PROPERTY FACTS/DESCRIPTION: The applicant's 40,049 square foot parcel has frontage along two streets, 125.50 feet along Hill Crest Drive, 242 feet along Sound View Drive, and 150.50 feet along Browns Hill Road, in Orient. The property is improved with a two-story, single-family house. BASIS OF APPLICATION: Building Department's February 3, 2006 Notice of Disapproval, citing Section 100- 33, in its denial of an application for a building permit to construct a proposed accessory in-ground swimming pool, for the reason that the pool is proposed in a front yard (Sound View Drive) instead of the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 30, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct an accessory swimming pool 40.5 feet from the southwesterly front lot line (adjacent to Browns Hill Road, a private road) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property has frontage along two town streets and an unimproved right-of- way. Although the yard for the proposed pool is adjacent to Sound View Drive and an unimproved right-of-way (Browns Hill Road), the yard is mostly wooded and the pool will be at least 40.5 feet from the applicant's property line along Browns Hill Road and at least 25 feet from the property line adjacent to Sound View Drive. The applicant will maintain a natural, treed yard for screening of the pool area and will properly enclose the pool to meet all codes. 2. The variance granted herein is substantial, in that the entire pool is in a front yard, and the rear yard is limited to the yard on the shorter,40 ft.wide side of the home adjacent to Subdivision Lot 6. • Page 2—April 13,2006 ZB File No. 5856—Richard Locke• • CTM No. 13-2-8.9 3. The difficulty was self-created in that the home was located greater than the code-required 50 ft. minimum front yard setback from Sound View, which reduced the available rear yard to only 40 feet. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the December 2, 2002 survey, amended February 14, 2006 by John Metzger, P.C., Any deviation from the variance given such as extensions,or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. I would like to locate the pool in this area of my rear yard because, unlike the rest of my yard, there are no trees and the pool would receive the greatest amount of sunlight. When I purchased the property and constructed my house, I did my best to preserve as many trees as possible. I would like to continue that policy - I believe the trees provide my rear yard with an almost "park like" quality. By locating the pool in this area of my rear yard, I would not have to remove any trees. The northern portion of my property is bounded by a "paper street." The street, Sound View Drive, was never constructed by the original developer. It currently exists as a wooded area between myself and my neighbor, Ian Crowley. The Brown's Hill Community charter explicitly states that Brown's Hill Road is to be used by Brown's Hill residents only. For this reason, the chance that this "paper street" is one day paved and turned into a dead end road is highly unlikely. Because this "paper street" exists, the area of my parcel where I would like to locate an in-ground pool is considered a front yard. My actual front yard is located east of my house, on Hill Crest Drive. I respectfully request a variance to permit the construction of an in-ground swimming pool in the northwest corner of my parcel. This area is located in my actual rear yard and, I believe, the best location for an in-ground swimming pool. The pool would receive the greatest amount of sunlight and I would be able to preserve all of the property's trees.
