given by our Board, February 13, 1979, with conditions. Our
file indicates this subdivision has been inactive nearly four
years, as the most recent correspondence is dated May 7, 1979
and the conditions for the preliminary approval were never met.
If you wish to proceed with the subdivision of your property,
please submit a new application to our Board. Upon receipt we
will place the matter on the next available Planning Board agenda.

Gentlemen:
In accordance with an application by William Schreiver of
Orient for a waiver of the turn around requirements of the Southold
Town Zoning regulations in regard to his development at Tabor Road
in Orient. For the east-west road terminating in a walk-way entering
Village Lane, the Highway Committee recommends the applicants re-
quest be granted.
Applicant cannot comply with a strict requirement because
he does not own sufficient area and is unable to acquire anymore
space. Applicant has 78' of the 100' required and the Highway
Committee after confering with the Town Highway Superintendant feels
that the area available will provide most of the space needed for a
turn around for vehicles at the end of this road. This is a practical
solution to the problem and a waiver seems appropriate to assist the
applicant to complete his develmpment and to protect the taxpayers
and residents while complying with the spirit and intent of the Town
zoning Rules.
Highway Committee recommends approval of applicants request.

The entire parcel which is to become the drainage facility on the
west side of Tabor Road in Orient' is now completely filled and graded.
Since the underground drainage facility has already been inspected and
approved by the Superintendent of Highways, I believe I have completed
all of the requirements as stated in the contract for the exchange of
property with the Town of Southold.

I recommend that the requirement by the Planning Board
to round the corners of the lot lines be waived as unnecessary
to achieve the desired objective ~ rounding the curbing at the
corners on a 12 foot radius.

Gentlemen:
At a regular meeting held February 13, 1979, the Southold
Town Planning Board acted to approve the preliminary map of the
subdivision to be known as "Oysterponds Village" owned by Mr.
and Mrs. William Schriever. Condition 2 of the approval reads'
as follows:
"2. The creation of a cuI de sac on the westerly end of
the proposed road be waived with the agreement of the proper
agencies."
As you know, there was much opposition to the east-west
road in Mr. Schriever's subdivision going into Village Lane
because of historical and other reasons. The Planning Board
felt this road should not go into Village Lane but did not feel
there should be a cuI de sac there. May we have your approval
or disapproval of this matter.

granting approval for the subdivision known as Oysterponds
Village.
You will note that one of the conditions of the approval
requires that the Highway Committee approve the road without
a culdesac at its westerly end. It is from that point that
the walkway is to extend to Village Lane.
Would you please confirm that the Planning Board has made
the request to the Highway Department concerning the
necessary waiver so that in turn, Mr. Schriever may
prepare the final map.

there Is no possibility .or it encroaching on the corner property. To include

instead of just one. The deeds to the lots and to the road itself will be

in very tight quarters, especially on the 100 feat to the inch scale for
the filedllap. And all of this extra effort and expense serves no useful
purpose whatever.
The only purpose this could possibly serve would be to accomodate the
eventual widening of the paved road to the full 50 foot width of the ROW.
Suoh an event might be possible in the cities in the western part of Suffolk
County, but that will never happen in Orient. Therefore I ask that the
modification required by Item #5 to provide short radius curves be dropped
by the Planning B~ard.
If this requiremont cannot be eliminated, then the radi! must be
specified. From the drawing presented, it would appear logical to make
the radii 5 feet so that the 7 foot shoulder width would be preserved as
the curbing goes around the corner. That will give the Town exactiy 2.07
feet of aj,jitional property on tho corner which shows just how absurd the
requirement actu311y is.
Please let 10" know your determination.

Board at a regular meeting held February 13, 1979.
RESOLVED to grant approval to the preliminary map o~ the
subdivision to be known as "Oysterponds Village" located at Orient
and owned by William and Barbara Schriever, said map dated November
27, 1978 subject to the ~ollowing:
1. A 10 ~oot wide walkway be provided measured ~rom Village
Lane easterly ~or a distance o~ at least 73 ~eet inlength with a
barrier provided ~or protection against vehicle access to Village
Lane.
2. The creation of a cuI de sac on the westerly end of the

