BASIS OF APPLICATION: Zoning Code Section 100-33, based on the Building inspector's February 23, 2006 Notice of Disapproval which states that, The "as built"accessory in-ground pond, situated on this 41,090 square foot corner lot, Is not permitted pursuant to Section 100-33, which states: "In the A-C District & Low Density Residential District, accessory buildings & structures or other accessory uses to be located in a rear yard,..." The application concerns a 'fish pond' (lily pond) built in the ground along side of the owner's existing deck and separate(detached)from the house. CODE PROVISION: The definition of swimming pool in the Zoning Code reads: "A structure containing an artificial body of water which is greater than six (6) feet long or wide and greater than eighteen (18) inches in depth at any point. Natural or man-made ponds all banks of which have a slope of less than forty-five degrees (45°)shall not be included in this definition." FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 27,2006, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property,and other evidence,the Zoning Board finds the following facts to be true and relevant: The Board, on its own motion, determines that, pursuant to Section 100-33, a fish pond or lily pond is not a structure which must be located in a required yard. Also, since the pond is not for habitable use or occupancy, but rather is for the enjoyment of maintaining a fish pond with plantings and landscaping. Therefore, a fish pond is not subject to the zoning ordinance pertaining to structures. This ruling does not change any Building Department requirement for proper fencing with self-closing gates that pertain to fish or lily ponds or other man- made depressions capable of holding 18" or more of water. BOARD RESOLUTION: Now, therefore, under the authority given by New York Town Law, Section 267, motion was offered by Member Goehringer,seconded by Member Weisman,to Reverse the February 23, 2006 decision of the Building Inspector which requires the in-ground fish pond to be located in a rear yard. The front of the dwelling is facing Park Avenue with the driveway situated on Long Creek Drive. The dwelling adheres to having the two front yard offsets(approx 114' from the front of the dwelling to Park Avenue and 55'4" from the front of the dwelling to Long Creek Drive). Due to having two front yard offsets there is only one area in the"rear" of the dwelling to place any aesthetically pleasing and/or character building landscaped structures, which is to what appears to be the rear yard although due to zoning codes is deemed the side yard on this particular parcel. The pond was set into place during the original construction of the house and has been on the survey since the original C.O. dated July 18, 2002. This was also on the survey for the addition, which was approved for a building permit(30717z). The pond is not connected to the dwelling in anyway nor is it used as a swimming pool. The landscape has been constructed just so in the rear area of the dwelling for over 4 years. (2) The alleged hardship relating to the property is unique because of the lot placement. Being that the lot is situated on the corner of Park Avenue and Long Creek Drive there is an area that appears to be the rear portion but due to zoning codes the rear portion of the dwelling(where the pond) is situated in a side yard. (3) The alleged hardship does not apply to a substantial portion of the neighborhood because it is placed behind the dwelling. The pond is small. (4) The request will not alter the character of the neighborhood because it is a small sized man-made pond. The landscape is also admired by the neighbors and well liked. (5) The alleged hardship has not been self-created because the lot is situated just-so and the zones that were set into place created an area in the rear of the dwelling to be known as the side yard. The placement of the pond would be situated in the rear yard if the lot were not a corner lot. (6) This question is not applicable because there is not a question of setbacks just the location of the pond in regards to the lot. However, we are asking for the minimum, which is to grant the variance so that a final may be issued on the addition to the dwelling.
