J">., ABSTRACT OF LOCAL LAW RE: 2% REAL ESTATE TRANSFER TAX WHICH IS SUBJECT TO MANDATORY REFERENDUM Title: "A LOCAL LAW IMPOSING A TWO PERCENT (2%) REAL ESTATE TRANSFER TAX ON THE CONVEYANCE OF INTERESTS IN REAL PROPERTY IN THE TOWN OF SOUTH OLD, INCLUDING THE INCORPORATED VILLAGES THEREIN, WITH THE REVENUES DERIVED FROM THIS TAX TO BE DEPOSITED IN THE SOUTH OLD COMMUNITY PRESERVATION FUND FOR THE PURPOSE OF PRESERVING OPEN SPACE AND HISTORIC PLACES WITHIN THE TOWN" Purpose: To impose and create a two percent (2%) real estate transfer tax upon the conveyance of real property within the Town, including the incorporated village therein, with all revenues derived from the tax to be deposited in the Southold Community Preservation Fund for the stated purpose of the preservation of agricultural lands, open spaces, historic places, the establishment of parks, nature preserves or recreation area; the preservation of lands of exceptional scenic value; the preservation of fresh and saltwater marshes or other wetlands; the preservation of aquifer recharge areas; the preservation of undeveloped beach lands or shorelines; the establishment of wildlife refuges for the purpose of maintaining native animal species diversity, including the protection of habitat essential to the recovery of rare, threatened or endangered species; the preservation of pine barrens consisting of such biota as pitch pine, and scrub oak; the preservation of unique or threatened ecological areas; the preservation of rivers and riv~r areas in a natural, free-flowing condition, the preservation of forested land; the preservation of public access to lands for public use including stream rights and waterways; and the undertaking of any of the aforementioned for the establishment of a greenbelt; all within the Town. Expenditure of monies from the Community Preservation Fund shall be in accordance with the Community Preservation Project Plan. Effect: Impose and create, local law, a two percent (2%) real estate transfer tax upon the conveyance of real property within the Town, including the incorporated village therein, the local law to be Article IV of Chapter 6 "Community Preservation Fund" of the Town Code, Article IV to be known as the "2% REAL ESTATE TRANSFER TAX", with all revenues derived from the tax to be deposited in the Southold Community Preservation Fund.
