BASIS OF APPLICATION: Request for Variance under Sections 100-33C and 100-244B, based on applicant's request for an amended Building Permit and the Building Inspector's January 19, 2006 Notice of Disapproval concerning construction of a foundation for an accessory garage in a front yard at less than the code-required 40 feet from the front property line. PROPERTY FACTS/DESCRIPTION: A pre-existing accessory garage located in the applicant/owner's front yard was demolished in order to make room for the heavy construction equipment that was needed to meet the Health Department's drainage standards to bring the septic system up to code The location of the new septic system required that the location of an accessory garage be revised. The Building Department states that a revised site plan showing the new, non-conforming location was not submitted prior to the pouring of a concrete slab and footings for the proposed garage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 30, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed 574 square foot accessory garage will have no greater visual impact than the original pre-existing garage of 587 square feet. There are primary and accessory structures on the surrounding properties to the east and west that have non-conforming setbacks that are less conforming than the applicant's requested variance of 32 feet from their front property line. Page 2—April 13,2006 • • Appeal No. 5850—Elena Karacostas CTM 135-1-2 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The required location of the septic system and the steep slope of the curved driveway significantly limit access to an accessory garage in a location other than the one proposed on the site survey by Joseph Ingegno dated October 27, 1998, amended January 11, 2006. Demolishing the work done so far on the garage in it's non- conforming location in order to move the propose garage an additional eight feet from the front property line would cause considerable financial hardship to the owner/applicants and would result in a greater impact on the neighbors to the east. 3. The variance granted herein is not substantial. Only 117 square feet of the proposed 574 square foot garage is too close to the property line, requiring relief of 8 feet from the code- required 40 foot front yard setback. 4. The alleged difficulty has been self-created. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. Owner/applicant is installing drywells to prevent runoff on the bluff. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairwoman Oliva, and duly carried to GRANT the variance as applied for, shown on the survey dated October 27, 1998, amended January 11, 2006 by Joseph A. Ingegno, L.S. and shown on the February 8, 2006 construction diagram A-8 prepared by Fairweather-Brown Design Associates, Inc. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback or other feature of the subject property that may violate the Zoning Code,other than such uses, setbacks and other features as are expressly addressed in this action. There was confusion with the set-back required on the front yard and the foundation has been poured at that location- 32' from the front property line when it should be 40'. The surrounding properties have primary residences and accessory building setbacks from the road that are less than what we are seeking. (please refer to photos attached). There is currently a major renovation/addition being constructed on the Residence that is under a separate permit. The building department issued the accessory garage permit referring to the original site plan submitted with the residence application. The pre- existing garage had to be demolished to meet Health Department drainage standards to bring the septic system up to code. Due to the location of the new septic-system the location of the garage had to be revised. The current location of the garage foundation is 32' to the property line, according to the recent survey by Joseph Ingegno, (submission of which caused the building dept.'s disapproval). The distance to the concrete wall with iron fence above is 42'+ and the distance to the edge of the pavement is 56'+. There is a steep winding driveway from the road level to the location of the garage. This site is the location for the remodeling of a 2-story dwelling. At the time of inspection the house was gutted and the existing garage was removed. Additionally, the foundation for a new garage was set and construction debris was found throughout the site. No great limitations where found on the subject parcel in regard to the stability of the bluff_ However, the bulkhead at the bluffs toe is in need of repair. A small portion of the rear yard is sloped toward the bluff edge but the majority of the yard is sloped away from the bluff. It is advised to install gutters and downspouts on the house and pipe the roof runoff into drywells. This will prevent additional runoff from flowing over the bluff edge. Dry wells should be sited as far from the bluff edge as possible in order to minimize seepage out onto the bluff face. The bluff itself is in dense vegetative cover and appears stabile at this time with the exception of where the bulkhead is damaged. The damaged bulkhead has been patched(on the seaward side)with pieces of wood but water is still finding its way through these patches.Where patches exist,the sand is beginning to erode behind them. This bulkhead must be repaired as soon as possible so that future erosion is minimized. Ideally the replacement patches of wood should be screwed to the landward side of the bulkhead and filter cloth placed between the bulkhead and wooden patch. However,this may only be feasible where the sand has already eroded behind the bulkhead and the landward side of the bulkhead is now accessible. Phragrnites,also known as the common reed,is an invasive plant species that will crowd out native species and alter wildlife habitat. Another indication of groundwater seepage was the presence of frozen water on the top of the bulkhead and also on the face of the bulkhead. This ice has the appearance of groundwater seeping out of the bluff face and through the bulkhead. The landowner should monitor this condition and he sure to maintain dense vegetative cover on the entire bluff_ One large tree was observed growing on the bluff face adjacent to the stairs. This tree should be cut down to its base leaving the roots in tact; do not leave any debris on the bluff. Trees and tall shrubs tend to sway during heavy winds,causing the roots and associated sand to loosen,thereby weakening the integrity of the bluff Should you require further assistance in this matter, please don't hesitate to contact this office.
