All of the premises hereinabove described shall be known and designated as residential plots. Z. No structure shall be erected, altered, placed or permitted to remain on any lot other than one detached single-family dwelling not to exceed two stories in height. No dwelling shall be erected, placed or permitted to remain on any lot unless it has an enclosed garage, attached or unattached, for not less than one (1) car, and all such garages and accessory buildings must conform in architectural exterior design with the dwelling. 3. No dwelling, having a ground floor area of the main floor structure of less than one thousand two hundred (1, 200 sq, ft.) square feet, exclusive of one-story open porches and garage, shall be erected, placed or permitted to remain on any lot. 4. CORDON JAMES WALL February 28, 1977 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m. , Monday, February 280 1977 at the Town Clerk' s Office, Main Road, Southold, New York. Present were: Henry Raynor, Jr. , Vice-Chairman Frank S. Coyle Frederick E. Gordon Barzac site plan. Edward Bage, P. E. attended. Mr. Bage brought in two more copies of the site plan for an addition to Lisa' s Beauty Parlor. The plan shows drainage and exterior lighting. It will be asphalted by the North Road. It will be a one-story addition. Mr. Raynor requested a copy of the plans for the Board. Mr. Howard Terry, Building Inspector, will have to go over the plan and make his recommendations. Charles Rand property in Orient. William Smith in. Mr. Raynor had talked to the Town Attorney and it is his opinion that lots 4A, 5A and 6A are separate entities and lots there cannot be included in the other numbered lots for square footage requirements. Mr. Smith answered that the property to the north is all over 40,000 square feet. Drainage will be required for a ✓ major subdivision. The area designated as 'private beach' should be labelled 'park and playground' . Mr. Raynor said the Board takes a dim view of 15' right-of-ways. Mr. Smith asked if it was 50' would it have to be paved. They would have to use the right-of-way for access to the State road. It will be necessary to have covenants and restrictions on lots 1 and 2 not to be further subdivided. There was discussion regarding the State not accepting four driveways onto the State road. There was discussion as to what type of right-of-way would be required to a burial ground. Planning Board -5- April 4, 1977 John Vescur. Shepard Scheinberg, Esq. appeared. The minor subdivision was reviewed with the Board studying the overlay map ✓ of the area. There was talk about the possibility of selling the property nearest to South Harbor Road to the adjacent farmers. Rand subdivision. Mr. Goldberg, William Smith and Mr. Rand appeared. Sample covenants and restrictions were presented. They want to tie the property on the south side of the road to the other lots. There is no specific area for park and playground. There will have to be covenants and restrictions filed as to no further subdivision for the lots and those on the south side of the road not to be built upon. Rights-of-way are being used that are not allowed in a major subdivision. The regulations say that roads in a major subdivision shall be constructed to Town highway specifications. Mr. Wickham said we are having the building inspector say that in minor subs, they are going to have to construct to Town highway specifications because of a suit in Islip. Mr. Raynor said he had talked to the Town Attorney, Robert Tasker, and he said to eliminate the numbers across the road, because it would lead to confusion. Mr. Raynor also said the banks want a 25 foot right-of-way. Mr. Coyle said ✓ the State Dept. of Transportation doesn't like so many cuts. Mr. Wickham said the roads will have to be to Town specifications with 50 foot and 36 feet paved. Mr. Raynor thought all the property to the south should be put in common ownership in a property owners' association and designated as park and playground. There was discussion on making it a four-lot minor subdivision. Mr. Wickham thought the Board might waive the requirement for a highway built to town specifications on one corner because it is next to the Town Beach. Mr. Raynor asked if there were any existing rights-of- way and Mr. Rand said he didn't think so. * ac- g Greenbriar Acres. A letter was presented from Lawrence M. Tuthill, Town Engineer, stating that the road now lines up with the road into Tut' s Acres. Water runs past this area but sewer doesn't according to what the developers found out from the Greenport Utilities Dept. Mr. Wickham was concerned about storm water. The Southold Town Conservation Advisory Council has ✓ been asked to make an inspection of the property