3. Drainage be computed by a licensed engineer.

Dear Mr. Tasker:
Mr. Schreiver met with members of the Planning Board and the Town
Board at the Supervisor's Office on Wednesday, February 7, 1979. .
The meeting was called to discuss Mr. Schriever's subdivisions and
in particular, the proposal for drainage.
During the meeting, at which I was also present, the question of
completion of the work at the drainage site at Tabor Road which is
to be exchanged with the Town was discussed.
tlr. Homan and Judge Suter, as members of the Highway Committee,
were present and concluded that that Mr. Schriever could include
in the performance bond for the adjoining subdivision an amount to
cover the fill requirements to be placed on the drainage area. Mr.
Schriever agreed to this proposal. I believe that this should
permit us to proceed to have the deeds executed so that the
exchange of property may take place. Please confirm this.
I am sending a copy of this letter to the Planning Board, although
the members of the board were present at the time of this
discussion. This letter is being sent merely to have on record
the agreement that an amount may be included in the subdivision
performance bond for the completion of the fill at the town
drainage area.

FROM LONDON:
As new owners of Brown's house we strongly oppose
the project coming into Village Lane which would inter-
fere with the existing landmark conditions of Village
Lane which is the main reason why we bought our house.
This will present serious danger for our two small
children on way to school, will bring noise, pollution
and added traffic and risks undermining value of property.

Dear Mr. Wickham:
In accordance with your request the staff has examined the proposed subdivision
layout for a 21.809 acre tract reputedly owned by William W. and Barbara D. Schriever
and offer the following comments on the map for your use.
Generally, the layout of the subdivision is considered to be satisfactory.
When the Commission reviews this proposed subdivision its primary concern will
be the impact that the subdivision will have on Main Road. The Commission usually
requires that: (1) there be no vehicular access to Lot 1 on Main Road and a note
be placed on final map stating that vehicular access to Lot 1 is restricted to
Tabor Road; (2) no driveway on Tabor Road be located closer than 50 feet to Main
Road; (3) a short radius curve be provided at the northwest corner of Lot 1 to
facilitate turning movements and to help prevent encroachment onto the lot by
vehicles; and (4) adequate stormwater disposal be provided to insure that no storm-
water resulting from the development and improvement of the subdivision or any of
its lots will flow into Main Road.
As far as the interior layout of the subdivision is concerned the following
should be given additional consideration:
1. A short radius curve should be provided at the southeast corner of Lot 8,
the northeast corner of Lot 9, and the southwest corner of Lot 6. Use of
a short radius curve will help to prevent encroachment onto the corner
property and facilitate turning movements.
2. The staff questions the need and purpose of the area on the north side of
Orient Central Cemetery that is being reserved for future right-of-way.
If this strip is developed as a road it may feed traffic directly into
Village Lane when the vacant lands to the east are developed.

3. The proposed road between Village Lane and Tabor Road appears to be satis-
factory. It will provide the residents of the subdivision access to the
business and community area on Village Lane. However, as mentioned above,
if the right-of-way to the east is developed some traffic problems may
develop. Considering the extent of the vacant lands to the east of this
subdivision and the traffic that will be generated when they are developed,
this road will function as a collector street. This function will detract
from the residential amenities of the lots along the street in addition to
causing congestion at the intersection on Village Lane.
4. It would appear that the westerly end of the proposed road (Village Lane
terminus) will be subjected to parking by those who are utilizing the busi-
ness and community facilities on Village Lane. Therefore, it is felt that
that section of the road between Village Lane and Lot Line 18-19 should be
curbed. Curbs will prevent parking on lawn areas and help to prevent break-
down of the edge of pavement. The pavement width should be adequate to
handle traffic flow and parking. A minimum width of 34 feet is necessary
(two 12' travel lanes and one 10' parking lane). Parking restrictions may
be an alternative to requiring a pavement width of 34 feet but it is felt
that curbs in this area will be necessary regardless of pavement width.
5. The subdivider is proposing a flat spot in the road grades. This should
not be permitted. Changes in road grades should be made by use of a vertical
curve.
6. There are a number of small parcels adjoining the subdivision that are re-
putedly owned by one of the subdividers. The staff questions their not
being included as part of the subdivision. If they are not included it
would appear that a number of landlocked parcels will be created.
7. The lowness of the area in the vicinity of the proposed road and private
right-of-way presents a problem. Since there is no way that stormwater can
get out of this area the design of the drainage system becomes critical.
The design capacity of this system should take into consideration the entire
tributary area and not just the runoff from the proposed road. Requiring
dry wells at roof leaders on each lot plus dry wells to handle driveway run-
off may help to minimize the runoff from the lots that will reach the drain-
age system. Lawn areas, particularly during the winter, can be a problem
even though the amount of runoff is minimal.

