your written request dated March 29, 2006 for a Certificate of Occupancy final site inspection, Planning
Department staff performed site visits on April 3 , 2006 and June 26, 2006. In reference to the above, the
Planning Board has accepted the 'As-Built' plan dated February 19, 1991 and last revised May 18,2006. As per
your letter dated June 21, 2006, the Planning Board has accepted the minor changes in landscaping along the
vineyard rows on the west of the parking lot and the east side of the tasting room building. TIlls is to inform you
that the site plan requirements have been satisfied conditional of the following items:
1. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the Southold
Town Building Inspector.
2. All handicap parking stalls and access aisles must comply with New York State Code and ADA
reqwrements.
TIlls letter does not condone any changes from the approved site plan and approvals from other agencies if
required.

Pursuant to your conversation with The Bidwells, the new tasting pavilion has been designed in
conformance with TIle Building Code of the State of New York. Additionally, specific to your
inquiry to handicapped accessibility, section 4.5.1 of the Americans with Disabilities Act
requires surfaces along accessible routes to be stable, fim1 and slip-resistant. The compacted
grave! indicated in the contract documents satisfies this requirement.

Dear Mr. Eller:
At your written request, date received on March 30, 2006, for a Certificate of Occupancy
final site inspection, Planning Department staff performed a site visit on April 3, 2006.
The Planning Board held a work session on April 3, 2006 and discussed the as built
conditions of the site described above. The Planning Board is unable to recommend a
Certificate of Occupancy or issue a site plan satisfaction letter at this time. The site work
does not match the approved site plan dated July 12, 1995. We request that you submit to
the Planning Department an as-built site plan detailing the changes. Please include the
following items: parking lot, parking spaces, driveway entrance, drainage calculations,
ADA locations for handicap requirements, landscape, walkways and any other site
changes. Additionally, please submit information on the new sign including a detailed
drawing with colors for review.
