RESOLVED that the Southold Town Planning Board recommend the park and playground fee for the major subdivision of Georgiopoulos located at Southold to be $10,000 and request approval of sam~ as this is the fee agreed upon by the applicant and after review by the Planning Board it is felt this is an acceptable amount. When this matter was discussed before the Planning Board in the latter part of 1982, the Board advised me that the fee would be $10,000.00 and asked that I confirm in writing that Mr. Georgiopoulos would accept that fee in lieu of establishment of a park and playground area. I enclose a copy of my letter to the Planning Board dated January 10, 1983 with that confirmation. I also enclose a copy of my letter to the Planning Board dated October 8, 1982 enclosing contracts for several surrounding properties to help ascertain market value. If you would like the contracts themselves, I would be glad to furnish them. We therefore request that the fee be set at $10,000.00 in line, with the statement of the Planning Board. From the Southold Town Code - Subdivision of Land: A106-38 E (3) - The Town Board shall determine the amount to be deposited based upon the following formula: not less than three thousand dollars ($3,000.00) per gross acre of land that would otherwise be required for recreation purposes, or five percent (5%) of the fair market value of the total acreage proposed for subdivision as determined by an independent appraiser retained by the Town. The applicant's attorney Ms. Gail Wickham, has indicated that this will be acceptable to the applicant. We are requesting that the Town Board determine the amount of this fee pursuant to Article III, Section AI06-38 E (3) of the Southold Town Ordinance.
