PROPERTY FACTS/DESCRIPTION: The applicant's property is shown as Plot 1 on the Map of re-subdivision of Block F, Map of Reydon Shores, filed October 7, 1936 with the Suffolk County Clerk's Office. The lot contains an area of 13,300+- square feet and has 60 feet along Lake Drive. The property is improved with a two-story, single-family house, as shown on the applicant's site plan dated December 6, 2005. BASIS OF APPLICATION: Building Department's November 16, 2005 Notice of Disapproval, amended November 29, 2005, citing Sections 100-242A(Walz Interpretation No. 5039)and 100-244B, in its denial of an application for a building permit to construct proposed additions and a new accessory garage, for the reasons that the new construction will constitute an increase in the degree of nonconformance when located at less than 10 feet on a single side yard, and the proposed garage is proposed at less than 35 feet from the front yard lot line. ADDITIONAL INFORMATION: The November 29, 2005 Notice of Disapproval was amended to reflect details and changes in setbacks that were not included on the rough map submitted under the November 16, 2005 Notice of Disapproval. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 9, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants propose: (a) a new 20' x 26' garage facing Lake Drive, with a setback of 23.9 feet to the front lot line, and 41 feet to the edge of the pavement in the easement of Lake Drive, (b)with a side yard setback shown at 7.57 feet from the westerly side lot line, and (c) proposed first floor additions; (d) second floor reconstruction with cottage style deck, after removing the existing nonconforming dormer, all as shown on the October 30, 2005 diagrams with applicant's updated hand-written notations and site plan with updated penciled notations. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—March 9,2006 • ZB File No.5823 Charles and L Hill CTM No.80-3-20 1. Grant of relief from the code-required front yard setback and alternative variance for a minimum four foot side yard on the westerly side will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The traveled edge of Lake Drive extends approximately 17 feet beyond the applicants' lot lines, which gives the appearance of 43 ft. front yard from the house, although the setback will be 23 feet from the code-required front yard lot line. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is removing the existing accessory shed off the property as part of this proposed site plan. 3. The relief requested is substantial in relation to the code requirements, and is the maximum relief that the Board will allow. 4. Although the home is existing with side yard nonconformities, the difficulty was created, based on applicants'desire to build in these locations with an increase in the degree of setback nonconformities. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and an accessory garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Goehringer, and duly carried, to GRANT the variance with regard to the front yard setback as shown on the October 30, 2005 elevation and site diagrams with hand-written notations, and to DENY the relief as applied for with regard to the requested westerly side yard setback, and to GRANT alternative relief for a minimum four (4) ft. side yard setback for the proposed garage on the westerly side, and subiect to the following Conditions: 1. The leaders, down spouts, gutters shall be installed with an adequate drywell system; 2. Lighting shall be shielded to the applicant's property without affecting neighboring lands. 3. The existing accessory shed shall be removed off the property. 4. The garage shall be used for code-permitted accessory uses, and not as dwelling livable area. 5. The westerly side yard shall not be less than four feet for new construction. Any deviation from the variance given, such as extensions or demolitions which are not shown on the applicant's diagrams or survey site maps,are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses, setbacks and other features as are expressly addressed in this action. Dear Sin, I am applying for two variances as per my Notice of Disapproval from the building department dated 11/29/05. The first variance will be referred to as Variance# 1 which we are asking for relief of the side yard setback of 10 feet located on the northwest corner of the proposed addition. The second variance will be referred to as Variance#2 which we are asking for relief of the front yard setback of 35 feet located on the south end of the property for the accessory garage. Variance#1- Seeking relief of 2 ft.6" x 11 ft. 6" (=2Ssa.ft. of addition) of the 10 ft. side yard setback. Part A: Area Variance Reasons as follows; 1) An undesirable change will not be produced in the character of the neighborhood or a detriment • to nearby properties, if granted, because: The Reydon Shorn community is unique and stands alone as one of the crown jewels of our North fork. The `Cottage' Architectural character is preserved beautifully as every single remodeling or new home project has been planned and built to enhance the unique Architectural integrity of Reydon Shorn—including ours. We have worked tirelessly for three years with a number of Architects and Engineers and have reached a New England Cottage design that we feel will add tremendously to our neighborhood. Our home at 655 Lake Drive, the last one on a dead end street, is a vital focal point from the water as our North side( please refer to pg# -Northern Elevation- under overlay sheet)faces directly down the middle of the Reydon Shores channel and is the first house EVERY boater sees entering our harbor and can be seen clearly by all the passing boats in Southold bay.As the Elevation plan shows, we have taken this focal point very seriously in our design. The remodeled home will be our full time residence and we feel our reasons for the variances are well founded. 