as far as wetlands are concerned and they will make their report shortly after the 18th of May when they meet. On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED to refer to the Town Board the proposed cluster subdivision of property of Ernest Wilsberg located in Orient for ✓ its determination as to whether it can be developed in the cluster concept. Vote of the Board: Ayes: Wickham, Coyle, Wall A meeting will be arranged for the discussion of the two changes of zone requested by Zabohonski, this meeting to be held on June 2nd. Mr. Wickham read the letter from the Southold Town Conservation Advisory Council dated May 19, 1977. Gentlemen: Our council inspected the Rand properties on May 7, 1977 as you requested. No wetlands were located on lots 1, 2, 5, 6, 7 and 8. Wetlands were indicated on the "A" lots south of the state highway. Coyle, it was RESOLVED to grant site plan approval to the plan of Colgate Design Corporation for property located at Greenport, said map revised May 23, 1977, and to be signed upon receipt of Suffolk County Health Department approval. Mr. Raynor questioned the one-foot strip and Mr. Gatz said the matter is being settled by his attorney. It will be necessary to have a 100 foot setback line from the top of the bluff and a 50 foot setback from the road. They should keep about a 60 foot area. Provisions should be made for drainage. Rand subdivision. William B. Smith and Charles Rand appeared. Mr. Wickham had a question regarding the additional covenant and restriction for the Brionngloid-by-the-Sea subdivision owned by Mr. Rand. Mr. Rand added the words "north of Route 25" , initialled it and signed the bottom. This was dated 5/23/77. Mr. Raynor remarked that he couldn't find anything in the restrictions regarding resubdivision of any lots. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to hold a public hearing on the preliminary map of the subdivision known as "Brionngloid-by-the-Sea" owned by Charles Rand and located in East Marion. i Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to release for sale lot no. 7 as shown on the subdivision map of "Brionngloid-by-the-Sea" in East Marion, ✓ subject to receipt of covenants that lots 1, 2, 3, 6 and 7 will not be further subdivided, such covenants to bind the successors in title. Vote of the Board: Ayes: Wickham, Coyle, Gordon Nay: Raynor Mr. Raynor asked to go on record as to the reason he was opposed to the above resolution. He questioned the releasing of a third of the subdivision without consultation with the Town Attorney as to the legality of the action. There was further discussion regarding requiring five per cent of the area for park and playground. Kouros. Edward Boyd, Esq. appeared. There was discussion regarding selling the piece of property with the 50 foot jog. Mr. Wickham said the Planning Board would insist ✓ that no one of these lots be further subdivided except to sell the 50 foot piece to one of the adjacent lot owners. Mr. Boyd will bring in the sketch plan. Mr. Raynor: That would also entail considerable expense. We have been down to look at it. . Mr. Wickham: If there is nothing else, I will declare the hearing closed because this is the imput we have to have. After the hearing was closed, there was more discussion on this subdivision and if the people would have any other opportunity to air their opinions. Public Hearing on the preliminary map of the subdivision of Charles Rand known as Brionn loid-b -the-Sea. Charles Rand, William B. Smith and Arthur Goldberg, Esq. , appeared. ✓" Mr. Raynor read the notice of hearing and presented affidavits of publication from the Suffolk Times and the Long Island Traveler Watchman. Mr. Wickham: (went over the checklist) I have here the report from the County. The following letter was read: Dear Mr. Wickham: In accordance with your request tYe staff has examined the proposed subdivision layout for a 18.5- acre tract reputedly owned by Charles Rand and offer the following comments on the map for your use. With the exception of the proposed points of access to the lots from Main Road the map is considered to be generally satis- factory. It has been the policy of the Commission to disapprove any subdivision map that permits vehicular access to a County or State road. It is its feeling that unrestricted vehicular access to each lot having frontage on such a road will result in inter- Planning Board -9- June 27, 1977 ference with traffic flow on that road. In the case of an existing access no objection is usually raised unless the access is contri- buting to a definite traffic problem. It is possible that the Commission may be amenable to the restriction of vehicular access to Lots 2 and 3 to the proposed right-of-way