On a positive note, if I were to buy a lot in this develop-
ment, I certainly Vlould appreciate having no through street.
It would be an extra maseure of pro~ection for children as
well as for the entire family and an add3d plus for buying.

Gentlemen,
We wish to state our objections to the east/west road running
between Tabor Rd. and Village Lane,Orient as shown on the
Preliminary map presented by Mr.William SchrieTer for his
development known as Oysterponds Village situated in the
hamlet of Orient.
This objection has been stated at previous Planning Board
meetings: Sketch Map April 21,1974,May 5,1975 ( at this time
the Planning Board favored a cul-de-sac rather than an exit
on Village Lane) and on July 7,1975 when a Preliminary map
were presented to the board. At that time a number of Orient
residents were present and objected to access from or to the
Lane.
Our objections as follows:
1. Village Lane is too narrow wit h only one side of the street

On a positive note, if I were to buy a lot in this develop-
ment, I certainly would appreciate having no through street.
It would be an extra maasure of protection for children as

Dear Gentlemen,
We wish to raise objection to the proposed access
road into Orient Village which is intended to join Village
Lane with the projected sub-division on Tabor Road.
It is our understanding that the proposed sub-division
is planned for cluster zoning. Certainly the most desirable
characteristic of well-planned cluster zoning is that it
preserves the architectural and environmental integrity
of an area. Such integrity is now found in a more traditional
form in the historical landmark district of Orient Village.
It is a fragile environment, and its qualities are ensured
to a large degree by its road plan.
It would not be consistent for a planned community to
commit an environmental insult upon an eKisting area for
the sske of what can only be regarded,as a questionable
convenience. One would hope that individuals who choose
to live in Orient will come to enjoy, as the undersigned
cherish, the very quality which an access road would diminish.

Gentlemen:
I am writing to express my concern regarding application
by Mr. William Schreiver of Orient for a subdivision known
as Oyster Ponds Village as suggested by a map drawn by Mr.
VanTyle dated November 27, 1978. Much time and effort has
been spent by the residents of Orient to establish an
historic district in the village and the introduction of a
50' road seems contrary to these efforts. If I am not
mistaken, this matter has been discussed at length in the
past and the community's objections to this approach have
been well documented.
May I suggest that the Planning Board note the strong
objections from the residents of Orient for the plan as
currently proposed and that time be spent to work out a
suitable development proposal that takes into consideration
all parties involved. In closing may I say that I am con-
fident that no one wishes to deny Mr. Schreiver his right
to develop his property but Mr. Schreiver must realize that
the community has a right to maintain what many consider
to be a unique balance.

that in no way will this road in our estimation change the

I have studied Mr William Schriever's planned
blitzkrieg of the Village of Orient as ammended on
November 27th. 1978.
The proposed fifty foot right of way into
Village Lane is superflous and a devitilization
of the charm and heritage of the area. This heritage
now cries out to the members of the Planning Board
for protection.
The remnants of Mr Schriever~s partially completed
preambles to his previous ephemeral visions of grandeur
are still painfully visable and are a pock on the landscape.

I am totally opposed to this proposal as it would destroy
the beauty of Orient Village.

Gentlemen I
I am writing on behalf of my husband and myself in re-
gard to the proposed residential development of property between
Tabor Road and Village Lane, Orchard Street and Main Road, in
Orient by William Schriever.
As owners of a house and property on Orchard Street,
directly adjoining the Schriever property, we would like to
state that we have no quarrel with the residential development
proposed. Our concern is with the proposed access street from
the development into Village Lane.
Any new traffic directed into Village Lane seems to us
to be unwise for a number of reasons, all of which we feel certain
are apparent to you already. The overriding concern to us is the
fact that the street is already so crowded in summer that free
passageway for any emergency vehicle is virtually impossible.
We would ask you please to add our opposition to any that
may be expressed by other residents of Orient in the hope that
such opposition will be sufficient to deny developers the right
to put a road through to Village Lane.
It would seem that a cu1 de sac turnaround would serve
their purpose very well without adding dangerous traffic to an
already overburdened thoroughfare.

matter which is of grave concern to all of us.

