(631)765-1809 • Fax(631) 765-9064 MAR 1 7 2006 FINDINGS, DELIBERATIONS AND DETERMINATION Souluuid Devil!Clerk MEETING OF FEBRUARY 2, 2006 ZB File No. 5829— Pat lavarone Property Location: 995 West Road, Cutchogue CTM 110-7-3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 34,000 square foot parcel has 110.50 feet along West Road (also referred to as Pequash Avenue) and a lot depth of 305 feet along the easterly side property line. The property is improved with a single-family, two-story frame dwelling and accessory garage as shown on the June 20, 1968 survey prepared by Robert Kart, and the January 5, 1996 survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Building Department's November 1, 2005 Notice of Disapproval, citing Section 100-30A.3 in its denial of an application for a building permit concerning as-built alterations to a non-habitable attic. The reason stated in the denial is that Section 100-30A.3 states that the construction is not permitted unless the same conforms to the requirements of the Bulk Schedule and of the Parking Schedule, with the same force and effect as if such regulations were set forth herein in full, and that the Bulk Schedule limits a building to 2% stories, and stating further that the as-built construction converts the attic to a third story. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 26, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants request a variance for a bedroom and storage (closest and storage area) on the area above the second floor of the existing dwelling, as detailed on the "as built"finished attic plan prepared 10/10/2005 by Eileen Santora, Residential Designer. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The three-story house was constructed prior to 1957 with a finished habitable space on the third floor and three small dormers, and rendered non-habitable after the 1938 hurricane. Two out of the three dormers were destroyed in 1938. The area that was upgraded was interior, and renovated it with updated electrical and energy compliant insulation. •Page 2—February 2,2006 • ZB File No.5829—Pat lavarone CTM No. 110-7-3 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dormers were restored under Building Permit 22830-Z issued in 1995, and extended under Building Permit 31329. There will be no expansion of the space, and the as-built alteration is an updated replacement of the former habitable space, remaining the same as originally constructed on the interior of the existing house. 3. The variance granted herein is not substantial and updates the area that was used on the third floor area. 4. The difficulty has been self-created because the building permit expired in 1996, after having been altered, and a certificate of occupancy cannot be issued without a variance under the Town Code. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The two dormers were replaced in 1996 and face the water, away from the road and the two adjacent houses. There will be no outside change in the appearance of the home by the grant of the relief. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of interior alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the "as built finished attic plan date 10-10-05 prepared by Residential Designer Eileen Santora, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The dwelling shall be in compliance with the New York State Construction and Fire Codes. 2. No further expansion of the third floor living space shall be permitted. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The house was constructed prior to zoning with three stories and three dog house dormers - the third floor was finished habitable space. During the 1938 hurricane two out of the three dormers were destroyed. When the applicant began renovating the house he obtained a permit to restored the dormers (Permit 22830Z- extended under permit 31329) . The building department, however, did not have records of the habitable space because the house predated the building code. Therefore when the applicant renovated the existing finished interior space a notice of disapproval was issued. The applicant did not change the space merely renovated it with updated electrical and energy compliant insulation. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The space was occupied, habitable space . There has been no change or expansion of the space, merely updating. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The house design predates zoning and the New York State Building Code. The renovations were customary improvements to an old house. The space has always been living space and remains the same as originally constructed. 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The house predates zoning and all environmental regulations . There are no adverse effect or impact on the physical or environmental conditions by the renovation of the existing house . The renovations preserves the existing structure. 5 . The alleged difficulty was not self-created. This space is existing, having been renovated in 1996, but the permit expired and the certificate of occupancy can not be issued until this variance is granted. Mr. John Bayles issued the original permit, none of the current inspectors saw the third floor space prior to the renovation, therefore, a notice of disapproval has been issued. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . This property is the location for the proposed construction of a replacement cement porch and porch roof in the rear yard. No limitations were found at this site. The house is fitted with gutters and downspouts which outlet into the ground. The rear yard is sloped towards the Sound and is in dense grass cover_ An aging wooden bulkhead stabilizes the north edge of the rear yard;the bulkhead is approximately 8 or 9 feet in height. It appears as though there was once a dune(or perhaps a marsh)where the bulkhead now exists. Although it is generally recommended to slope the yard landward, away from the shoreline, there does not appear to be any active erosion. The bulkhead itself appears stabile at this time although the vertical support posts are severely deteriorating. It is suggested that these posts be replaced at some point in the near future;a professional engineer should be contacted It is estimated that the mean high tide line is approximately 8 feet from the bulkhead while storm surges do reach the bulkhead. At the time of inspection, the beach was littered with excessive amounts of debris, both natural and man-made. Additionally, Phragmites and Montauk daisies were observed at the toe of the bulkhead.