2)The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance because: Please refer to the first floor plan. As you can see on the plan, the only place for a Chimney/fireplace is where it is planned. The old chimney is non- working and is presently to close to the staircase. There simply is no other place for it. By keeping the cottage look we are sacrificing a great deal of living space and our only area of space will be the great room which will be 26'x15'S"which will serve as a dining room and a living room. As you can see this area is vital. Expanding on the other side will only increase the kitchen/ 0 dining area which we do not need. Pg. 2 • 3) The amount of relief requested is not substantial because: Please refer to the scaled sketch overlay of the existing house located on pg.# on the Northern Elevation . As you can see we will be eliminating the entire existing 2"floor dormer(which is presently non-conforming) and will bring the 2'd floor back to current setback code. SPECIFICALLY we are asking for relief of app. 18" x 6 feet of 1"floor addition with an aesthetic 12" roof overhang and appr.18"x 5ft 6"of L ff the addition.As you can clearly see, by eliminating the non-conforming 2o" floor- the new construction actually looks less subtle than the existing structure while providing a `Marthas Vineyard' second floor cottage deck overlooking Southold Bay. 4) The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district in any way. Quite the opposite-All painting, scraping and sanding maintenance will be eliminated as we are installing all maintenance-free siding,windows and decking. The remodeling will have a positive financial impact on home values on Lake Drive as the updated home will increase all property values. 5)Has the variance been self created?- both yes and no as the house currently stands non conforming and we are requesting an increase in non conforming while at the same time decreasing the non conforming as on the 2e" floor. 6)Due to the extreme narrowness of our lot size( basically 60' wide) it has made it very difficult to achieve architectural balance, usable space and aesthetic values in meeting the code requirements. • We feel we have achieved this with our plans. Variance#2- Seeking relief of 11 ft. 6" x 20'(=230 sq.ft.) of the Front yard setback of 35 feet from a Garage. Part A : Area Variance Reasons as follows; 1)An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties, if granted, because: Throughout Reydon shores,the property lines are of extreme distance to the actual roads. In the case of our property- the edge of the road (Lake dr.) is SEVENTEEN feet plus away from our property line. This is the most significant fact that exists for our variance request. (This is the average distance of all six neighboring homes on the north side of Lake drive.) This distance of 17 plus feet which we maintain as our property ( as does everyone else in our community)added to the 23 plus feet from our proposed garage to our property line comes to a total distance of FORTY ONE FEET plus from the road to the proposed garage. Visually- Exceeding the setback requirment of 35 feet by Six feet plus.(as shown on pictures # 1 & # 2 ). Additionally, Picture# 3 shows my neighbors garage,two houses down from ours ,when lined up to the edge of my proposed garage, is at least 8 feet closer to the road than my proposed garage thus clearly showing that our proposed garage will not change the existing character of the • neighborhood. Picture# 4 shows the Hefernans home(just recently built last year) on West shore drive in Reydon shores in an almost identical situation in both design and setup as our proposed home. This picture also provides the aesthetic value our design will bring to the community. Pg.3 • 2)The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance because: -A two car garage is desperately needed for storage of a 25 ft. sailing mast during the winter months ( currently tied up to our fence not only creating an eyesore but weather beating our equipment badly). The garage will also act as a workshop.We currently have a one car garage and it is filled beyond capacity. -Also It would be impossible to put the garage on the east side of the property because of septic location. Our only other option is to put the garage directly in front of the house thus completely losing the aesthetics of a front door home-as our front entrance would literally be two garage doors a very unappealing look. 3)The amount of relief requested is not substantial because: As extensively stated in #1—the actual distance from the garage to the road is FORTY ONE FEET PLUS. 4) ) The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district in any way. Quite the opposite as normal garage spills of gas, oil, paint etc. will be easily cleaned up on a cement floor as well as all new materials are maintenance free thus eliminating the potential hazards of storing, sanding, scraping and painting the old garage. 5) The variance for the Accessory Garage has been self- created. • 6)Due to the extreme narrowness of our lot size( basically 60' wide) it has made it very difficult to achieve architectural balance, usable space and aesthetic values in meeting the code requirements.