The Orient Historic District was created through
the initiative and efforts of the Oysterponds
Historical Society. The District was officially
recognized in 1976 and entered on the National
Register of Historic Places on May 21st of that
year.
Oversight of historic districts is normally the
responsibility of an official Landmarks Commission
appointed to advise and assist town authorities.
The appointment of a Landmarks Commission for
Southold Town is still pending.
In the absence of a Landmarks Commission to act
as spokesman for the interests of the Orient His-
toric District, the Oysterponds Historical Society,
which is committed by its By-Laws to n... aid in
the preservation and maintenance of local sites
and monuments of historic interest ...n, respect-
fully wishes to go on record with the Southold
Town Board and the Planning Board to the effect
that a prime concept underlying the designation
of Historic Districts is that they are to be pro-
tected insofar as possible from inappropriate
physical changes, in order that their historical
image and integrity will be preserved under any
foreseeable circumstances.

Gentlemen:
1 heard to my dismay that you entertained on the 9th January, a change in the
plan of the development by Barbara and William Schriver at Orient to allow a 50 foot
right of way to open into the narrow Village Lane directly on the side of the property
belonging to my wife and myself.
Such a proposal was presented by the developer quite some time ago and was
rejected by you after having been vigorously opposed by the majority of the local
community. At that time you held a Hearing which filled to capacity the largest
meeting room available to you, where all attendees but one, expressed their opposition
to the developer opening a road into the scenic Village Lane; additional opposition was
expressed by a petition with more than 200 signatures.
As a result of that Hearing you recommended that the developer change his plans
so as not to insert a road into Village Lane. On the basis of such a plan, you recommen-
ded to the Board of Appeals, that two substandard size lots of the same developer on
Orchard Street be granted a variance even though both lots were contingent with his
property in the back of them and could have been marketed by him as one-acre lots,
as required by the zoning.
The entire population of the village was persuaded that you would remain constant
to your decision which was supported by the majority of interested parties, in not
allowing a road to enter into Village Lane. 1 am, therefore, at a loss to understand
how you can now consider reverting to the initial plan of the developer previously
rejected by you?
On the basis of your rejection of the developer's road opening into Village Lane,
we recently acquired additional property surrounding our house on Village Lane, which
we would have never purchased had we thought that the property may become a corner
lot, thus diminishing its desirability and market value.

You might have noticed that we have begun to landscape our newly acquired
property abutting on Village Lane in a style of an early American open garden so as
to enhance the character of the early federal Village Lane. In order to do so we
had to invest several thousand Dollars, not only for the services of the landscaper.
but also to bring in and spread on the land, several loads of top soil to replace that
surreptitiously removed by the developer prior to our taking possession of the
property .
The narrow Village Lane represents a unique assembly of early American houses
and open space and the opening into it of a new development will destroy its unspoilt
character. There is, moreover. no need for the developer to have a road opening
into Village Lane, he can develop it as previously planned using a cul-de-sac or a
U-shaped road opening into Tabor Road. It would also be in everybody's interest
that a halt be made to Mr. Schriver's continuous change of plans for his properties
which is not only unnecessarily taking your time Gentlemen, but is also making it
necessary for the local citizenry to attend meeting after meeting to listen to
Mr. Shcriver's flights of fancy from which we have to protect our landscape and way
of life in Orient.
Please be notified that we are unalterably opposed to the proposal of the
developer that a road be opened into Village Lane. Please note also that while this
letter is written on the stationery of my office. which is located in New York City,
our legal and voting permanent residence is in Orient at Village Lane.

Gentlemen:
It is our understanding that Mr. William Schriever
of Orient is about to ask permission to have his
property lying west of Tabor Road and north of Orchard
Street be given residential zoning.
This communication is written not to object to
the rezoning of this land, but to object to a 50 foot
wide right of way and road from his property into
Village Lane in the Hamlet of Orient.
As you know, New York State declared the Hamlet
of Orient an historic site in 1976.
Cutting into historic Village Lane with the road
proposed by Mr. Schriever is unnecessary to the
development he plans, since Tabor Road is the logical
exit and entrance.
But having a new road enter Village Lane could
lessen or destroy the charm which the Hamlet of Orient
now has and upon which its designation by New York
State authorities as an historic site has been granted.
As property owners in Orient, we urgently request
that Mr. Schriever's proposed road entering from his
development into Village Lane be denied.