and the .creation of a similar right-of-way at Lot line 4 and 5 to serve Lots 4, 5 and 6. In the latter case this can be accomplished by relocating the proposed right-of-way along the east map line whose purpose and need is not entirely clear. It is felt that a note should be placed on the map indicating that the area lying on the south side of Main Road is to be preserved as a conservation area. At the time of formal referral information should be provided indicating: (1) the setback from the Sound; (2) that sanitary disposal facilities will not be constructed within a minimum of 100 feet of. the Sound and the upland edge of the Bay; and (3) that no stormwater runoff resulting from the development and improvement of any lot will flow out onto the State road. Staff comments on a preliminary map do not constitute a review of the map by the Suffolk County Planning Commission. When the map has been finalized it should be referred to the Commission for review pursuant to Section 1333 of the Suffolk County Charter. Very truly yours, /s/ Charles G. Secretary: Mr. Tuthill, town engineer, did not feel it was in his jurisdiction to comment as presumably the roads will not be built , to town specifications. Mr. Wickham: Since the building inspector will no longer make specific recommendations in cases of this sort, we are asking our engineer to give us specifications somewhat less than town specifi- cations and to meet with the developer. Another thing that appears to me at this time, we have spoken of it before, but lot number 5 has the greater part of it on the south side of the highway and, again, we have said that no buildings will be allowed on the south side of the highway. Does anyone wish to be heard in opposition to this subdivision? Hearing none, I will ask for those that wish to be heard in favor of it. Mr. Goldberg: You have before you the preliminary maps and the correspondence. In talking to the town attorney,. he felt it might be good for the board to have the new owner to join in the covenants and restrictions. Mr. Goldberg: They will be glad to do it. Mr. Raynor: This is probably my most major concern pertaining to this subdivision, to let a parcel of land this size get away from US. Mr. Goldberg: If the board wishes, I will have the owner of lot 7 sign covenants and restrictions and have them filed with the board. Mr. Raynor: I see the County has some recommendations, my question being for lot number 4 as to whether or not it might be to the developer's advantage to create a walkway from the northeasterly corner of lot 4 to lot 5 so that they would not have to go out onto the highway, not that it would be a restriction on the lot. It might serve a good purpose. Mr. Wickham: If there is nothing else, I will declare the hearing closed and thank you very much. Sterling Forest. Harold Reese appeared. The following letter was read .from Lawrence M. Tuthill, town engineer. 0n :tune 15, 1977 Mr, Dean and I inspected the site and noted that there are definitely clay deposits on the site. Because of the unsuitability of this clay in roads, it is recommended that these areas be removed to 4' below the proposed road grade and be filled with bankrun. It is also recommended that prior to final approval the exact location of the leaching pools be staked out and that test holes be dug in these areas. A letter is to be requested from the Supt. of Highways that he will not require a recharge basin. Planning Board • -8- filly 18, 1977 On motion made by Mr. Wickham, seconded by Mr. Gordon, it was RESOLVED to hold a public hearing on the preliminary map of the subdivision of property known as "Kouros Acres" owned by Olympia Kouros, map dated October 15, 1976 and amended June 16, 1977. Driftwood Cove. Mr. Coyle and Mr. Gordon made an inspection of this site. They noted there was a split rail fence and a stockade fence which were alright. In front of tenant 13, there is a big pile of dirt and it is not complete. There is no parking lot at the south end. It is about three-quarters completed. Morchel. Mr. Henry made an inspection of this site. There are no plantings in the front. There is no front grading and gravel where necessary. The fence is not constructed on the easterly line to stop traffic flow to Sigsbie Road. There have been several reported accidents on that intersection and as soon as possible the fence should be set up to correct the traffic problem. In a letter dated June 17, 1998 to Patricia Moore, the Planning Board stated that it did not support the proposed subdivision since as part of the subdivision approval, a Declaration of Covenants and Restrictions was filed limiting the overall number of lots to 7 (the number of lots in the original subdivision). Ms. Moore attended a Planning Board work session and argued that a title search had been conducted, and that neither the title search nor the deed for the lot reflected the condition in regard to further subdivision of the lot. The Planning Board would like your advice in regard to the above mentioned issue. I have listed some facts in regard to the original subdivision below. 