September 12, 1988. This letter of credit is to also cover

and authorize you to draw upon this Bank up to an aggregate amount of

The following action was taken by the Southold Town

RESOLVED that the Soutohld Town Planning Board recommend
to the Town Board that the letter of credit for Harbor Lights,
Section 4 be extended for a one-year period to expire on
October 1, 1988. This letter of credit is to also cover corrective
work necessary since items in the original bond estimate were
not complied with.
Enclosed are copies of the engineers reports with
regard to this subdivision,indicating the remaining work to
be completed.
Please note, the Town Board authorized a reduction in
the letter of credit from $100,000 to $35,000 in August 1986.

Re: Site Inspection of Retention Area, Harbor Lights Estates,
Section Four, Town of Southold, N.Y. (SBB NO. 87144)
Gentlemen:
A site inspection of the "recharge area" for this project was conducted
on 9/22/87. Present were Mrs. Valerie Scopaz, Town Planner, Town of
Southold, Mr. Raymond Dean and Mr. C.S. Heffernan, both from this
office.
We found that the area could be util ized effectively in its natural
state as a recharge area and would provide adequate recharge area for
the tracts involved. Maintaining this area in its natural state would
not only provide a "greenbelt" but would protect the i~tegrity of the
existing "eco system".
Excessive silting has occured in the recharge area due to both the pipe
trench from the catch basins at the south end of Clipper Drive to the
discharge pipe at the recharge site, as well as from the areas where
excavation was performed adjacent to this discharge pipeline (Square
Rigger Lane).
We recommend that the developer stabil ize this area immediately to
deter further contamination of this recharge area and construct a
siphon structure (bubble basin) at the end of the discharge pipe to
further guard against future silting and erosion.
We also recommend that final approval be withheld until this work is
completed as well as the remedial work listed in our letter of August
3, 1987.

The following is based on inspection of work completed as of today and
the bond estimate by L. M. Tuthill, dated May 11, 1981.
There were some changes in the pavement layout. The paved turnaround
was eliminated and a temporary turning area was agreed upon and to be
located in Square Rigger Lane. This has not been done. The Ii" top
course asphalt pavement has not been placed. Estimated cost for top
course - 2800 S.Y. at 12 s.Y./ton = 233 tons at say $35/ton = $8155.00.
See attached copy of bond estimate for work items completed and not
completed.

one-year period from October 1, 1984 to October 1, 1985 in the

The Town Board made a request for an extension on the letter
of credit for Grand View Estates on November 3, 1983 for a two-
year period from April 1, 1983 to April 1, 1985, and we have
nothing in our files that this was complied with. Since you have
requested a reduction as you have indicated that improvements
have been made in this subdivision, we will have our field inspector
make an inspection and report on the percentage of work completed

the bond estimate by L. M. Tuthill, dated May 11, 1981.
There were some changes in the pavement layout. The paved turnaround
was eliminated and a temporary turning area was agreed upon and to be
located in Square Rigger Lane. This has not been done. The 11" top
course asphalt pavement has not been placed. Estimated cost for top
course - 2800 S.Y. at 12 S.Y./ton = 233 tons at say $35/ton = $8155.00.

Gentlemen:
We hereby establish our Irrevocable Letter of Credit #M-8303 in your favor and
authorize you to draw upon this Bank up to an aggregate amount of Three Hundred
Twenty-Five Thousand and NO/lOO ($325,000.00) Dollars. Said monies to the extent
necessary to complete the improvements hereinafter set forth and referred to here-
in shall be paid upon demand by the Town Board to complete road improvements to
the subdivision known as Granclview Estates at Orient, Town of Southold, New York.
Funds under this Letter of Credit are available against the Town's draft on us
presented at our office at 245 Love Lane, Mattituck, New York no later than
April 1st, 1984. Al~ drafts drawn hereunder must all also be accompanied by
the Town's signed statement certifying that the amount drawn represents sums
due under or in connection with the Performance Bond of Ronald Reese, Christine
Reese and Harold Reese, Jr.
This Letter of Credit is not transferrable.
This credit is subject to Uniform Customs and Practices for Documentary Credits
(1974 Revision) International Chamber of Commerce Publication #290 exc~pt as
expressly provided herein.