Dear Mr. Wickham:
Last year, I have purchased a house in Orient, attracted b;1 the unspoiled
charm of this landmark village.
Now I understand that the Planning Board is contemplating permitting
Hr. William Shriever, developer, to open a road into the narrow and
picturesque Village Lane between the Constant and Moor-Jankowski properties.
I most strongly oppose this plan which would damage the unspoiled charac-
teristics of Village Lane which has for such a long time maintained its
early American characteristics. The long stretch between the Monument
and Orchard Street is particularly picturesque, especially since the
empty lots on the eastern side of the lane are presently being landscaped
in an open park land fashion. If Village Lane was declared a landmark,
it obviously indicates that it should not be changed by opening it through
a road leading into a development, which could normally be accessed to
through Tabor Lane. The developer may benefit by selling the lots at a
higher price drawing on the charm of Village Lane, but Village Lane will
not benefit by having a 50 feet wide opening into itl

Gentlemen:
Submitted herewith are twelve copies of the Preliminary Map of the
proposed Oysterponds Village subdivision together with twelve copies of
each of the following: the proposed road profile. the proposed drainage
system for the subdivision. and a map of the existing drainage system
owned by the Town of Southold on the west side of Tabor Road. The contract
for the property exchange with the Town of Southold has been signed and
the necessary legal work is in process to effect this exchange. The
public hearing on my zoning application to remove the business zone from
the subdivision has been held and there was no opposition either in
writing or voiced at the hearing. I believe the application will be
granted. Approval has been obtained from the Cluster Review Committee
of Suffolk County for the subdivision water and sewage. And sketch
plan approval has been granted for the identical map now submitted.
Therefore I believe that this subdivision is completely in order for
a preliminary hearing and I ask that this hearing be held without
delay.
My intention is to dedicate the new road to the Town of Southold
as soon as it is constructed and approved. At that time I would like
to dedicate the 50 foot strip north of Orient Central Cemetery to the
Town since I see no purpose in my continuing to own it when it cannot
be sold. If this is not possible. I would like to have the taxes
reduced to reflect the easement which the Town is taking. The private
right-of-ways leading to the recreation areas are to be deeded to the
Home Owners Association so that they can control access to the areas.
I propose to deed an easement to the Town to all or part of these
right-of-ways for the purpose of maintaining an underground drainage
system for the Town roads in the area. And the proposed drainage
system is to be installed in this right-of-way.

The road profile shows that there is 868 feet of new road within
the property lines of the subdivision. Provision has been made in the
?rofile just east of Village Lane for a rise sufficient to prevent the
normal flow of water along Village Lane from being diverted down the
new road. The 0 % slope is intended to provide for the transition and
will not actually be flat. Dropping the road below the existing grade
around 1 foot east of this rise will actually improve the fit of the
road to the contours since there is a slight knoll in that area. Also
it will minimize the slope of the road. The filling necessary west of
Tabor Road is also absolutely necessary to make the adjoining lots
attractive from Tabor Road. In fact the topsoil and loam removed from
the roadbed will be used to raise the grade about a foot for most of
the lots along Tabor Road, particularly in the area of the existing
sump. Also the right-of-way south of the new road is now flat and
much of it will be raised about a foot to provide the pitch necessary
to direct the water toward the road rather than have it accumulate in
the right-of-way. As nearly as I can estimate from the contour map,
I believe the material from the roadbed will be approximately what is
required to regrade the subdivision.
The low sppt in the new road will be 1.72 feet east of the point
of tangency in the road and thus near the center of the lots. This
conforms as nearly as possible to the existing contour and thus will
require a minimum of regrading. The profile of the road is nearly
flat for 81.67 feet each side of the low spot to reduce the velocity
of flow near the catch basins and to provide a relatively flat area
for the intersection with the right-of-way. In addition to the two
catch basins, manhole grates are provided at the curb line in the
center of the right-of-way and these will become effective in draining
the road before the water reaches the height of the curb at any point.