1. The Brionngloid-By-the-Sea subdivision was filed in the County Clerk's Office on August 22, 1978. 2. The subject parcel is Lot #7 in the Brionngloid subdivision. The subject parcel is now known as SCTM# 1000-23-1-14.7. 3. The subject parcel is 6.7 acres (as per the tax map) and is located in the R-80 Zoning District. 4. On June 6, 1977, the Planning Board passed a resolution that Lots 1, 2, 3, 6 and 7, shall not be further subdivided. A Declaration of Covenants and Restrictions was filed limiting the overall number of lots to 7. The R.O.W., between lots 2 and 3 and partially between lots 1 and 7, runs from the State R.O.W. through a flat swampy area to an upland ridge, approximately 10 ft. higher, and then down to about the same elevation beyond. Clearing has been done on the upland. Fill, sand and gravel, has been placed from the State Road to the toe of slope at the ridge - - about 250 ft. at widths from 35 ft. to 50 ft. Some fill also placed on the upland south slope. Do not know what procedure was followed in placing fill through the swamp area. If the proposed roadway profile follows about the same existing ground elevations over the higher upland, it will create a bad situation as to sight distance and winter driving. A cut of say 51 ft. at the top of the high ground would provide a better vertical curve. Elevations should be taken on the now existing conditions to determine a suitable profile for this R.O.W. road. In case the ridge is lowered and depending on the pavement width to be used, some slope easement might be necessary. Me other road R.U.W. between lots 49 5 and 6 does not appear to have profile difficulty. most of area is in upland or fill and is cleared to a section of large boulders after the R.U.W. turns easterly. `Mere is a low area at the turn that will require fill. �/dvz2 JOHN W. Dear Mr. Wickham: The Suffolk County Planning Commission at its regular meeting on June 7, 1978, reviewed the proposed subdivision plat entitled Map of Brionngloid-By-The-Sea referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map subject fo the following conditions: 1. Stormwater runoff resulting from the development and improvement of each lot or a right-of-way shall be retained on-site by adequate drainage structures so that it will not flow out onto the State road. 2. No structures of any nature except for possibly a cat-walk or dock for a small boat shall be constructed on that portion of any lot lying be- tween Main Road an Orient Harbor. 3. In order to preserve the aesthetic and environmental attributes of the area in accordance with preliminary findings of the Coastal Zone Manage- ment Study the area between Main Road and Orient Harbor shall be made subject to a scenic or conservation easement to insure that this area remains as open space in its natural state. PROTECTIVE LIABILITY INSURANCE COVERAGE Permittee must have protective liability insurance coverage in accordance with Department requirements. Expiration of, or lack of, liability insurance automatically terminates the permit. Insurance coverage may be provided by furnishing the Department with one of the following: a. Work must start within 30 days from date of permit. Notify area gas distributors 72 hours prior to any blasting. Notify Utility Companies with facilities in work area (permission must be obtained before doing work affecting utilities' facilities) before starting work. Notify land owners of abutting lands, before disturbing trees. Notify Department of Transportation at conclusion of work and return original copy of permit to Regional Office. Annual Maintenance Permit Notifications: Notify by telephone the District or Resident Office, one week in advance, each time regular maintenance work is to be performed. In emergencies, notification by telephone should be made the next work day. 4. SITE CARE AND RESTORATION An Undertaking, a bond or certified check in an amount designated by the Department of Transportation may berequired bytheRegional Office,before a permit is issued, to guarantee restoration of the site to its original condition. If the Department is obliged to restore the site of its original condition, the costs to the Department will be deducted from the amount of the permittee's guarantee deposit at the conclusion of the work. The permittee is responsible for traffic protection and maintenance, including adequate use of signs and barriers during work and evening hours. No unnecessary obstruction is to be left on the pavement or the right of way or in such a position as to block warning signs during or between work hours. No work shall be done to obstruct drainage or divert creeks, water courses or sluices onto the right of way. All falsework must be removed and all excavations must be filled in and restored to the satisfaction of the Regional Traffic Engineer. 