Undercliff Road, Montclair, New Jersey 07042, hereinafter called the
"0wnerll:
~'lHEREAS, the "Owner" has title to certain land situate,
lying and being at East Marion, in the Town of Southold, County of
Suffolk and State of New York, said land hereinafter being more par-
ticularly described; and
WHEREAS, it is the "Owner"'s intention that the aforesaid
lands be subdivided into a minor subdivision consisting of not more
than two (2) residential lots;
NOW, THEREFORE, the following described land shall be
restricted as hereinafter set forth:
ALL that certain plot, piece or parcel of land, with
the buildings and improvements thereon erected, sit-
uate, lying and being at East Marion, in the Town of
Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a point on the northerly line of Main
Road at the southwesterly corner of land of Jayne,
said point also being the southeasterly corner of
these premises;
running thence along the said northerly line of Main
Road in a southwesterly direction on a curve to the
right having a radius of 2259.01 feet a distance of
228.34 feet to land of woglom;
running thence along said last mentioned land North
17 degrees 06 minutes 30 seconds West 342.10 feet
to land of Shikler;
running thence along said land of Shikler North 72
degrees 53 minutes 30 seconds East 187.70 feet;
running thence North 21 degrees 21 minutes 10 seconds
West 150.19 feet;
running thence North 13 degrees 57 minutes 30 seconds
West 119.29 feet;

which is North 74 degrees 05 minutes 30 seconds East
140.0 feet;
running thence along other land of Shikler the follow-
ing four (4) courses and distances:' (1) South 18
degrees 12 minutes 50 seconds East 240.0 feet; (2)
North 71 degrees 47 minutes 10 seconds East 44.45 feet;
(3) South 18 degrees 12 minutes 50 seconds East 112.40
feet; (4) North 71 degrees 47 minutes 10 seconds East
15 feet to said land of Jayne;
running thence along said land of Jayne the following
two courses and distances: (1) South 13 degrees 57
minutes 30 seconds East 267.34 feet; (2) South 21
degrees 21 minutes 10 seconds East 453.92 feet to the
northerly line of Main Road at the point of BEGINNING.
Declarant does hereby warrant, covenant and represent that
on approval of the aforesaid described land as a minor subdivision by
the Planning Board of the Town of Southold, no further application
will be made to the Board or to any other Board in the Town of Southold
to further subdivide any of the lots set forth in said minor sub-
division into additional building lots.
Declarant does hereby further warrant, covenant, and repre-
sent that the aforedescribed land within the minor subdivision cannot
be subdivided into more than two (2) building lots.
Declarant does hereby further warrant, covenant and repre-
sent that the foregoing restrictions and agreements shall bind the
undersigned, his heirs, successors and assigns, and any and all person
or persons who shall succeed to the ownership of any of the lots shown
on the aforedescribed premises in said minor subdivision by transfer
or otherwise.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Theodore Swick is a two lot subdiv-
ision located at East Marion.
The project has been determined not to have a significant
effect on the environment for the following reasons:

An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmantal
Conservation it is assumed that there is no objection
nor comments by that agency. Applicant should be aware
that a permit may be required because of the proximity to
the wetlands.
The Suffolk County Department of Health Services has in-
dicated its agreement with the lead agency designation. A
precursory review indicated conditions are suitable for in-
dividual sewage disposal systems, however, problems may be
anticipated in obtaining potable water due to salt water in-
trusion in the area.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

The fOllowing actions were taken by the Southold Town Planning Board,
Monday, July 19, 1982:
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act in the
matter of the minor subdivision of Theodore P. Swick, located at
East Marion. An initial determination of nonsignificance has been
made.
RESOLVED that the Southold Town Planning Board approve a set-off
(106-13) as designated on the map of Theodore Swick, located at East
Marion, dated November 24, 1970 and amended May 20, 1982, with a
condition that the right-of-way be expanded to a width of 25 feet on
lots one and two.
Please submit six (6) copies of the final map, indicating the above,
so that we might proceed with the State Environmental Quality Review
Act.