The drainage basins as proposed will be installed along the center-line
of the right-of-way on 17 foot centers, 9 up each right-of-way. The desired
pitch of 1/32 nd inch per foot is only 0.21 feet over the 140 feet on the
right-of-way and thus should not be any problem in the installation. By
bringing the pipe out just under the slab cover of the catch basins, the
system can be kept above the water table and still permit basins 8 feet
in height. The existing material as observed in the installation of the
system for the Town is coarse sand and gravel and should provide excellent
drainage. The two cross-over pipes in the road serve to equalize the flow
in the system and make the plumbing redundant in case one pipe is out of
service for any reason.
In designing the system it was assumed that the leaching effect of
the rings would be severely affected in time and allowance was made for
this. The total volume of the system is 52,500 gallons including the
340 feet of 12 inch pipe. And the sidewall leaching area inside the rings
is 3,684 square feet. For a road 868 feet in length and 30 feet in width,
a 1 inch rainfall will provide 16,230 gallons of water. Thus the system
can hold 3.23 inches of rainfall without any leaching at all. Each of
the two 12 inch pipes can handle at least 500 gallons per minute at the
desired pitch of 1/32 nd inch per foot and thus the system will handle
rainfall at the rate of 3.7 inches per hour with the pipes running only
half full. To handle 6 inches of rainfall in 24 hours, one would subtract
the holding capacity of the system of 52,500 gallons from the total
accumulation of 97,380 gallons giving 44,880 gallons that must leach into
the ground. For the 3,684 square feet of leaching sidewall area that
requires a leaching rate of 12.2 gallons per square foot per day or
0.00846 gallons per minute per square foot, The Soil Conservation Service
assumes a leaching rate of 1 gallon per minute per square foot for clean
sand and gravel which is more than 100 times ~rate necessary for this
design. This seems to me to be a more than adequate safety factor for
whatever factors were neglected including the known loss in leaching rate
with time. Note also that no leaching was assumed from the bottom areas
and that would add 928 square feet to the leaching area or about 25%.

In actual operation, the first fe~ basins ~ill act as filters for the
~ater received and only on rare occasions ~ill a substantial part of
the system be filled. Thus the basins near the end ~ill act as very
eff~ctive leaching basins for many many years since they ~ill rarely
be used, if at all. And those first few basins ~ill continue to act
as filters eVen after they become relatively ineffective at leaching
~ater into the ground. In my opinion, the system as proposed ~ill more
than adequately handle the drainage.
In these plans, the road is proposed as 30 feet in width bet~een
the curbs. There are only 9 lots fronting on this road though there
may be a fe~ drive~ays use the road from the corner lots. This road
serves no through traffic whatever though it may provide access to the
business district on Village Lane for some traffic not originating
in the subdivision. So a ~idth of 30 feet is more than adequate to
accomodate the traffic and parking that can be expected. The Fire
Commissioners have indicated no concern about the use of this road
and since the firehouse ~ill not be along Tabor Road under the plans
as submitted, I see no need for concern about its use by the Fire
Department. Many residents along Village Lane have objected to the
~idth of the road as being out of place in the area. In fact it runs
from Village Lane ~hich is 24 feet ~ide to Tabor Road ~hich is only
20 to 22 feet ~ide. I believe the 30 foot ~idth as proposed ~ill be
more in keeping with the other roads in the area and more than adequate
for the traffic to be expected. If it ~ere felt necessary to keep
~o lanes open at all times for high-speed traffic, I ~oulaj suggest
providing for no parking on one side of the street just as is done
on Village Lane. Of course there is no room for parking on Tabor Road
at all and the Town Board clearly indicated at one time that they
~ould budget no money ~hatever for the improvement of Tabor Road even
in cooperation with my efforts. Therefore I do not expect the To~n