5. COSTS INCURRED BY ISSUANCE OF THIS PERMIT All costs beyond the limits of the protective liability insurance, surety deposits, etc., are the responsibility of the permittee. The State shall be held free of any costs incurred by the issuance of this permit, direct or indirect. 6. SUBMITTING WORK PLANS The applicant will submit work plans and/or a map as required by the Department. This shall include such details as measurements of driveways with relation to nearest corner, positions of guys supporting poles and a schedule of the number of poles and feet of excavation necessary for completion of the work on the State right of way. A description of the proposed method of construction will be included. Plan work with future adjustments in mind, as any relocation, replacement or removal of the installation authorized by this permit and made necessary by future highway maintenance, reconstruction or new construction, will be the respon- sibility of the permittee. The permittee must coordinate his work with any state construction being conducted. 7. TRAFFIC MAINTENANCE Traffic shall be maintained by the permittee on the highway, in a safe manner, during work and evening hours until its final completion. Suitable safeguards, to reduce conditions dangerous to life, limb and property to a minimum, must be provided by the permittee (including flagmen when requested by the Department). S. COST OF INSPECTION AND SUPERVISION If, in the accounts kept by the Department, costs of supervision are found to be exceedingly high, the Department re- serves the right to bill the permittee for actual expenses incurred by the supervision and inspection of the permittee's project. 9. SCOPE a. Areas Covered Permits issued ore for highways, bridges and culverts over which the New York State Deportment of Transportation has jurisdiction. (Local governments issue permits for their own jurisdiction.) b. Dear Mr. Wickham: In accordance with your request the staff has examined the proposed subdivision layout for a 18.5± acre tract reputedly owned by Charles Rand and offer the following comments on the map for your use. With the exception of the proposed points of access to the lots from Main Road the map is considered to be generally satisfactory. It has been the policy of the Commission to disapprove any subdivision map that permits vehicular access to a County or State road. It is its feeling that unrestricted vehicular access to each lot having frontage on such a road will result in interference with traffic flow on that road. In the case of an existing access no objection is usually raised unless the access is contributing to a definite traffic problem. It is possible that the Commission may be amenable to the restriction of vehicular access to Lots 2 and 3 to the proposed right-of-way and the creation of a similar right-of-way at Lot line 4 and 5 to serve Lots 4, 5 and 6. In the latter case this can be accomplished by relocating the proposed right-of-way along the east map line whose purpose and need is not entirely clear. It is felt that a note should be placed on the map indicating that the area lying on the south side of Main Road is to be preserved as a conservation area. John Wickham, Chairman Town of Southold Planning Board Southold, New York RE: Charles Rand Subdivision at Main Road, East Marion, New York Called Brionngloid By-The-Sea Dear Mr. Wickham: I would like to request that the requirement for a fifty foot road built to the Southold Town Highway' s requirement in my proposed subdivision be waived. This road actually only serves the two lots on bong Island Sound and I feel this would spoil the aesthetic value of my property and that of surrounding property owners. This road, if necessary to be a fifty foot road, would never be a collector road and also would remain private. Puture property owners would undoubtedly not maintain it curb to curb. As you can see by my plot plan the center section is being sold in a five plus acre parcel; this being done so as not to spoil the value of the large beautiful home and its surroundings. If it is possible to solve this problem with this property deeded immediately to another party, I would do so, with the two adjoin- ing parcels handled as two minor subdivisions.
