THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON APRIL 10, 1990:
RESOLVED that the Town Board of the Town of Southold hereby rescinds
their Resolutions No. 16 of September 6, 1988, and No.2 of October 18,
1988 with respect to establishing the amount to be deposited with the Town
in lieu of land for Park and Playground purposes by Henry Arbeeny, owner
of a subdivision at Kennys Road, Southold, whereas the Planning Board
has advised the Town Board that the Arbeeny subdivision has changed from
a major to a minor of three residential lots and one limited business lot,
and the Planning Board does not require Park and Playground fees for
minor subdivisions.

Dear Mrs. Terry:
Please note that a Park and Playground fee was not required
by the Planning Board for the above mentioned subdivision.
The original proposal was for a major subdivision. However,
during the review process, the proposal was changed to a minor
subdivision of three residential lots and one limited business
lot. The Planning Board does not require Park and Playground
fees for minor subdivisions. Consequently, a fee was not
required.

The Southold Town Board, at their regular meeting held on October
18, 1988, amended their resolution of September 6, 1988 setting the amount
of money to be deposited with the Town in lieu of land for park and play-
ground with respect to the Henry Arbeeny subdivision. The Board deleted
the 2.0 acres of business property from their computations, and set $8,750.00
to be deposited, based upon the 5.6 acres of residential property at 5% of
the appraised value of $175,000.

It is our belief that your resolution of September 6, 1988, (copy
enclosed) determining the amount. of $18,000.00 be deposited with the
Town in lieu of park and playground reservation, was based upon a
miscalculation.
We understand that an appraisal was made of the entire parcel and that
the fair market value of the total acreage was determined to be
$360,000.00. This parcel, however, contains 1.818 acres of
business-zoned property for which a park and playgrou~d deposit would
be inappropriate and the value of which should not be considered in
~etermining the amount of this deposit.
We secured the professional opinion of Lewis L. Edson, licensed real
estate broker and appraiser, and. he advised that business property,
generally, has twice the value of residential property. Based upon
this information we have recalculated the $360,000 appraisal as
follows:
1) 5.774 acres residential property
@ $38,250 per acre
2) 1.818 acres business property
@ $76,500 per acre
Total appraised value
$ 220,860.00
139,140.00
$ 360,000.00
If you agree with these figures, the park and playground deposit would
be $11,043.00 (5% of $220,860.00). Please review this matter at your
earliest convenience and advise us of your determination.

The Planning Board has reviewed Mr. Bruer's letter regarding
the method used to arrive at the $18,000 park and playground fee.
The Board feels that commercially-zoned property should not be
included in the appraisal. It is recommended that the appraiser
be asked to submit another report which studies the value of the
residentially zoned portion only.

This appraisal is made for the purpose of arr~v~ng
at an opinion as to the Fair Market Value of the subject
property, if offered for sale on the open market under
conditions prevailing as of August 12, 1988, and is based

comparable sales relied upon in making said appraisal

Since that time I have completed over four hundred
Real Estate Appraisals for Residential Properties, Farm
Properties, Lots, and Business Properties.
I am currently the President of Stype Brothers Real
Estate, Inc., and have been in this position since 1983.
The business was purchased from my father,
Val W. Stype, who had started the Real Estate and Appraisal
business back in 1966.
I have personally engaged in the purchase and
sale of Real Estate on the Eastern End of Long Island
for investment.

Currently Stype Brothers Real Estate, Inc., is an
active sales office involved in the sale of new residential
properties, resale properties, farm properties, waterfront
properties, and business properties.
We maintain a full-time sales office, and in addition,
offer consultation and auction services.

to Orient.

The Southold Town Board, at their regular meeting held on July 26, 1988,
adopted a resolution engaging your services for the purpose of conducting an
appraisal of the subdivision of Henry Arbeeny, Kenneys Road, Southold, so
the Town Board may determine the amount of money to be deposited with the
Town in lieu of land for park and playground purposes. Copy of the subdivision
map enclosed.
Section A106-38 E. (3) of the Subdivision of Land reads as follows: The
Town Board shall determine the amount to be deposited based on the following
formula: not less than three thousand dollars ($3,000.) per gross acre of land
that would otherwise be required for recreation purposes or five (5%) percent
of the fair market value of the total acreage proposed for subdivision as deter-
mined by an independent appraiser retained by the Town.