to make any changes in Tabor Road as. to width, curbing, sidewalks, or
drainage in the foreseeable future. Since the residents of the area will
have ample off-street parking for all of the~ ordinary needs, the only
time they would need on-street parking would be if they were having many
guests at their home, say for a party. This would be a problem for the
lots on Tabor Road but I suppose their guests could park on the new road.
What I am concerned about is the use of Tabor Road for parking for the
Oysterponds School and for Orient Central Cemetery. This is clearly going
to be very objectionable to the owners of the ten lots on Tabor Read and
will consume all of the parking on the new road if Tabor Road is not used
for parking. I offered to provide for widening the road and for a parking
lot and both were rejected by the Town. I don't feel that it is fair for
the owners of these ten lots to have strangers parking on their front lawn
and so I hope that the Town will provide for no parking on Tabor Road
whatever until such time as the Town widens the road or provides some
alternative. One alternative would be to build the new road north of
the Orient Central Cemetery to provide parking for the Cemetery guests.
Another would be to have the Oysterponds School build more parking for
its own use. And short of rebuilding Tabor Road, I don't see any other
alternatives.
There was talk at one point of restricting the traffic flow on ~he
new road to one way. I don't see this as being necessary, but if it is
done it must provide for traffic to move in a westerly direction. With
the business district now firmly established on Village Lane and parking
there restricted to the west side, restricting traffic on the new road
to move in the easterly direction would prevent the road from being used
by outsiders to gain access to the post-office for whatever benefits the
community would gain by that, but it would require the subdivision
residents to circle block after block to get to the post-office and to
return thus greatly increasing the traffic flow throughout the village.
If anything, this would be even worse than closing off the road on the
west end, as far as increasing traffic in the village is concerned.

In constructing the new road, I plan to remove all of the topsoil
and loam from the roadbed and replace it with sand and gravel trucked
from Cutchogue if necessary. This topsoil and loam would be used to
regrade the subdivision, thus saving the expense of stripping off the
loam subsoil in order to add fill. ~his sand and gravel base will be
stabilized and graded to conform with the surface profile including
a grade of 1/4 inch per foot from the center-line to the curbs. Then
two coats of asphalt will be applied to create a durable finished
surface with a minimum of mess and delay. Alternatively, a base of
bluestone blend could be spread and compacted and sealed with either
asphalt or two coats of oil. The two coats of asphalt is now the
standard in most Towns and I hope that the Town will accept my proposal
in this regard.
You may be concerned with the fairly large trees along Tabor Road.
The two nearest the entrance to the road are spaced about 50 feet apart
but disnlaced about 2 feet to the south of the corresponding property
lines. Thus they can be preserved if desired so long as no sidewalk
is needed to Tabor Road. The limbs will have to be trimmed to get them
clear of the road, however.
As far as providing for new trees in the subdivision, 1 prefer to
have this done by planting them in the front yards of the lots rather
than along the right-of-way of the road. The existing trees along Tabor
Road are in terrible shape and some are going to rot and die from lack
of attention. I see no reason to add to the burden of maintaining trees
when the Town cannot handle what it now owns. If the trees are on the
private lots, the owners can provide maintenance when it is needed.
Also keeping the parking free of trees will improve the lighting of
the road, reduce the problem of leaves and branches in the street and
drainage system, and allow the parking to be used for the underground
utilities without interference. In fact I would prefer that the trees
on the west side of Tabor Road be removed to provide the same benefits
there, especially when the underground utilities are installed. If
they are not, the already marginal road is going to be damaged further
by the utility installation process. And then when the road is improved

later the utilities will be under the road and very likely to be damaged
during the construction of the new surface. b~ years in the construction
business I have found that people will almost always make every effort to
preserve a good tree in their front yard through the process of building
the house. If the location of the driveway is determined and allowance
is made for the installation of the cesspools and septic tank, each lot
could still provide a good location of one substantial tree in the front
yard. If these were planted now they would provide an exceptionally attrac-
tive setting for the house and still leave room for the cesspools. There
are almost no rights left in the ownership and development of property,
but if there are any at all I ask that I be allowed to decide where to
add and remove trees both in the subdivision and along the right-of-way
of the road next to ~ properties. And if I am allowed to make this one
decision, I will ask that the trees on the west side of Tabor Road be
removed and that I be allowed to plant new trees on the lots in spots
carefully selected to provide the best setting for the houses to be built.
Assuming that the trees are removed from the parking, my proposal is
to install the underground utilities entirely within the parking. The
narrow trenches used by the union contractors are impossible to fill
and compact properly and thus undermine the support for the road surface.
This is particularly important along Tabor Road but is also important
on the new road if the construction is not to be delayed through one
winter to allowfrOrsettling of the subbase. My hope is that the lines
will go underground at the pole north of my shop so that the lines and
pole in front of the shop can be removed. This will require installing
an additional pole alongside the existing pole and bracing between them
since no guy can be installed at that point. But it would make the most
attractive installation and allow the lots opposite my shop to be fed
from the transformers on the pole from the secondary now going underground
to ~ shop, thus eliminating an underground transformer installation
in the area of the shop. I have no control over this installation since
it is not on ~ property and I am not permitted to either participate in

the design or contribute toward the construction. I ~ould hope that I
can achieve some say in the design through the To~n offices ~ho clearly
have the power to control it. Apparently I ~ill have to pay for the
installation in any case. One thing I ~ill insist on is to have
Cablevision installed throughout the subdivision.
Originally 1 had planned to have short lantern-type street lights
in the subdivision. These ~ould be particularly effective if the trees
are kept out of the parking. Ho~ever, the To~n has installed high~ay-
type lighting throughout the village in spite of its designation as an
historical district and such lighting ~ould actually detract from the
sales of myl10ts. So perhaps it ~ould be better not to have any lighting
at all for no~. There are no poles, remember, and these ~ould have to be
provided and fed from the underground system. I have no idea ~hat arrange-
ment the To~n has with LILCO'to provide service to such lighting, but if
tall poles ~ere used after having put the utility lines underground, it
~ould defeat the ~hole purpose of the underground installation.
Assuming that the trees are kept out of the parking, side~alks could
be installed at some point. Ho~ever, I believe they ~ould be severely
damaged ~hen the houses are built because the heavy equipment ~ould
drive over them, the utilities ~ould have to be dug under them, and
in general they ~ould be in the ~ay of the contractor. They should be
installed upon completion of the house on the lot by the o~ner as they
are in most areas of the country. On the other hand I have thought of
installing the ramps to the drive~ays at the time the curbs are installed.
This ~ill severely restrict the location of the garage and driveway on
the lot and I ~onder ~hether I can plan that accurately for the future.
Frankly, I doubt that I can in every case. Thus I conclude that these
should be left to each o~ner to install. I do plan to install ramps
to the right-of-~ays, at least on the new road, much as 1 have sho~n in
the dra~ing of the drainage system.

larly ~ith regard to the Home Owners Association, but some modifications
~ill be necessary to accomodate the larger subdivision and the changed
ownership of the right-of-ways. I see no problem here of immediate concern

the preliminary hearing. No doubt ~e will have to discuss many of these

Gentlemen:
I want to apologize to all of you for my complete lack of decorum
at your meeting last night. Usually I have been successful in maintaining
my composure in the face of these defeats but in this particular instance
I seem to have lost control.
No project I have ever undertaken has consumed more of my efforts nor
exposed us to more financial risks than this project to develop a business
district for Orient. Nor have I ever been so emotionally exhausted as I
have in exploring one alternative after another in a futile attempt to
salvage at least a part of my project for the community. All along I
continued to hope that someone would find the courage to step forward
and abort this suicidal course of events before it was too late.
And now at the end I find myself in the position of having to beg
the Town to let me destroy the last vestige of what I worked over a
decade to achieve simply so that my wife and I can survive. It is an
intensely bitter experience for me and yet I know it has to be done.
So if you will forgive me this once, I will try to gain better
control over my emotions in the future.

Re: Oysterponds Subdivision
Dear Ms. Brush:
At t he meeting of the Planning Board on Monday, June 26,
1978, William Schriever appeared in connectiOn with the
above subdivision and asked that the board grant approval
of the sketch plans. There was some concern expressed
by the board since Mr. Schriever is in the midst of an
exchange of property at Tabor Road involving the town
recharge basin. Mr. Schriever is also in the process
of making an application for a change of zone from business
to residential which would effect two lots and part of
a third J.ot.
I have discussed this matter with Mr. Tasker and believe
he will confirm that sketch plan approval may be granted
subject to the condition that the zoning application is
granted and further, subject to the completion of the
exchange of property. For your information, the exchange of
property has been agreed to by the Town Board and the
contract for~e exchange of property is being signed by
the supervisor.
Kindly place this matter on the agenda for the next meeting
so that sketch plan approval may be obtained pursuant to
the conditions noted. Thank you.

In response to your letter of June 29th, in my opinion the Planning
Board can approve of the Schriever sketch plan at this time.
However, such approval should be subject to Schriever's applying
for and obtaining the change of zone of the business zoned property
to residential.
